In view of Decree No. 2002-728 of 30 April 2002 on classification Hierarchical of the ranks and jobs of the staff placed under the special status of the decentralised services of the prison administration, Décrète:
A liability allowance may also be allocated to In the duties of:
-Director of Prison and Probation Services;
-the head of a penitentiary institution and assistant to the head of establishment.
A joint order of the Minister of Justice, the Minister responsible for the budget and the Minister responsible for the Public Service sets the annual reference amounts of the liability allowance corresponding to each of the jobs or Each grade, by level of responsibility, of the personnel concerned in Articles 1 and 2 of this Decree.
The amounts of the individual liability allowance may be modulated according to the way in which the agent is used, but without being able to be less than 80 % of the reference amount and Greater than 120 % of the same amount.
For the set Of beneficiaries of the liability allowance, the average level of individual modulation coefficients shall not exceed 105 %.
Assigning The indemnity of liability established by this Decree shall be exclusive of the allowance for penitentiary expenses.
Decree No. 99-903 of 25 October 1999 for the award of a liability allowance to Executives and certain staff of the Prison Service is repealed.
The Minister of Economy, Finance and Industry, the Minister of Justice, the Minister of Justice, the Minister of the Public Service and the Minister Delegate to the Budget and State Reform, Government Spokesperson, are: Entrusted, each as far as it is concerned, with the execution of this Decree, which will be published in the Official Journal of the French Republic and takes effect from 1 January 2005.
