The Prime Minister,
On the report of the Minister of Health and Solidarity, the Minister of Economy, Finance and Industry and the Minister
the light of the amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, the amended Act No. 86-33 of 9 January 1986 amending the statutory provisions relating to the civil service Hospital;
In light of Order No. 89-241 of April 18, 1989, as amended to provide for the special status of health care aides and qualified hospital officials of the hospital public service;
Given Order in Council No. 90-839 of September 21, 1990 Amending the specific statutes of the administrative staff of the hospital public service;
Having regard to the amended Decree No. 91-45 of 14 January 1991 on the special status of workers, drivers of motor vehicles, Ambulance drivers and maintenance and safety personnel of the hospital public service;
In light of the amended Order No. 91-868 of September 5, 1991, amending the specific statutes of the technical staff of the Public Service Hospital;
Having regard to Decree No. 93-658 of 26 March 1993 on the special status of workshop monitors of the hospital public service;
Having regard to Decree No. 2006-227 of 24 February 2006 concerning the organisation of careers in the Category C hospital employees;
Given the opinion of the Hospital Public Service Board of Governors as of November 16, 2005;
The Conseil d' Etat (social section) heard,
Describes:

Item 1
The decree of 18 April 1989 is thus amended:
I.-Article 1 is replaced by the following provisions:
" The provisions of this Decree shall apply to the body of the caregivers and to the The bodies of the staff of the hospital services referred to in Article 2 of the aforementioned Act of 9 January 1986. "
II. -In Article 2, the words: In Article 2 of Decree No 93-345 of 15 March 1993 on professional acts and the practice of the profession of nurses' Are replaced by the words: " In Article R. 4311-4 of the Public Health Code ".
III. -Article 4, the word ' 6th " Is replaced by the word " 5th " And after the word: " Compensation " Are inserted the words: " With at least two years of seniority in this step ".
IV. -Article 4-1, the word ' 8th " Is replaced by the word " 7th ".
V.-In Article 5, 3 °, the words:" Aged forty-five years or more " Are deleted; at 4 ° of the same article, the words: " At least forty-five years of age as at 1 January Year of the competition and " Are deleted.
VI. Article 6 is thus amended:
-at 1 °, the words: " Age forty-five not more than 1 January of the current year " Are deleted;
-in the last paragraph of the same article, the words: " 2nd category " Are deleted. The words: " Specialized maintenance agent " Are replaced by the words: " Qualified maintenance agent ".
VII. -The last paragraph of Article 12 shall be replaced by the following:
" This body includes a single rank: a qualified hospital services officer on a pay scale. "
VIII. -In the first paragraph of Article 13, the words: 2nd category " And the words: " Candidates must not be more than fifty-five years old on 1 January of the year of recruitment, without prejudice to the legal provisions relating to the decline Age limits for access to public employment " Are deleted.
IX. Article 15 is deleted.
X. -Article 16 is thus amended:
-in the first paragraph, the words: At grade and index equivalents " Are replaced by the words: " At the level with an index " ;
-in the second paragraph, the words: " Of Grade and " Are deleted;
-in the third paragraph, the words: " In grades and levels attained " Are replaced by the words: " At the level reached ".
XI. Article 25 is deleted.

The decree of 21 September 1990 is thus amended:
I.-The first paragraph of I of Article 13 is replaced by the following:
" Can be appointed to the rank of first class, in Under the conditions laid down in Article 69 of the Act of 9 January 1986, the Administrative Assistants of 2nd Class with six years of effective service in the body. "
II. -Article 13 reads as follows:
" The Hospital Administrative Assistants may be appointed to the rank of Principal Hospital Administrative Assistant under the conditions laid down in Article 69 of the aforementioned Act of 9 January 1986. 1st class with at least two years' seniority in the 8th step of their grade. "
" Officers promoted to the rank of Senior Hospital Administrative Assistant are reclassified to this rank in accordance with the following table:

