Judgment of 11 August 2006 relating to fees for processing applications for frequency assignments declared to the International Telecommunication Union and applications for authorization pursuant to Articles R. 52-3-1 and R. 52-3-4 of the Post and Electronic Communications Code

Based on the Post and Electronic Communications Code,
Stop:

Article 1


The amount of the royalty referred to in Article R. 52-3-1 of the Post and Electronic Communications Code and corresponding to the costs of processing applications for frequency assignments declared to the International Telecommunication Union is equal to the value in euros of the amount charged by the International Telecommunication Union to the National Frequency Agency for the processing of the file declared to the International Telecommunication Union increased from the amount of costs associated with the last payment of the sums.

Article 2


The amount of the allowance paid to the National Frequency Agency by any frequency assignment applicant referred to in section R. 52-3-17 of the Post and Electronic Communications Code is calculated according to the schedule. The payment, in euros, is made on an account of the National Frequency Agency opened on behalf of the accounting officer of the National Frequency Agency.

Article 3


The National Frequency Agency shall verify that the amount of the provision defined in section 2 of this Order is in accordance with the scale; if the amount is insufficient, the National Frequency Agency shall notify the applicant, by registered letter with a request for a notice of receipt, and invite him to provide the supplement.

Article 4


The amount of the royalty referred to in R. 52-3-4 and corresponding to the costs of processing by the administration of a request to operate frequency assignments to satellite systems is set at 20,000 euros.

Article 5


The present order will be issued in the Official Journal of the French Republic.

Satellite systems of the satellite amateur service are exempt from the provision.

(*) Definition of categories of coordination (C) and notification (N).
The relationship between the coordination category (C1, C2, C3) or the notification category (N1, N2, N3) and the number of types of coordination applicable to a coordination request or notification of a satellite network is as follows:
C1 and N1 correspond to a satellite network notification form involving only one type of coordination subject to cost recovery (A, B, C, D, E or F). Both categories also include cases in which no type of coordination applies in the light of the unfavourable conclusion in respect of number 11.31 of the Radiocommunication Regulations, formulated for all frequency assignments of the network subject to the notice sheet submitted, or cases with frequency assignments published only for information.
C2 and N2 correspond to a satellite network notification form involving two or three types of coordination subject to cost recovery, regardless of whether (A, B, C, D, E or F).
C3 and N3 correspond to a satellite network notification form involving four or more of four types of coordination subject to cost recovery, regardless of whether (A, B, C, D, E or F).
