Decision No. 2002-935 dated 22 October 2002 fixing the conditions of#039; the use of low-power and low-power radio installations in the band 868-870 MHz

Telecommunications Policy Authority,
Seen Directive 98 /34/EC of the European Parliament and of the Council of 22 June 1998 laying down an information procedure in the field of technical standards and regulations and the rules on the services of the information society, in particular the Notification n ° 2002 /230/F;
In view of Decision ERC/DEC/( 01) 09 of the European Conference of Postal and Telecommunications Administrations of 12 March 2001 on low-range equipment for alarms operating in the bands 868.60-868.70 MHz, 869.25-869.30 MHz and 869.65-869.70 MHz;
In view of Decision ERC/DEC/( 97) 06 of the European Conference of Postal and Telecommunications Administrations of 30 June 1997 allocating a band of harmonised frequencies for systems Social alarm;
In view of recommendation ERC/REC/70-03 of the European Conference of Postal and Telecommunications Administrations on the use of low-range devices, and in particular its annexes 1 and 7;
Given the code of Posts and telecommunications, and in particular Articles L. 33-3 (5 °), L. 36-6 (4 °) and L. 36-7 (6 °);
In view of the order of 7 December 1998 approving Decision No 98-865 of the Telecommunications Regulatory Authority of 21 October 1998, Setting the conditions for the use of low-range devices operating in the frequency band 868-870 MHz;
In view of Decision No. 2002-939 of the Telecommunications Regulatory Authority, dated 22 October 2002, Frequencies at low-power and low-power radio facilities in the band 868-870 MHz;
The Advisory Radio Advisory Board was consulted on February 13, 2002;
After deliberation on October 22 2002,
On the legal framework:
In accordance with Article L. 33-3 (5 °) of the Postal Code and Telecommunications, radio installations not using frequencies specifically assigned to their users are established Freely. Their conditions of use shall be defined by decision of the Authority pursuant to Article L. 36-6 (4) of the Postal Code and telecommunications and published in the Official Journal, after approval by the Minister responsible for
Low-range devices, as defined in decisions ERC/DEC/( 01) 09 and ERC/DEC/( 97) 06 and in recommendation ERC/REC/70-03 above, referring to the harmonised standard EN 300 220-3 of the ETSI or any other Equivalent standard is covered by these provisions. The same applies to low-range devices that use an appropriate access protocol for the transmission of data referring to the EN 301 391 standard of the ETSI or to the harmonised standard which will replace it or any other recognized standard Equivalent.
Low-range devices allow different types of wireless applications, including remote control and remote control, telemetry, alarms and data transmission. Their conditions of use are laid down in this Decision.
In accordance with Directive 99 /5/EC of the European Parliament and of the Council, and in particular Article 4.1 thereof, the Member States shall notify the Commission of the interfaces they have
On frequencies:
The Authority has, by Decision No. 2002-939, allocated frequencies for the operation of low-power and low-power radio installations in the band 868-870 MHz.
On the advisability of authorizing low-power and low-power radio installations in the band 868-870 MHz:
Considering France's interest in the development of low-power radio installations Which operates on frequencies harmonised at European level, the Authority considers it necessary to lay down by this Decision the conditions for the use of such installations in the frequency band concerned,
Decides:

Item 1


Low-power, low-power radio installations operate in the frequency band Is intended for use solely for the purpose of short-range transmission. They shall be freely established provided that their use complies with the conditions laid down in this Decision.

Article 2


Only allowed the use of an embedded antenna or antenna recommended by the manufacturer in the use record.

Article 3


Low-power, low-power radio installations operate on a non-interference basis with no guarantee of protection. As a result, the user should not cause discomfort to other authorized users and is not guaranteed the availability of a frequency.

Item 4


Decision No. 98-865 dated October 21, 1998, is repealed.

The Director General of the Authority is responsible for the implementation of this Decision, which will be published in the Official Journal of the French Republic, after its approval by the Minister responsible for telecommunications.