III. Article 15 shall be replaced by the following:
" The corps of administrative officers is a single grade body classified in scale 3 of remuneration provided for in Decree No. 2006-227 of 24 February 2006 concerning the organisation of the Careers of category C. hospital officials "
IV. -The third sentence of the first paragraph of Article 16 is deleted.
V. Article 17 is deleted.
VI. -Article 26 is replaced by the following provisions:
" May be appointed to the rank of auxiliary permanent medical regulatory authority, under the conditions laid down in Article 69 of the aforementioned Act of 9 January 1986, Auxiliary medical regulatory offices with at least four years of effective service in the body. "
VII. -Article 26 is replaced by the following provisions:
" Under the conditions laid down in Article 69 of the Act of 9 January 1986 referred to above, he may be appointed to the rank of auxiliary permanent medical regulatory authority under the conditions laid down in Article 69 Auxiliary permanent medical regulatory assistants with at least two years' seniority in the 8th step of their grade.
" The officers promoted to the rank of auxiliary medical regulatory authority are reclassified in that rank, In accordance with the following table:

VIII. Article 28 shall be replaced by the following:
" The Body of Standardists comprises three grades: Standardist, Head of Telephone Standard, respectively classified in scales 3 and 5 of Remuneration provided for in Decree No. 2006-227 of 24 February 2006 concerning the organization of careers of category C hospital officials and head of the main telephone standard consisting of three levels. "
IX. -The third sentence of the first paragraph of Article 29 shall be
. -Article 30 is deleted.
XI. Article 31 shall be replaced by the following:
" May be appointed to the rank of head of the telephone standard, under the conditions laid down in the 2 ° of Article 69 of the aforementioned Law of 9 January 1986, the switchboard with at least Eight years of effective service in the body. "
XII. -The first two paragraphs of Article 31-I and the reclassification table are replaced by the following provisions:

XIII. -The first two paragraphs of Article 34 are

" As regards the category C bodies referred to in Article 1 above, the agents are classified according to the provisions laid down in Decree No. 2006-227 of 24 February 2006 relating to the organisation of careers of category C. hospital officials "
XV. -The second and third sentences of Article 50 are replaced by the following:
" They are on a pay scale. They shall be reclassified on this scale in accordance with the provisions laid down in Article 8 of Decree No. 2006-227 of 24 February 2006 on the organisation of careers of category C hospital officials'

The aforementioned decree of 14 January 1991 is thus amended:
I.-In Articles 9, 14, 20, 23 and 45, the words: Having reached the 5th step " And the words: " Having reached at least the fifth step " Are replaced With the words: " At least two years of seniority in the 4th step ".
II. -In Article 9, the words: " Eight years of effective service in this capacity " Are deleted.
III. -In Article 14, 2, the words: " Public services " Are replaced by the words: " Effective services ".
IV. -In Article 15, the first and second subparagraphs and the reclassification table shall be replaced by the following:
" Art. 15. - Master workers with at least two years' seniority in the 8th echelon of their grade may be promoted to the rank of Principal Labour Master under the conditions laid down in Article 69 of the aforementioned Law of 9

V.-In Article 24, the first and second subparagraphs and the reclassification table are replaced by the following:
" Art. 24. - Garage chefs with at least two years' seniority in the 8th grade of their grade may be promoted to the rank of chief garage chief under the conditions laid down in Article 69 of the aforementioned Law of 9 January

VI. -Article 27 is replaced by the following:
" Art. 27. - The motor vehicle driver's body shall comprise the grade of motor driver of the first category and the grade of motor driver out of category classified respectively in scales 3 and 4 of remuneration provided for in Decree No 2006-227 Of 24 February 2006 concerning the organization of careers of category C. hospital officials "
VII. -In Article 28, the words: 2nd category " Are replaced by the words: " 1st category ".
VIII. -Article 29 is deleted.
IX. -The first paragraph of Article 30, which becomes Article 29, is replaced by the following provisions:
" Can be promoted from motor vehicles out of category, after entry in the table of promotion under the conditions laid down in 1 ° of Article 69 of the aforesaid law of 9 January, drivers of motor vehicles with two years' seniority in the 6th echelon and having satisfied the medical examinations provided for in Article 30. "
X. -Sections 31, 32, 33 and 34 respectively become sections 30, 31, 32 and 33.
XI. -Article 35, which becomes Article 34, is thus amended:
In the first paragraph, the words: Having reached at least the fifth step " Are replaced by the words: " Having at least two years of effective service in the 4th line ".
The second and third subparagraphs and the reclassification table shall be replaced by the following:
" First class ambulance drivers with at least two years' seniority in the 8th grade of their grade can be promoted To the rank of non-category ambulance driver under the conditions laid down in Article 69 of the abovementioned Act of 9
. First class ambulance drivers promoted to the rank of non-category ambulance driver are Reclassified in this rank according to the following table:

