ACT No. 2004-228 of 15 March 2004 governing, in application of the principle of secularism, the wearing of signs or outfits showing religious affiliation in public schools, colleges and schools (1)

The National Assembly and the Senate have adopted,
The President of the Republic enacts the following:

Article 1


In the code of education, after Article L. 141-5, an article L. 141-5-1 reads as follows:
" Art. L. 141-5-1. -In schools, colleges and public schools, the wearing of signs or outfits by which pupils ostensibly manifest a religious affiliation is prohibited.
The rules of procedure refer to the implementation of a procedure Preceded by a dialogue with the student. "

I. -This Law shall apply:
1 ° In the Wallis and Futuna Islands;
2 ° In the departmental community of Mayotte;
3 ° In New Caledonia, in public educational establishments The second degree falling within the competence of the State under Article 21 of the Organic Law No. 99-209 of 19 March 1999 on
Caledonia. -The code of education is thus amended:
1 ° In the first paragraph of Article L. 161-1, the references: L. 141-4, 141-6 " Are replaced by references: " L. 141-4, 141-5-1, L. 141-6 " ;
2 ° A l' article L. 162-1, references: " L. 141-4 to L. 141-6 " Are replaced by references: " L. 141-4, 141-5, 141-5-1, L. 141-6 " ;
3 ° In Article L. 163-1, references: " L. 141-4 to L. 141-6 " Are replaced by references: " L. 141-4, 141-5, L. 141-6 " ;
4 ° Article L. 164-1 is amended as follows:
a) References: L. 141-4 to L. 141-6 " Are replaced by references: " L. 141-4, 141-5, L. 141-6 " ;
(b) It shall be supplemented by a paragraph so written:
" Article L. 141-5-1 is Applicable to public educational establishments of the second degree referred to in Article 21 of Article 21 of Organic Law No. 99-209 of 19 March 1999 on New Caledonia, which fall within the competence of the State. "
III. -In Article L. 451-1 of the Code, it shall be inserted after the reference: L. 132-1, ", reference: L. 141-5-1, ".

The provisions of this Law shall enter into force after the beginning of the school year following its publication.

Article 4


The provisions of this Law shall be evaluated one year after its entry into force.
This Law shall be enforced as the law of the State.
