DECREE NÚLNÍNO 546
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
WHEREAS:
I.-By Legislative Decree N29,902, dated November 28, 1996,
published in the Journal Officer No. 241, Volume No. 333 of 20 December 1996, the Law against the Intra-Family Violence @.
II.-That in the aspiration to guarantee a life free of violence and discrimination
for women by Legislative Decree No. 520, dated November 25, 2010, published in the Official Journal N ° 2, Volume N ° 390, of January 4, 2011,
is issued the Comprehensive Special Law for a Free Life of Violence Against Women @.
III.-That in order to make the next implementation of the Specialized Courts for a Free Life of Violence for Women @, it is essential to reform some articles of the Law Against the Violence Intrafamily @, approved by Legislative Decree No. 902 dated November 28
, published in Official Journal No. 241, Volume No. 333 of December 20
1996,harmonize, systematize the regulations for the entry into force of the specialized jurisdiction for women victims of violence for reason
of the gender.
FOR TANTO,
in use of its Constitutional powers and at the initiative of the Deputies and Deputy Ana Marina
Alvarenga Barahona, María Elizabeth Gómez Perla, Karla Elena Hernández Molina, Silvia Estela Ostorga de Escobar and Numan Pompilio Salgado García.
DECRETA the following:
REFORMS TO THE LAW AGAINST INTRA-FAMILY VIOLENCE
Art. 1.-Reform Article 9 in its first indent, as follows:
ADuration of Measures
Art. 9.-The duration of the preventive, protective or protective measures imposed on the aggressor, shall be established by the Judge or Judge according to the circumstances, reincidences and
according to the regulations of the Law of the Family and the Comprehensive Special Law for a Free Life
of Violence for Women. "
Art. 2.-Reform Article 23 as follows:

Art. 23.-Received the proceedings from the Attorney General's Office, or
direct request of the victims, the Judge or Judge must immediately decree if the case so requires, the
precautionary, preventive or protection measures.
Protection measures shall be maintained in force; however, criminal proceedings shall be initiated in the event of a crime and the Courts of Peace, Family or the Courts Specialised for a Free Life of
Violence and Discrimination for Women must be followed up. @
Art. 3.-Reform Article 42 as follows:
Criminal Matters
Art. 42.-In the case of acts of intra-family violence under criminal jurisdiction and persons subject to this Law, the Judge or Judge during the processing of the proceedings, must apply
preventive, precautionary and relevant protection regulated in this regulation.
The same may be maintained or decreed in the relevant judgment and to ensure
its effective compliance, the Courts of both jurisdictions, which have intervened in these cases, they must exchange direct information on the state of the process to be In his

This resolution may be followed up with the support of the Center for Psychosocial Care
of the Judicial Branch, the Multidisciplinary Teams attached to the Family Courts. and to the Specialized Courts for a Free Life of Violence for Women in the cases in which it is dealt with
crimes of gender-based violence against women, and of those public and private institutions; as well as of organizations Non-governmental organizations that provide care to people in violence
within the family. "
Art. 4.-This Decree shall enter into force eight days after its publication in the Official Journal
