Decision No. 2002-1088 of 28 November 2002 fixing the conditions of#039; the use of low-power and low-power radio installations in the band 2 400-2 483.5 MHz

Telecommunications Regulatory Authority,
In view of Directive 98 /34/EC of the European Parliament and of the Council of 22 June 1998 providing for an information procedure In the field of technical standards and regulations and rules relating to the services of the information society, and in particular notification n ° 2002/284 F;
Given decisions CEPT/ERC/DEC/( 01) 05 and CEPT/ERC/DEC/( 01) 08 of the Conference European postal and telecommunications authorities for the use of non-specific low-power and low-power equipment and for motion and alarm detection systems operating in the band 2 400-2 483.5 MHz;
In view of the recommendation T/R 70-03 of the European Conference of Postal and Telecommunications Administrations (CEPT) on the use of low-range devices;
Given the postal code and telecommunications, and in particular its Articles L. 33-3 (5 °), L. 36-6 (3 °) and L. 36-7 (6 °);
In view of Decision No. 2001-442 of the Telecommunications Regulatory Authority of 2 May 2001 laying down the conditions for the use of low-power radio installations and Low-range in the 2.4 GHz band;
In light of Decision No. 2002-1087 of the Telecommunications Regulatory Authority, dated 28 November 2002, allocating frequencies for low-power radio installations and Low range in band 2 400-2 483.5 MHz;
The Advisory Radio Advisory Board was consulted on June 13, 2002;
After deliberation on November 28, 2002,


On the legal framework:
In accordance with Article L. 33-3 (5 °) of the Postal Code and Telecommunications, the Radio installations that do not use frequencies specifically assigned to their users are freely established. Their conditions of use shall be defined by this Decision of the Authority and published in the Official Journal after approval by the Minister responsible for telecommunications.
This decision of the Authority fixing the requirements In order to ensure, in particular, the proper use of spectrum is taken pursuant to Article L. 36-6 (3) of the Postal Code and Telecommunications.
Low-power, low-power radio installations As defined in decisions CEPT/ERC/DEC/( 01) 05 and (01) 08 and in recommendation T/R 70-03 above, referring to EN 300 440-2 or EN 300 761 of ETSI or to any other recognized standard equivalent, fall within these provisions. They consist of equipment for transmitting broadband data, transceivers for remote control applications and telemetry, telemetry, alarms, voice and video transmission, designated as installations Non-specific low-power and low-range radio, motion and alarm detection systems, equipment for railway applications and radio frequency identification applications, Including badges readers, alarm systems, anti-theft labels, access control, wireless control systems and transfer of data on portable equipment.
In accordance with Directive 1999 /5/EC of the European Parliament and of the Council, and in particular Article 4.1, the Member States shall notify the Commission of the interfaces they have regulated.
On the frequencies:
The Authority has granted, by Decision No 2002-1087 above, frequencies for Low-power, low-range radio installations. The frequency band for these facilities is all or part of the band 2 400-2 483.5 MHz.
For low-power and low-power radio installations, the use of the entire band Is authorized with an equivalent effective isotropic radiated power (PIRE) of 10 mW inside buildings and 2.5 mW outside buildings.
For motion and alarm detection systems, use of tape 2 400-2 446.5 MHz is allowed with a maximum WIRE of 10 mW and that of the band 2 446.5-2 483.5 MHz with a maximum WIRE of 25 mW inside the buildings, the PIRE being limited to 2.5 mW outside the buildings.
In some Departments whose list is published and maintained by the Telecommunications Regulatory Authority, the use of the entire band 2 400-2 483.5 MHz is authorized for low-power and low-power radio installations Non-specific scope with a maximum WIRE of 10 mW, inside and outside buildings.
In this same list of departments, motion and alert detection systems are allowed with a maximum PIRE of 25 mW on All of the band within the buildings and on the only part 2 400-2 454 MHz outside the buildings, and a maximum WIRE of 10 mW on the band 2 454-2 483.5 MHz outside the buildings.
The Authority continues the negotiations with The Department of Defence for the opening of the entire band 2 400-2 483.5 MHz, inside and outside the buildings with a 10 mW PIRE for non-specific low-range radio installations and 25 mW for Motion and alert detection systems. This openness has already been achieved for some overseas departments and local authorities.

Article 1


Low-power, low-power radio installations operate on the frequencies allocated to this use. They are for use only for short-range transmission.

Item 2


Facilities Low-power and low-range radio systems operate on a non-interference basis and without a guarantee of protection. As a result, the user should not cause discomfort to other authorized users and is not guaranteed the availability of a frequency.

Item 3


Decision No. 2001-442 above is repealed as of the approval by the Minister responsible for telecommunications of this Decision and is replaced by this Decision Decision.

Article 4


The Director General of the Authority shall be responsible for the implementation of this Decision, which shall be published in the Official Journal of the French Republic, after its approval by the Minister responsible for telecommunications.
