Summary

The Decree of November 27, 1991 on statutory provisions applicable to the body of physicians of national education and to the employment of doctor of national education - technical advisor, provides that vacatary doctors of national education who justify an effective public service of at least four years of full-time equivalent completed in the previous eight years, may present themselves to the internal examination of access to the body of doctors of national education. However, the law of January 3, 2001 on the resorption of precarious employment has lowered from 4 to 3 years of full-time equivalent, exercised over the last 8 years, the requirement of seniority required for non-State officials to attend the reserved competitions. This draft decree provides for a reduction of four to three years of full-time equivalent, completed in the previous eight years, to the required duration of seniority, in order to allow individual physicians of national education to present the internal examination of access to the body of doctors of national education. Since the internal competition is also open to incumbent or contracted physicians of the State, territorial authorities and public institutions that depend on it, this draft decree provides for the sake of harmonization, also to amend the required seniority rules, and to lower them from 4 to 3 years of full-time equivalent. 4 (al. , 6 of 2) of Decree 91-1195 of 27-11-1991.

The Prime Minister,
On the report of the Minister of Youth, National Education and Research, the Minister of Social Affairs, Labour and Solidarity, the Minister of Economy, Finance and Industry and the Minister of Public Service, State Reform and Land Management,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to Decree No. 91-1195 of 27 November 1991 on statutory provisions applicable to the body of doctors of national education and to the employment of doctor of national technical education, as amended by Decree No. 97-383 of 16 April 1997 and No. 98-123 of 2 March 1998;
Having regard to the advice of the ministerial technical committee dated 28 March 2002;
The State Council (Financial Division) heard, Decrete:

In the first and sixth paragraphs of 2 of Article 4 of the above-mentioned Decree of 27 November 1991, the words "four years" are replaced by the words "three years".

The Minister of Social Affairs, Labour and Solidarity, the Minister of Youth, National Education and Research, the Minister of Economy, Finance and Industry and the Minister of Public Service, State Reform and Land Management are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
