In accordance with the decision of the Parliament:

General provisions
ARTICLE 1
Purpose of the law

The purpose of this law is to promote the right to good social care and good treatment of the customer, by requiring the necessary training and familiarity with the professional staff of the social services.

ARTICLE 2 (30/04/2013)
Scope of law

This law shall apply to the eligibility of the professional staff of the social services, except where otherwise provided for in the law.

Social services are defined in this law:

1) Social Security Act (1301/2014) in Article 14 Those tasks, the organisation of which is to be organised by a municipal institution or State;

2) tasks falling under the Law on Private Social Services (2011) For social services.

This law shall not apply to the qualifications required by the home-service support services referred to in Article 19 of the Social Welfare Act.

Qualification requirements
ARTICLE 3
Social worker

The qualification of a social worker is a higher education qualification, which includes or has undergone major studies or university studies in the field of social work.

§ 4
Social Ombudsman

Eligibility of the law on the status and rights of the customer (812/2000) Article 24 Shall be carried out in accordance with the provisions of Article 3 of this Act, or a higher education qualification and knowledge of the field.

§ 5
Children's supervisor

Qualification requirement in paternity law (700/1975) Shall be eligible for the tasks of the child supervisor in accordance with Article 3 of this Law or a higher education qualification.

ARTICLE 6
Social protection and

As a qualification requirement for the role of the social director, a qualification for social and health education in the social field is appropriate.

§ 7
Kindergarten teacher

Qualification as a qualification requirement for the kindergarten teacher is at least a bachelor's degree in education, including the education of a kindergarten teacher, or a university degree in social and health care, including early childhood education and training, and Studied social education in the form of a more detailed regulation of the State Council Regulation.

§ 8
Related nurse

Qualification as a qualification for a caregiver is a primary or equivalent qualification in the field of social and health care.

§ 9
Special employee of social care

Qualification as a qualification for the tasks of a specific social worker shall be the basic training required for the task and, in addition, appropriate specialised training or a postgraduate degree.

More detailed provisions on the training or further examination required for the task of a special worker may be laid down by a Council regulation.

ARTICLE 10
The management of social services

Eligibility for the management of the social or social services of a municipality or of a group of municipalities, in the form of a qualification or a higher education qualification and a knowledge of the field, as well as knowledge of the field, in addition to those in accordance with Article 3, Adequate management skills.

Eligibility for the professional management tasks of the social work organisation is in accordance with Article 3 and sufficient managerial skills.

ARTICLE 11
Other professional tasks of social welfare

Qualification as a qualification for other professional tasks of social services is an appropriate professional qualification or other appropriate training.

Specific provisions
ARTICLE 12
Temporary derogation from eligibility criteria

If a person who is eligible for a job in the social welfare service is not eligible for a job, a person who, on the basis of the studies carried out, has sufficient conditions to perform the task may be taken for a maximum period of one year.

Entry and transitional provisions
ARTICLE 13
Entry into force

This Act shall enter into force on 1 August 2005.

Where other legislation makes reference to the regulation in force at the time of entry into force of this Act, the conditions for the qualification of professional staff (18/04/1992) , must instead apply this law.

ARTICLE 14
Social worker

Tasks to which this law requires the qualification of a social worker may also be carried out by a person who, at the time of entry into force of this Act, was eligible for a similar function under Article 2 (1) of the Regulation on the conditions of eligibility of the professional staff. Or the transitional provisions of that Regulation.

Students who, at the time of entry into force of this Act, have been admitted to the university to study in accordance with Article 2 (1) of the Regulation on the conditions for the qualification of social services, are eligible under this law. Provided that the studies are completed by 31 July 2008 at the latest.

More detailed provisions on the application of paragraph 1 shall be adopted by a Council Regulation.

§ 15
Kindergarten teacher and social director

The duties to which this law requires the qualification of a bachelor's degree in education may also be carried out by a person who has completed a bachelor's degree in childhood education or a master's degree or a kindergarten teacher Examination.

The tasks referred to in paragraph 1 and other tasks to which this law requires a university degree may also be carried out by a person who, before the entry into force of this law, has carried out an appropriate social and health service. ARTICLE 16
Related nurse

§ 17
Other transitional provisions

Notwithstanding the provisions of this Act, a person who carries out or has carried out the duties referred to in Articles 3 to 11 of this Act before the entry into force of this Act in the service or employment relationship resulting from the entry into force of this Act, The eligibility criteria for staff, may continue to perform the task or carry out other similar tasks according to the conditions laid down in the decision granting the exemption.

Persons other than those referred to in paragraph 1, who shall perform the duties referred to in Articles 3 to 11 of this Act before the entry into force of this Act and which cannot be deemed to satisfy the eligibility criteria laid down in this Act, Continue to perform the tasks without prejudice to the provisions of this Act. Where a person has been admitted under Article 7 of the Regulation on the conditions of eligibility of the professional staff of the social services, he may continue to carry out the task up to the end of the period referred to in that provision.

Paragraph 2 shall also apply to a person who carries out the functions referred to in Articles 3 to 11 of this Act in the service of a self-employed person or a community providing social services in the context of a law on the supervision of private social services , obtained before the entry into force of this Act, or on the basis of a declaration made before the entry into force of this Act.

ARTICLE 18
More detailed provisions

More detailed provisions on the implementation of this law may be adopted by a Council regulation.
