Order of 15 July 2005 approving a professional organization for the execution of industrial statistics surveys

The Minister of Economy, Finance and Industry and the Minister for Agriculture and Fisheries,
In view of Council Regulation (EEC) No 3924/91 of 19 December 1991 on the creation of a Community survey on industrial production (PRODCOM Regulation);
Having regard to Council Regulation (EC) No 322/97 of 17 February 1997 on Community statistics;
In view of Regulation (EC) No 1165/98 of the Council of 19 May 1998 concerning short-term statistics;
As amended by Act No. 51-711 of 7 June 1951 on the obligation, coordination and confidentiality of statistics, and in particular Article 4 thereof;
In the light of Law No. 79-18 Of 3 January 1979 on the archives;
In view of Act No. 94-126 of 11 February 1994 on The initiative and the individual enterprise;
In light of Decree No. 73-314 of 14 March 1973, as amended to create a national identification system and a directory of enterprises and their establishments;
Given the decree n ° 2002-1622 of 31 December 2002 approving the nomenclatures of activities and products;
In light of Decree No. 2005-333 of 7 April 2005 on the National Statistical Information Council and the Committee on Statistical Information;
In the light of Decree No. 2005-662 of 9 June 2005 on contributions from the Minister of Agriculture and Fisheries;
In view of Decree No. 2005-671 of 16 June 2005 on the powers of the Minister for the Economy, Finance and Industry;
In view of the orders of 22 March 1965 approved by professional bodies for the execution of industrial statistics ;
In view of the Decree of 22 February 1985 on the organisation and remit of the agricultural statistics services of the Ministry of Agriculture, Stop:

Item 1


The said March 22, 1965, orders for the Union of Spirits Consumed in Water and the Union Manufacturers of liqueurs for the performance of industrial statistics are repealed.

Article 2


The French Federation Of spirits (FFS), 7, rue de Madrid, 75008 Paris, is approved, in the Conditions laid down by the law of 7 June 1951 and the aforementioned decree of 7 April 2005 for the execution of industrial statistical surveys in the branches' Natural life-water production " And " Manufacture of spirits " Classified in activities 15.9A and 15.9B by reference to the abovementioned nomenclatures.
The programme of investigations shall be fixed annually by the administrative authority which decides on the compulsory nature of investigations in accordance with Article 1 (first Paragraph) of the aforementioned Law of 7 June 1951.

Article 3


The approval provided for in Article 2 shall be valid, subject to the option provided for in Article 4 of the Law of 7 June 1951 and Article 14 of the Decree of 7 April 2005 referred to above, in respect of all undertakings belonging to the FFS or trade unions affiliated with the FFS carrying on an activity belonging to the industries referred to in Article 2.
The list of units questioned is Set by reference to the SIRENE directory created by the aforementioned decree of 14 March 1973. All exchanges of information on enterprises and establishments between the investigating service and the FFS use the SIREN and SIRET identification numbers of these units.
A complete list of the units being interviewed must be provided to the An investigative service at least once a year at the time of the first investigation of each periodicity. Any changes to this list during the year must be done in accordance with the investigating department.

Item 4


Service Competent investigator within the meaning of the law of 7 June 1951 and of the decree of 7 April 2005 referred to above for the investigations referred to above is the central service of the statistical surveys and studies (SCEES) of the Ministry responsible for agriculture
Exercising at any level an activity belonging to the branches of Production referred to in Article 2 of this Order, who wish to reply directly to the investigating service, shall exercise the option provided for in Article 4 of the aforementioned Law of 7 June 1951 by sending a registered letter with a request to that service Notice of Receipt indicating their intention to respond directly. The option can be exercised during the year to take effect the following calendar year.
The Investigator Service itself sends the questionnaires to these companies.

Article 5


The statistical surveys carried out under this Order are primarily the measurement of industrial production. The investigations will be carried out in accordance with a specification drawn up by the investigating service after consulting the FFS and describing the provisions aimed at ensuring the production of quality statistical
. Investigations, which may be annual or sub-annual, shall be determined by the investigating service after the FFS has been consulted.

Article 6


Questions may be raised, after agreement between FFS and the service Investigator, or on product lines that will be used to reconstruct the headings " PRODCOM headings ", the list of which shall be updated annually in accordance with the Council Regulation of 19 December 1991 referred to above, or on product lines for reconstituting the" Control-series " The industrial production index for its calculation in the framework of the Council Regulation of 19 May 1998. Article 7


In the context of Annual survey programme established by the National Statistical Information Council (CNIS) and adopted by the Minister responsible for INSEE, the survey questionnaires are developed jointly by the FFS and the investigating department, and arrested by the Last. They are presented on the Minister's joint endorsement by INSEE and the Minister responsible for agriculture. Printing is charged to the FFS.

Item 8

Article 9


Any publication of survey results by FFS respects the rules of statistical confidentiality and the protection of personal freedoms. It refers to the name of the investigating department.

Article 10


For the purposes of the above texts, the FFS addresses the service , within the time-limits fixed by the latter, the elements necessary for it, in particular those enabling, where appropriate, to initiate the litigation procedure provided for in Articles 15 and 16 of the aforementioned decree of 7 April 2005.

Section 11


The questionnaires are kept by the FFS until they are archived in accordance with the aforementioned Act of January 3, 1979.

Article 12


The FFS may be relieved of the work of which it has accepted the execution under this Order, having sent to the investigating service a request to that effect at least six months prior to the beginning of the The next year's survey program. This request may become effective and release the FFS from its obligations only after the current year's investigation program has been completed within the meaning of this Order.

Article 13


When the FFS ceases to be approved either pursuant to the preceding Article, or following a withdrawal of approval under the conditions laid down in Article 13 of the Decree of 7 April 2005 referred to above, it must provide the investigator with all the questionnaires Collected in accordance with the aforementioned Law of 7 June 1951, which is still in its possession and which has not yet been paid to the archives pursuant to Article 11 of this Order.

Article 14


FFS may not use the individual information from the surveys provided for in this Order for purposes other than statistics.

The Director General of the Institut national de la statistique et des études économiques (INSEE) and the Secretary General of the Ministry of Agriculture and Fisheries are responsible for the implementation of the present Order, to be published in the Official Journal of the French Republic.
