Decree of 8 July 2003 on the training of maritime inspectors (technical option) recruited under articles 6 (1°) and 7 of Decree No. 97-1028 of 5 November 1997

Minister of Equipment, Transport, Housing, Tourism and the Sea,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
In view of Decree No. 97-1028 of 5 November 1997 on the status of inspectors for ocean affairs;
Having regard to the decree of 30 May 2003 on delegation of signature;
In view of the ministerial decree of 23 October 1968 creating the Maritime Training and Administrative Documentation Centre (CIDAM);
Having regard to the order of 5 April 2001 amending the Order of 23 November 1987 concerning the safety of ships;
Having regard to the technical training repository adopted by the Maritime Affairs Development Board of 25 April 2001;
Considering Decision No. 691 AT/1 of the Director of Maritime Affairs and Seafarers of 17 July 2001 creating the Maritime Safety Training Unit (UFSM);
On the proposal of the Director of Maritime Affairs and Seafarers,

  • Chapter I: Training of interns inspectors for maritime affairs (technical option) recruited under articles 6 (1°) and 7 of Decree No. 97-1028 of 5 November 1997 Article 1


    The interns inspectors of ocean affairs (technical option) recruited under articles 6 (1°) ) and 7 of the aforementioned decree of 5 November 1997 shall receive a basic training of one year, in accordance with the first paragraph of article 12 of the said decree.

    Article 2


    This training is divided into sequences related to:
    - maritime formation;
    - the administration of ocean affairs;
    - the vessel's technology;
    - internships and boarding.

    Article 3


    The various sequences of this training year correspond to:
    - applied education in accordance with the programmes set out in annexes I and II;
    - practical applications included in the annual training plan.

    Article 4


    The substances cited in the programs in Annexes I and II are subject to continuous control which may take the form of interrogations, task sheets, case studies, practical work, noted from 0 to 20. A coefficient 6 is assigned to the final score obtained from the entire continuous control.

    Article 5


    The validation review of the acquisitions takes place at the end of the sequence devoted to the vessel's technology, on the date fixed by the Director of Maritime Affairs and Seafarers who designates the review panel.
    The jury is presided over by a deputy director, or an office chief in the direction of ocean affairs and seafarers, or by a senior maritime inspector in a ship safety centre, and composed of two chief marine inspectors.
    A Marine Affairs Inspector, different from these, serves as the secretary of the jury.

    Article 6


    The validation examination of the acquired includes written tests and an oral examination.
    A coefficient 8 is assigned to this review.
    Written examinations include:
    - a composition covering the general training program in Appendix I (duration: three hours); coefficient 2);
    - the study of a concrete case concerning the technical training programme contained in Appendix II (duration: 4 hours); coefficient 3).
    The oral test consists of an interview with the jury on the basis of a specific case concerning the training programs in Annexes I and II (preparation: twenty minutes; duration: 20 minutes; coefficient 3).

    Article 7


    Internships are reported from 0 to 20.
    A coefficient 3 is assigned to the evaluation of these courses.

    Article 8


    At the end of the schooling, a general rating, expressed between 0 and 20, is assigned to each intern inspector by the director of CIDAM.
    This note is issued taking into account the work, general holding, grades obtained during this training year and any other evaluation elements relating to the ability of the officer to perform the duties of the AIM.
    A coefficient 3 is assigned to this general rating.

    Article 9


    For each intern inspector, a nominative ballot shall include the following notes:
    - the average score of continuous control (coefficient 6);
    - the average rating of the validation examination of the acquis (coefficient 8);
    - the average grade of internships (coefficient 3);
    - the general rating (coefficient 3).
    The total coefficients attributed to these notes is 20.
    It is considered to have satisfied the conditions of schooling that the intern inspectors who have gathered a minimum of 200 points on all the notes provided above.
    The general classification of interns inspectors recruited under articles 6 (1°) and 7 of the above-mentioned decree of 5 November 1997 is based on the general average resulting from the averages distributed according to the above factors.

    Article 10


    The intern inspectors who have met the conditions of schooling are registered as an inspector under the conditions set out in section 14 of the above-mentioned decree of 5 November 1997.

    Article 11


    For health reasons, or if they have not obtained the minimum of 200 points provided for in article 9 above, the interns inspectors recruited under articles 6 (1°) and 7 of the above-mentioned decree of 5 November 1997 may, on the proposal of the director of the CIDAM and after a consistent opinion of the parity administrative commission of the marine inspectors, in accordance with article 14 of the aforementioned decree, be allowed to redouble the year of first formation

  • Chapter II: Training for adaptation to the first employment of marine inspectors (technical option) recruited under Articles 6 (1°) and 7 of the decree of 5 November 1997 referred to above Article 12


    Intern inspectors who have met the educational conditions set out in section 9 above and held as inspectors are trained to adapt to the first job of six months.
    This training is focused on the regulation of vessel safety.

    Article 13


    This training corresponds to:
    - specialized education, the main subjects of which are listed in Appendix III to this Order;
    - practical applications included in the training programme.

