Texts implementing Act No. 2002-1487 of December 20, 2002, from financing social security for 2003 (1) summary this Decree lays down the minimum conditions organization and operation centres specialized care for drug addicts. Repeals Decree 92-590 June 29, 1992 on specialized care for drug addicts (CSST) centres. This change responds to a double necessity. It creates a legal framework adapted to the new status and mode of financing of the CSST. In fact, art. 38 of the Act of financing of social security for 2003 (December 20, 2002 2002-1487) on the one hand, integrates these centres in the field of medico-social establishments when interfaced to the "institutions and services providing the home and l support to persons facing specific difficulties to promote adaptation to working life and the social and professional integration assistance or to ensure care and medical follow-up benefit" mentioned at 9 ° of the I of art. L. 312-1 of the code of social action and, on the other hand, transfers their funding from the State to health insurance. This legislative registration implies to redefine the Organization and tasks of the CSST because the Decree of 1992 supra, based on the principle of funding by the State and an agreement by the insurance is no longer valid. In addition, this Decree will update the CSST missions to integrate developments in the field of hospitality, support drug addicts and also of the products consumed. Accordingly, it extends the missions of the CSST tracking of harmful uses, to reduce risks associated with the consumption of substances psychoatives, and prescription and monitoring of alternative treatments. In order to take account of the increase in consumption associated with drug taking, it extends the scope of jurisdiction of the CSST to the associated addictions. Moreover, this Decree defines the terms of operation and organization of the CSST including, the possibility for a centre to develop specific support modes. It provides the role of the Director, the status of the centres and the minimum composition of its personnel and its qualifications will be set by Decree. It is stated that, pending Decree on budgetary and accounting of medico-social establishments covered art management. L. 312-1 of the code of social action and families, the provisions of Decree 88-279 of March 24, 1988, as amended, concerning budgetary and accounting management and the arrangements for financing of certain social and medico - social dependents of the State or insurance shall apply to the CSST. This last Decree is currently the subject of a review to allow pricing and funding for the centres from January 2003 onwards.

Centres specialized care for drug addicts in the categories of establishment referred to in 9 ° of article L. 312 I - 1 of the code of social action and families provide prevention missions, reception and support of persons with a consumer at risk or harmful use of substances or plants classified as narcotics or with associated addictions.

Specialized drug addicts care centres provide: 1 ° the reception, information and orientation of the person as well as the accompaniment of his entourage;

3 ° diagnosis and care, through medical and psychological support services. The Center provides the withdrawal as well as its accompaniment when it is performed in a hospital;
4 ° the prescription and monitoring of alternative treatments;
5 ° the social and educational support which includes access to social rights and aid to the insertion or reinsertion.

Can be attached to the centre one or more sections, which correspond to specific forms of support including: 1 ° of the permanences home and guidance outside the centres;
2 ° the therapeutic apartments;
3 ° of networks of host families;
4 ° the accommodation structures, individual or collective, transitional or emergency;
5 ° of insertion workshops.
The conditions of organization and functioning of therapeutic apartments and host families networks sections are defined by joint order of the Ministers responsible for Social Affairs, health and social security.

The centre retains the services of a multi-disciplinary medical team.
The minimum composition and qualifications of the personnel that make up the centre's medical team are determined by Decree of the Ministers responsible for Social Affairs and health.

The Director or the person responsible for centre ensures itself or, where appropriate, by delegation, in respect for the skills and the ethical rules of the different professionals, the consistency of all the activity of the personnel as well as coordination with external stakeholders. It has overall responsibility for the operation of the centre.
The responsibility of medical activities is ensured by a doctor.

The Center can participate in actions of prevention, care, training and research on drug abuse organized by legal persons under public law or private subject these people to remunerate the intervention of the centre.
Participation in actions of care and their funding conditions give rise to the signing of an agreement between the centre and the structure which organizes the action, of which a copy is sent to the prefect of Department for information.
