The provisions of this Order are made for the application of the provisions of Articles R. 134-1 to R. 134-5 of the Construction and Construction Code. The dwelling, with the exception of the overseas departments, in respect of rentals of existing buildings for primary use.
For the purposes of this Order:
-the lots considered are the premises for which energy is Used to regulate the inside temperature for human occupation;
-by " Renewable energy produced by permanently installed equipment " means the supply of renewable energy by equipment located in the building, on the parcel or in immediate proximity;
-for cooling purposes, Greenhouse gas emissions considered do not take into account the emissions of refrigerant fluids.

  • Chapter I: Energy performance diagnosis for an individual house proposed globally for lease Article 2


    The provisions of this chapter apply to the overall rental of an individual house with no more than two Housing, in which energy is used to regulate the inside temperature.

    Article 3


    The performance diagnosis Includes the following elements:
    1. The identification of the house and its living space, as set out in Annex 1 to this Decree;
    2. A description of the main thermal and geometric characteristics of the house and its energy equipment, including the Equipment using renewable energies produced by the remaining installed equipment; this description shall be drawn up in accordance with Annex 1.1 to this Decree;
    3.a By type of energy, the annual quantities of final energy Necessary for heating, hot water production and cooling:
    -equal, for individual houses completed before 1 January 1948, to the average of the actual consumption of the house over the last three years Prior to diagnosis. In the absence of information on the average of actual consumption over the last three years, the average can be calculated on the actual duration of the supply of heating or hot water. In the particular case where the energy performance diagnosis is established before 1 July 2008 on behalf of an owner with more than 500 units, consumption estimates can be made on the basis of a single Billing or metering year. The conversion factors in kilowatt hours of the identified energies are defined in Appendix 3.1.

    3.d A classification of the total amount of primary energy for heating, hot water and cooling of the premises of the house according to a reference scale noted from A to G, as indicated in Annex 3.2 to this Order, according to the Value of the ratio of this quantity to the living space of the house;
    4.a The annual indicative amount of greenhouse gases emitted to the atmosphere due to the quantities of final energy for heating, hot water and water Cooling of premises, expressed in equivalent quantity of carbon dioxide, calculated according to the conventions mentioned in Annex 4.1 to this Decree;
    4.b A classification of the quantity of greenhouse gases mentioned in 4.a of the house According to a reference scale noted from A to G, as shown in Annex 4.2 to this Order, based on the value of the ratio of that quantity to the living area of the house;
    5. The share of the quantity of primary energy of renewable origin generated by equipment installed at home, where this quantity can be estimated or measured;

    7. Depending on the type of estimate applied, the reference to the calculation method used and its version, or the reference to the reporting period under consideration;
    8. The date of the order in force on the day of the development of the diagnosis, which sets the energy prices in the energy rate table set out in Annex 5.

    Item 4


    I. -The energy performance diagnosis shall be determined according to the choices made according to model 6.A (conventional method) or model 6.B (consumption readings) specified in Annex 6 to this decree.
    II. -Notwithstanding the provisions of Article 3, the energy performance diagnosis submitted with a seasonal rental contract shall include the elements defined in 1, 3.d and 4.b of Article 3 above, and recommendations for improvement of the Thermal management of the asset and its equipment to reduce energy consumption. These elements are provided in accordance with the model set out in Annex 6.C of this Order

  • Chapter II: Energy performance diagnosis of a building or lot of building for primary use with a mode Common heating or hot water production and for which an energy performance diagnosis has not been made in the building Article 5


    The provisions of sections 5 to 7 apply to the private parts of the lot assigned to the dwelling and located in a building for primary use with a common mode of heating or hot water production and for Which has not been made a diagnostic of energy performance in the building.