    Article 14


    The evaluation of this first job adaptation training includes:
    - an encrypted assessment encompassing the assessments specific to each subject matter and each fiscal year requested.
    This overall evaluation, calculated on a scale of 0 to 20, is the average of all evaluations associated with this training.
    The coefficient 7 is attributed to this overall evaluation;
    - the presentation of a case study relating to the materials of this training and the courses carried out during it.
    The subject of this study is proposed by the intern inspector and validated by the director of CIDAM.
    This study is presented to a jury composed of the director of studies or his representative, a CIDAM teaching officer (UFSM) and possibly a qualified person who welcomed the inspector on probation.
    The coefficient 3 is attributed to the presentation of this case study.

    Article 15


    For each inspector, a nominative bulletin shall be issued with the following notes:
    - the average rating of the overall evaluation (coefficient 7);
    - the note obtained in the case study (coefficient 3).
    The total coefficients attributed to these notes is 10.
    The inspectors who have gathered a minimum of 100 points on all of the above-mentioned notes are considered to have met the conditions of accommodation for the first job.

    Article 16


    For health reasons, or if they have not obtained the minimum of 100 points provided for in Article 15 above, inspectors may, on the proposal of the Director of CIDAM and at their request, present themselves at a knowledge assessment test in September following the training of adaptation to the first employment of marine inspectors (technical option) recruited under Articles 6 (1°) and 7 of the decree of 5 November 1997 referred to above.
    This knowledge assessment test is organized by the GE-CIDAM (UFSM).

  • Chapter III: Issue of diploma to maritime inspectors (technical option) recruited under articles 6 (1°) and 7 of the decree of 5 November 1997 referred to above Article 17


    At the end of the adaptation training to the first job, the diploma sanctioning the training provided for in the above-mentioned April 5, 2001 order is issued to the marine inspectors having:
    - complete training, including the courses provided for in this training;
    - obtained the average score of 10 out of 20, on the one hand, following the basic training and, on the other hand, following the adaptation training to the first job.

    Article 18


    In the event of failure of the knowledge assessment test provided for in section 16 above, inspectors may apply for qualifying continuing education in force, with a view to obtaining the diploma referred to in section 17 above.

  • Chapter IV: Training of interns inspectors for maritime affairs (technical option) recruited under Article 6 (2°) of the aforementioned Decree of 5 November 1997 Article 19


    For the interns inspectors of maritime affairs (technical option) recruited under Article 6 (2°) of the above-mentioned Decree of 5 November 1997, the duration of training at CIDAM (UFSM) is one year.

    Rule 20


    This training mainly includes sequences related to:
    - the administration of ocean affairs;
    - the regulation of vessel safety,
    and application courses as well as boarding.

    Article 21


    The substances in the programs in Annexes I and IV are subject to continuous control in the form of interrogations, task sheets, case studies and practical work that are noted from 0 to 20.
    The terms and conditions for the evaluation of this continuous control are identical to those mentioned in Article 4 above.

    Article 22


    The validation examination of the acquired will take place at the end of the training.
    The procedure for organizing this review is identical to those mentioned in Article 5 above.

    Article 23


    The validation examination of the acquired includes written tests and an oral examination.
    The written tests are:
    - a composition covering the general training program in Appendix I (duration: three hours); coefficient 2);
    - the study of a concrete case relating to the technical training and safety program of vessels listed in Appendix IV (duration: four hours; coefficient 3).
    The oral test consists of an interview with the jury from a concrete case of the administration of marine affairs (preparation: twenty minutes; duration: twenty minutes; coefficient 3).

    Article 24


    The provisions for the evaluation of internships, the allocation of the general fitness note and the obtaining of a minimum of points are identical to those mentioned in sections 7, 8 and 9.

    Rule 25


    The general classification of interns inspectors recruited under Article 6 (2°) of the above-mentioned Decree of 5 November 1997 is based on the general average resulting from the averages distributed according to the above factors.

    Rule 26


    The intern inspectors who have met the school conditions are registered as an inspector of ocean affairs under the conditions set out in the above-mentioned decree of 5 November 1997.

    Rule 27


    For health reasons or if they have not obtained the minimum of 200 points provided for in Article 9 above, trainees recruited under Article 6 (2°) of the decree of 5 November 1997 referred to above may, on the proposal of the director of the CIDAM and after a consistent opinion of the administrative commission of the marine inspectors, in accordance with the article of the decree referred to above, be allowed to redouble the training year provided for in the first paragraph

  • Chapter V: Diploma delivery to Marine Affairs Inspectors (technical option) recruited under Article 6 (2°) of the above-mentioned Decree of 5 November 1997 Rule 28


    At the end of the training, the diploma sanctioning the training provided for in the above-mentioned April 5, 2001 order is issued to the marine inspectors having:
    - complete training, including the courses provided for in this training;
    - and obtained on all notes a minimum of 200 points.

  • Chapter VI: Miscellaneous provisions Rule 29


    The provisions of this Order will come into force as of 1 September 2003 for intern inspectors recruited for the year 2003.

    Rule 30


    The Director of Maritime Affairs and Seafarers is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
