The Minister Delegate to Industry,
Given the Constitution, Convention and Radio Regulations of the International Telecommunication Union;
Given the Code of Posts and electronic communications, in particular Articles L. 41, L. 41-3, L. 43, L. 97-2, L. 97-3, L. 97-4 and R. 52-3-1 to R. 52-3-21;
In the light of the order of 11 August 2006 relating to charges relating to the processing costs of applications Frequency assignments reported to the International Telecommunication Union and applications for authorization pursuant to sections R. 52-3-1 and R. 52-3-4 of the Electronic Communications and Position Code;
Seen the Order of August 11 2006 relating to the content of the application for authorisation to operate frequency assignments to satellite systems and information relating to the satellite system;
In view of the investigation file transmitted by the National Agency of Frequency on February 2, 2007 to the Minister Delegate to the Industry;
In the opinion of the Electronic Communications and Postal Regulatory Authority of December 11, 2006;
In view of the opinion of the Conseil supérieur de l' Audiovisuel en date du 30 November 2006,

Item 1


France Telecom is authorized to exploit subpoenas Frequency reported by France to the International Telecommunication Union at the orbital position 3 ° East for the Rascom-QAF 1 satellite system under the conditions set out in the Annex to this Order.

Article 2


The authorization is issued for a period of twenty years from the date of publication of this Order, subject to the conditions of modification and caducity Pursuant to sections R. 52-3-13 to R. 52-3-15 of the Electronic Communications and Position Code. The conditions for the renewal of this authorization are set out in Section R. 52-3-12 of the Electronic Communications and Position Code.

CONDITIONS FOR AUTHORIZATION TO OPERATE FREQUENCY ASSIGNMENTS FOR THE SATELLITE SYSTEM RASCOM-QAF 1 TO THE ORBITAL POSITION 3 ° EST

Conditions


Pursuant to sections L. 97-2 and R. 52-3-1 to R. 52-3-21 of the Electronic Communications and Position Code, the authorization is issued under the following conditions:
a) Assignments of Concerned are limited to those, to the orbital position 3 ° East, which are included in the frequency bands 6 190-6 346 MHz, 6 181.5-6 182.5 MHz and 6 183-6 184 MHz, for the sense Earth to space, respectively in polarization Left, right and left circular, and 3 965-4 121 MHz, 3 955.7-3 956.7 MHz and 3 957.2-3 958.2 MHz, for the space direction to Terre in a right circular polarization, and which were declared by France in the requests for coordination List is specified below, which are or will be listed in the International Telecommunication Union (ITU) International Frequency Reference File.

Europe/Middle East:

c) exploited emissions do not radiate at any point in the space or surface of the globe. Greater than that produced by the emissions corresponding to the frequency assignments of which the characteristics are, or will be, recorded in the international frequency reference file of the ITU, and the receptions operated In no case ask for more protection than the frequency assignments of which the characteristics are, or will be, recorded in the same file.
d) Frequency assignments are operated in accordance with the Coordination with other ITU member states or with other operators of frequency assignments declared by France to the ITU, including those that would be after the date of issuance of this authorization. This exploitation shall be subject to the rights associated with the assignments previously communicated to the ITU for the duration of the operation of the ITU.
e) The operation of the frequency assignments concerned by the authorisation is Subject to compliance with the obligations laid down in Articles L. 97-2-II and R. 52-3-7 to R. 52-3-11 of the electronic communications and postal code.
(f) France Télécom is the sole holder of this authorisation and remains responsible for compliance with Obligations relating to the operation of these subpoenas, including when the associated radio stations are owned, installed or operated by third parties, or located outside France.
g) This authorization does not prejudge Authorisations which are required to operate the system in the territories concerned by the area of service.
h) The authorisation shall be issued for a period of 20 years from the date of publication of this Order, subject to the conditions of Amendment and caducity set out in sections R. 52-3-13 to R. 52-3-15 of the Electronic Communications and Position Code. The conditions for the renewal of this authority are set out in Section R. 52-3-12 of the Electronic Communications and Position
. -The GÉOSAT satellite network is based on an early publication (API) called FSAT 22.
