Judgment of July 25, 2007 relating to a collective lifting of the measures to reserve part of the harvests 1998, 1999, 2000, 2002, 2004 and 2005 claimed in controlled label of origin " Champagne"

Having regard to Council Regulation (EC) No. 1493/1999 of 17 May 1999 concerning the joint organization of the wine market;
Having regard to the amended Act of 12 April 1941 establishing an inter-professional committee of Champagne wine;
Having regard to the decree of 25 January 2007 concerning the organization and operation of the inter-professional committee of Champagne wine;
Having regard to the decrees of 26 January 2001, 12 August 2002, 15 November 2002, 13 January 2004 and 4 April 2005 relating to the approval of decisions taken by the Inter-Professional Committee on Champagne Wine,
Stop:

Article 1


The provisions of Decision No. 168 taken by the interprofessional committee of the Champagne wine, on June 13, 2007, relating to a collective lifting of the measures to reserve part of the harvests 1998, 2000, 2002, 2004 and 2005 claimed in the controlled label of origin "Champagne", which is annexed to this decree in accordance with Article 41 of the regulation (EC) n° 1493/1999 referred to above, are approved and made mandatory for the cooperatives

Article 2


The Director General of Economic, European and International Policy, the Director General of Competition, Consumption and Suppression of Frauds and the Director General of Customs and Indirect Rights are responsible, each with respect to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.

(Decision No. 168)


The Interprofessional Committee of Champagne Wine,
Having regard to the amended Act of 12 April 1941 establishing the Interprofessional Committee of Champagne Wine;
Having regard to the decree of 25 January 2007 concerning the organization and operation of the inter-professional committee of Champagne wine;
Having regard to Article 41 of Council Regulation (EC) No. 1493/1999 of 17 May 1999 concerning the joint organization of the wine market;
In view of the decisions of CIVC V.4.1998 of 8 September 1998 relating to the reserve of part of the harvest 1998, V.4.1999 of 7 September 1999 on the reserve of part of the harvest 1999, V.2.2000 of 4 September 2000 on the reserve of part of the harvest 2000, V.5.2002 of 3 September 2002 on the reserve of part of the harvest 2002, V.2.2004 of 8 September 2002
In view of the deliberation of the Executive Office of 13 June 2007,
Decides:


Article 1
Review of reserve measures


The measures taken to reserve part of the harvests 1998, 1999, 2000, 2002, 2004 and 2005 fixed by Article 1st of the decision of CIVC V.4.1998 of 8 September 1998, Article 1st of the decision of CIVC V.4.1999 of 7 September 1999, Article 1st of the decision of CIVC V.2.2000 of 4 September 2000, Article 1st of the decision of CIVCange V.5.2002 of 3 September
- the lifting shall apply, as appropriate, first to the quantities from the 1998 harvest and then to the quantities from the 1999 harvests, 2000, 2002, 2004 and 2005;
- the lifting shall apply, in a proportional manner, and in any place of storage (in the collector, in cooperatives and/or in collectives in one or more dealers-manipulators), both to the quantities subject to a contractual obligation of sale and to the other quantities.


Article 2
Recollectors concerned


All natural or legal persons who have subscribed a declaration of harvest after the harvest 2006 and who hold quantities placed in reserve equal to or greater than 1,600 kilograms of grapes per hectare are beneficiaries of the lifting provided for in section 1 above.


Article 3
Effective date of lift


The date of the lifting is 1 August 2007.


Article 4
Consequences of lifting


1. The amounts referred to by the lifting referred to in Article 1 above which are subject to a contractual obligation of sale and purchase shall be subject, from the date fixed in Article 3 above, to transactions, in accordance with and in accordance with the contracts entered into, between the sellers and the buyers.
2. The quantities covered by the lifting provided for in Article 1 above that are not subject to a contractual obligation of sale may result in transactions in the market of the clear wines of the 2007-2008 campaign.
3. All quantities covered by the lifting provided for in Article 1 above may be drawn in bottles from 1 October 2007.


Article 5
Application methods


The terms and conditions for the application of this decision are the subject of one or more circulars of the interprofessional committee of Champagne wine.


Article 6
Penalties for offences


In the event of a breach of the mandatory provisions of this decision, the inter-professional committee of Champagne wine may implement the penalties provided for in Article 11 of the Act of 12 April 1941, which are in force on the day of the finding of the offence.
