Order of 26 April 2005 amending the order of 21 December 2004 concerning the transport of Dangerous goods by rail (said " RID ")

Minister of Economy, Finance and Industry, Minister of Equipment, Transportation, Spatial Planning, Tourism and the Sea, and Minister of Ecology and Development Sustainable,
In view of Annex I to Appendix B to the Convention on International Carriage by Rail (Convention on the COTIF ") Concerning the regulation concerning the international carriage of dangerous goods by rail (regulation said ' RID "), as applicable from 1 January 2005;
Having regard to Council Directive 96 /35/EC of 3 June 1996 on the designation and the professional qualification of safety advisers for road, rail or rail transport By inland waterway of dangerous goods;
Having regard to Council Directive 96 /49/EC of 23 July 1996 on the approximation of the laws of the Member States concerning the transport of dangerous goods by rail ;
In view of Law No. 263 of 5 February 1942 on the transport of dangerous goods;
In view of the law n ° 75-1335 of 31 December 1975 on the recognition and enforcement of public and private transport offences;
In light of Decree No. 77-1331 of 30 November 1977 on certain infringements of the Regulation on the transport of dangerous substances;
Having regard to Decree No. 2000-286 of 30 March 2000 on the safety of the national rail network;
Having regard to Decree No. 2001-386 of 3 May 2001 on transportable pressure equipment ;
In view of Decree No. 2003-194 of 7 March 2003 on the use of the national rail network;
Having regard to the amended Order of 19 November 1995 on the control of emissions of volatile organic compounds;
In view of the amended Order of 1 June 2001 on the transport of dangerous goods by road (said: ADR ") ;
In view of the order of 5 June 2001, as last amended by the order of 9 December 2003, concerning the transport of dangerous goods by rail (said ' RID ") ;
In view of the Order of 21 December 2004 amending the amended Order of 5 June 2001 on the transport of dangerous goods by rail (said ' RID ") ;
In view of the opinion of the Interministerial Committee on the Transport of Dangerous Goods (CITMD) on 20 October 2004,

Article 1


Order of December 21, 2004 says " RID " Is modified as follows:
" Art. 3. -Decisions and opinions of the competent authority.
Amend the table to read as follows:
In the 15th line, the contents are as follows: " Test procedures for the battery wagons referred to in 6.8.2.4.5 and relating to the operations referred to in 6.8.2.4.2. And 6.8.2.4.3.
In the last line, replace the existing text with the following: " Test tests for tanks and their equipment for tank cars referred to in 6.8.2.4.5 made by an expert recognized according to 6.8.2.4.6 and relating to the operations referred to in 6.8.2.4.1, 6.8.2.4.2, 6.8.2.4.3 and 6.8.2.4.4 (except Operations related to a change in prototype approval); "

The Director of Land Transport and the Director General of Nuclear Safety and Radiation Protection are Responsible for the execution of this Order, each of which will be published in the Official Journal of the French Republic.
