Summary


This Order sets out the minimum conditions for the organization and operation of specialized drug addiction centres. It repeals Decree 92-590 of 29 June 1992 on specialised centres for the care of addicts (CSST). This change responds to a dual need. It creates a legal framework adapted to the new status and funding formula of the CSST. Indeed, art. 38 of the Social Security Financing Act for 2003 (2002-1487 of 20 December 2002), on the one hand, integrates these centres in the field of medico-social institutions by attaching them to the " establishments and services providing reception and Accompanying persons confronted with specific difficulties in order to promote the adjustment to working life and social and vocational integration or to ensure the provision of medical care and supervision " mentioned in the 9 ° of the I Of Art. L. 312-1 of the Social Action Code and, on the other hand, transfers their financing from the State to sickness insurance. This legislative inclusion requires a redefinition of the organisation and missions of the CSST because the 1992 decree, which is based on the principle of state funding and a contract by health insurance, is null and void. In addition, this Decree allows the missions of the CSST to be updated with a view to integrating developments in the field of reception, care of addicts and also the products consumed. As such, it extends the missions of the CSST to the identification of harmful uses, to the reduction of the risks associated with the consumption of psychoactive substances, and to the prescription and monitoring of alternative treatments. In order to take account of the increase in consumption associated with taking drugs, it extends the remit of the CSST to associated addictions. In addition, this Decree defines the modalities for the operation and organisation of CSST in particular, the possibility for a centre to develop specific forms of care. It provides for the role of the Director, the status of the centres and the minimum composition of his staff and his qualifications will be defined by decree. It is specified that, pending the decree on the budgetary and accounting management of medical and social institutions under s. L. 312-1 of the Code of Social Action and Families, the provisions of Decree 88-279 of 24 March 1988 relating to budgetary and accounting management and to the financing arrangements for certain social and medico-social institutions at the expense of Of the state or health insurance applies to CSST. The latter is currently under review to allow for the pricing and funding of centres as early as January 2003.

The conditions for the organisation and operation of the sections of therapeutic apartments and networks of foster families are defined by joint order of the Ministers responsible for Social Affairs, Health and Social security.

The center is responsible for the services of a multidisciplinary medico-social team.
