    The Prime Minister,
    On the report of the Minister of Employment and Solidarity, the Minister of Economy, Finance and Industry and the Minister for the Public Service and the reform of the State,
    In the light of Law No. 83-634 of 13 July 1983 amended on the rights and obligations of civil servants, together with the law N ° 84-16 of 11 January 1984, amended laying down statutory provisions relating to the public service of the State;
    Having regard to Act No. 2001-2 of 3 January 2001 on the reduction of precarious employment and the modernisation of recruitment in the Public service as well as working time in the territorial civil service;
    Given the amended Decree No. 70-79 of 27 January 1970 on the organisation of careers of officials of categories C and D;
    In light of Decree No. 90-975 of the 30 October 1990 amended concerning the special status of the body of health-study engineers;
    Given Decree No. 92-1437 of 30 December 1992 on the specific statutes of health workers and health assistants;
    In view of Decree No. 93-292 Of 8 March 1993 as amended bearing in mind the special status of the body of general education teachers of the National Institute for the Blind;
    In view of Decree No. 93-293 of 8 March 1993, amending the special status of the body of teachers General education of the national institutes of the deaf;
    In the light of Decree No. 93-294 of 8 March 1993, amending the special status of the body of technical teaching teachers of the national institutes of deaf and deaf youth National des jeunes blind;
    In light of Decree No. 94-464 of 3 June 1994 on the special status of the body of the specialised educators of the national institutes of the deaf and of the National Institute for the Blind;

    In the light of Decree No. 95-1156 On 2 November 1995 on the special status of the body of health and social affairs inspectors;
    Having regard to Decree No. 96-41 of 17 January 1996 on the special status of health technicians;
    In view of Decree No. 97-364 of 18 April 1997 on the special status of the body of labour inspectors;
    Having regard to Decree No. 2001-834 of 12 September 2001 on the recognition of professional experience as equivalent to the conditions of qualifications or diplomas required for To submit to the competitions and professional examinations set aside pursuant to Article 1 of Act No. 2001-2 of 3 January 2001 on the reduction of precarious employment and the modernisation of recruitment in the civil service, Working time in the territorial public service;
    Having regard to the opinion of the Joint Ministerial Technical Committee of 10 December 2001;
    The Council of State (Finance Section) heard,
    Describes:

    • TITLE I: PROVISIONS RELATING TO THE ORGANISATION OF RESERVED COMPETITION Article 1


      In accordance with the provisions of the Article 1 of the Act of 3 January 2001 referred to above, it may be carried out, under the conditions laid down in this Title, for a period of five years from 4 January 2001, to the organisation of competitions for access to the bodies mentioned on the attached list In this Decree, reserved for persons who fulfil the conditions laid down in Article 1 of the said Act.

      Article 2


      Candidates May present themselves to the competitions provided for in Article 1 only if they fall within the scope of their last contract, the Ministry of Employment and Solidarity or a public institution by reporting them. In addition, they may submit, in the same year, only one open competition for access to a body of each category organized pursuant to Article 1 of the aforementioned Law of 3 January 2001.

      Article 3


      For the application of 3 ° of Article 1 of the Act of 3 January 2001, candidates must be in possession of one of the prescribed diplomas or diplomas By the statutory provisions on recruitment in the host body considered by the external channel.
      Candidates for the reserved competitions for access to the body of the general education teachers of the national institutes of deaf youth Must be holders of the certificate of fitness provided for in Article 5 of Decree No. 93-293 of 8 March 1993 referred to above and the candidates for the reserved competitions for access to the body of technical teachers of the national institutes of deaf children and The National Institute for the Blind shall be in possession of one of the titles or diplomas provided for in Article 8 of Decree No. 93-294 of 8 March 1993 referred to above.

      Article 4

      Article 5


      The number of candidates nominated on the supplementary lists does not May exceed 100 % of the total number of jobs offered.

      Article 6


      The provisions applicable to the traineeship, sanction of the Traineeship, tenure and classification are those laid down by the status of the host body for non-incumbent agents.
      The winners of the reserved competitions for access to category C bodies are confirmed as soon as they are appointed and classified in the Reception body by application of the provisions of Article 6 of the Decree of 27 January 1970 mentioned above

    • TITLE II: PROVISIONS ON THE ORGANIZATION OF PROFESSIONAL REVIEWS Article 7


      In addition to the recruitments referred to in Article 1 of this Decree, candidates fulfilling the conditions laid down in Article 1 of the Act of 3 January 2001 may access, for a period of five years from 4 January 2001, after a selection by way of professional examination, to the category C body mentioned on the list annexed to this Decree.

      Article 8


      Candidates may submit to the professional examinations referred to in Article 7 only if they report, or fall within the expiry date of their Of the Ministry of Employment and Solidarity. In addition, they may submit to a single competition or professional examination for access to a category C body organised in accordance with Article 1 of the aforementioned Law of 3 January 2001.

      Article 9

      Article 10


      A joint order of the Minister responsible for the Public Service and the Minister responsible for Employment and Solidarity sets out the General rules for the organisation of professional examinations, the nature and programme of tests.
      The Minister responsible for employment and solidarity shall lay down the arrangements for the organisation of professional examinations and appoint the members of the jury.

      Article 11


      The selection board shall, in alphabetical order, determine the list of candidates admitted to the professional
      . Examination and listed alphabetically, are confirmed as soon as they are appointed. They are classified in the receiving body by application of the provisions of Article 6 of the aforementioned decree of 27 January 1970.

      Article 12


      Jobs not filled as a result of the professional examination provided for in Article 7 may be carried over to jobs which may be filled by competitions for access to Category C bodies provided for in Article 1 of the present Order.

      Article 13


      The Minister of Economy, Finance and Industry, the Minister for Employment and Solidarity, the Minister for Public Service and State Reform and the Secretary of State for the Budget shall each have responsibility for the implementation of this Decree, which shall be published in the Official Journal of the French Republic
