Regulation on the redemption of real estate for sale to the State

The presentation of the Minister for Agriculture and Forestry is governed by the provisions of the Law of 14 January 1938 on the redemption of the real estate sale to the State (23/38) And Article 11 (1):

ARTICLE 1

The property of the property referred to in Article 1 of the Act on the redemption of the real estate sold by the State, as well as the foreclosure of the property and the foreclosure of the holding, must be notified immediately to the rural district where: In the area the property is located.

ARTICLE 2

Upon receipt of the notification, the relevant rural district shall, where appropriate, assess the assets. The rural district may be assisted by the rural authorities of the municipality. After assessing the rural district of the property, when the right to redemption under paragraph 2 is covered by the farm government and the rural district, it considers the property to be suitable for use in the rural economy (1295/90) Or otherwise for the purposes of the State, send to the farm administration the instruments of assessment and presentation of the property to the State.

The right of redemption belongs to the farm government when the auction price exceeds 1 000 000 marks.

The rural economy 1295/1990 Has been repealed by the EAFRD: 329/1999 .

ARTICLE 3

In the event of a sale, in the event of a sale, of a dwelling holding or a plot forming part of the law referred to in Article 1 (2) of the Law referred to in Article 7 (2) of the Law referred to in Article 1, the sale price shall be determined, taking into account: The rural economy (248/91) The criteria set out in paragraph 5, up to 15 years. The part of the selling price, which has not been given in terms of payment terms, shall be paid by the trade book at the time of signature or by an annual interest rate of 12 % within a time limit which shall not exceed one year from the trade date. In addition, the provisions of Articles 49-51, 58, 59 and 63 of the Rural Development Regulation shall apply mutatis mutandis.

§ 4

Where appropriate, the farm government shall adopt more detailed provisions on the application of this Regulation.

§ 5

This Regulation shall enter into force on 18 March 1991.

This Regulation repeals the Regulation of 13 May 1977 on the redemption of real estate sold to the State (186/77) With its subsequent modifications.
