Summary

Under Order 58-696 dated August 6 1958 on the special status of the staff of the external services of the .penitentiary administration, the bodies placed under special status are classified out of category for the fixing of their processing indices. The order provides that these indices are adopted by decrees made in the Council of Ministers. This is why Decree No. 48-1108 of 10 July 1948 on the hierarchical classification of the ranks and jobs of the civilian and military personnel of the State concerned The general pension scheme was amended by the Decree of 21 November 1966 on the fixing of the indicial classification of the staff of the external services of the prison administration. The latter text has been the subject of consultation in Council of Ministers. Considering that the consultation procedure of the Council of Ministers generates an influx of cases too important to the Council, it has been decided that the provisions laid down in the Article 4 of Ordinance 58-696 of 6 August 1958 would no longer be implemented and that the amendment of the decree of 1966 would be made by simple decree desormal.The indicial decrees concerning the staff of the prison administration do not The penitentiary administration was confronted with an alternative procedure, adopted the rule of amendment of the 1948 text which presupposes consultation of the senior council of the civil service or the elaboration of a Autonomous decree which is not subject to any consultation.