XII. -In Article 36, which becomes Article 35, the words: Article 34 above " Are replaced by the words: " Section 33 ".
XIII. -Sections 37 to 48 become sections 36 to 47.
XIV. -In the third paragraph of Article 38, the words: Article 50 " Are replaced by the words: " Section 45 ".
XV. -In Article 39, the first and second subparagraphs and the reclassification table shall be replaced by the following provisions:
" Maintenance technical officers with at least two years' seniority in the 8th grade of their grade May be promoted to the grade of Principal Maintenance Technical Officer under the conditions laid down in Article 69 of the aforementioned Law of 9 January
. Technical maintenance officers promoted to Senior Maintenance Technical Officer Are reclassified in this rank according to the following table:

XVI. -In Article 43, the words " As well as specialized maintenance officers with at least three years of effective service in the body " Are deleted.
XVII. -In section 3 and in the first paragraph of Article 45, the word " Qualified " Is added after the words: " Maintenance agents ".
XVIII. -Article 46 is replaced by the following:
" Art. 46. - The corps of maintenance officers shall comprise the grade of qualified maintenance officer in scale 3 of remuneration provided for in Decree No. 2006-227 of 24 February 2006 concerning the organisation of the careers of hospital officials of Category C. "
XIX. -Article 47 is thus amended:
In the first paragraph, the third sentence shall be deleted and the word: Specialized " Is replaced by the word: " Qualified " ;

-in the last paragraph, the words: " Articles 52 and 53 " Are replaced by the Words: " Article 49 and Article 50 ".
XX. -Sections 49 and 50 are deleted.
XXI. -Sections 51 to 60 become sections 48 to 57.
XXII. -Articles 61, 62 and 63, which become Articles 58, 59 and 60 respectively, the words: Scale 2 " Are replaced by the words: " Scale 3 " And in Article 60 the words: As from 1 August 1993 " Are deleted.
XXIII. -Articles 64, 65, 65-1, 66 and 67 become Articles 61, 62, 63, 64 and 65.

The decree of 5 September 1991 is thus amended:
I.-Article 18 is thus amended:
The first and second subparagraphs and the reclassification table provided for in the I of Article 18 are Replaced by the following:
" I.-Draftsmen of groups with at least two years' seniority in the 8th grade of their grade may be promoted to the rank of principal designer under the conditions laid down in 1 ° of Section 69 of the aforementioned Law of January 9, 1986.
Designers of group leaders promoted to the rank of principal designer are reclassified in this rank according to the following table:

In II of article 18, the words: " Having reached the 6th level " Are replaced by the words: " Two years of seniority in the 5th step ".
II. -The provisions of Article 19 are deleted. V, VI and VII of Article 19 become IV, V and VI of the same Article.

The aforementioned Decree of 26 March 1993 is hereby amended:
I.-Article 1 shall be supplemented by the following words: And by the general provisions applicable to category C officials of the function Hospital public provided for in Decree No. 2006-227 of 24 February 2006 concerning the organisation of the careers of category C hospital officials, subject to the provisions of this Decree
. -Articles 6, 7 and 8 are
. -The second and third paragraphs of Article 9, which becomes Article 6, are deleted.
IV. Article 10, which becomes Article 7, reads as follows:
" The index scale applicable to workshop monitors is determined by joint decision of the Ministers responsible for budget, health and the public service. "
V. Articles 11, 12, 13, 14, 15 and 16 respectively become Articles 8, 9, 10, 11, 12 and 13.

The Minister of Economy, Finance and Industry, the Minister of Health and Solidarity, the Minister of the Public Service and the Minister Delegate to the Budget and Reform of the State, Spokesperson for the Government, shall each have responsibility for the execution of this Decree, which shall be published in the Official Gazette of the French Republic.