    Item 6


    I. -For the purpose of making a diagnosis of energy performance of the lot, the owner of the common heating equipment, the hot water of the premises, his agent or the trade union of the co-owners, shall provide to any owner making a Energy performance diagnosis:
    1.     III. -The energy performance diagnosis has the following elements:
    1. The identification of the building and the lot and the living area of the lot, as set out in Annex 1;
    2. A description of the main thermal and geometric characteristics of the private part of the lot, as well as the description of the Common heating systems, of the production of hot water from premises, including equipment using renewable energies produced by the equipment installed in the home; this description shall be established in accordance with Annex 1.1 to the Hereby arrested;

    6. Recommendations for the work and improvement of the thermal management of the private part of the lot and the equipment installed in it, aimed at reducing its energy consumption;
    7. The statement of the period of consumption readings considered;
    8. The date of the order in force on the day of the development of the diagnostic that sets energy prices in the Energy Rate Table set out in Schedule 5.
    IV. -Where it is impossible to distinguish the quantities of energy consumed for heating and for the production of hot water, the information referred to in 3 and 5 of III shall be provided for the total of the corresponding consumption.

    Article 7


    I. -The energy performance diagnosis shall be based on the model specified in Annex 6.B of this
    . -Notwithstanding the provisions of Article 6, the energy performance diagnosis submitted with a seasonal rental contract shall include the elements defined in 1, 3 d and 4b of Article 6 above, and recommendations for improvement of the Thermal management of the asset and its equipment to reduce energy consumption. These elements are provided in accordance with the model set out in Annex 6.C of this Decree

  • Chapter III: Energy performance diagnosis of a lot provided with individual heating, located in a building for residential use And for which a diagnosis has not been made in the building Article 8

    7. Depending on the type of estimate applicable, the reference to the calculation method used and its version, or the reference to the reporting period under consideration;
    8. The date of the order in force on the day of the development of the diagnostic that sets the energy prices in the Energy Rate Table set out in Schedule 5.
    II. -Where it is impossible to distinguish the quantities of energy consumed for heating and for the production of hot water, the information referred to in 3 and 5 of the I shall be provided for the total of the corresponding consumption.

    Article 10


    I. -The energy performance diagnosis shall be determined according to the choices made according to model 6.A (conventional method) or model 6.B (consumption readings) specified in Annex 6 to this decree.
    II. -Notwithstanding the provisions of Article 6, the energy performance diagnosis submitted with a seasonal rental contract shall include the elements defined in 1, 3 d and 4b of Article 9 above, and recommendations for improvement of the Thermal management of the asset and its equipment to reduce energy consumption. These elements are provided in accordance with the model set out in Annex 6.C of this Decree

  • Chapter IV: Energy performance diagnosis established for a collective building for primary use of housing Article 11


    The provisions of this Chapter apply to collective buildings for primary use, that they are filled A collective or individual heating mode, for which an energy performance diagnosis has been made for the entire building.

    Item 12


    I. -The energy performance diagnosis for a building as a whole has the following elements:
    1. The identification of the building and its habitable area, calculated according to the provisions of Annex 1.
    2. A description of the main thermal and geometric characteristics of the building and its energy equipment, including the Equipment using renewable energies produced by the remaining installed equipment; this description shall be drawn up in accordance with Annex 1 to this decree.
    3.a By type of energy, the amount of final energy required for heating And to the sanitary hot water supply of the good, calculated:
    -for buildings completed before 1 January 1948, from the annual final energy ratios necessary for heating, the production of hot water and the Cooling for the entire building.

    2. A description of the main thermal and geometric characteristics of the housing and its energy equipment, Including equipment using renewable energies produced by the equipment installed permanently; this description shall be drawn up in accordance with Annex 1 to this Order.

    Article 16


    I. -The energy performance diagnosis shall be determined according to the choices made according to model 6.A (conventional method) or model 6.B (consumption readings) specified in Annex 6 to this decree.
    II. -Notwithstanding the provisions of Article 15, the energy performance diagnosis submitted with a seasonal rental contract shall include the elements defined in 1, 3d and 4b of Article 15, above, and recommendations for improvement of the Thermal management of the asset and its equipment to reduce energy consumption. These elements shall be provided in accordance with the model set out in Annex 6.C of this Order

  • Chapter VI: Final Provisions Article 17


    An energy performance diagnosis established for the sale or construction of a property in accordance with the provisions of sections R. 134-1 to R. 134-5 of the Construction and Housing Code shall be diagnostic of Energy performance to lease.

    Article 18


    The Director General of Town Planning, Habitat and Construction and the Director General of Energy and Raw Materials shall each have responsibility for the execution of this Order, which shall be published in the Official Journal of the French Republic.
