DECREE Nº 448.-

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

WHEREAS:

I.-That the Salt Yodation Law was issued by Legislative Decree No. 45, on the twenty-third of February from one thousand nine hundred and sixty-one, published in the Official Journal No. 40, Tomo 190 dated twenty-seven of the same month and year cited;

II.-That the aforementioned Law does not harmonize with the Constitution, nor with the secondary laws in force, so it is imperative to repeal it and to issue a new Law;

III. Another part of the lack of iodine in the diet of the Salvadorans has given rise to the presence of goiter, constituting an endemic disease that affects the health of large sectors of the population.

BY TANTO:

in use of its faculties constitutional and at the initiative of the President of the Republic through the Minister of Public Health and Social Assistance.

DECRETA the following:

SAL YODATION ACT

Art. 1. Any natural or legal person engaged in the production of salt in the territory of the Republic shall have the authorization of the Ministry of Agriculture and Livestock and the health license issued by the Directorate General of Health. The Ministry of Public Health through the Directorate General of Health, will send to the Ministry of Economy for the corresponding registration, certification of the license granted to the person interested in the production of salt.

This certification must be sent to the Ministry of Economy within the first fifteen days of the month of January each year.

Art. 2.-All salt for human and animal consumption occurring in the places of exploitation in the territory of the Republic shall be iodine in proportion and in accordance with the procedures and requirements approved by the Directorate General of Health in compliance with this law, its Regulations and the respective Technical Standard.

For this purpose, the iodination may be carried out in any of these places: production plants, packing plants, storage or distribution.

Art. 3.-The importation of salt without iodine or that does not comply with the requirements established by this Law, its Regulation and the respective Technical Standard is prohibited. But when circumstances

will be required to be subject to the provisions of Article 5 literal (c) of the Consumer Protection Act.

Salt may be expended without iodine, exclusively for industrial non-food purposes or for consumption human prescription; in both cases their use or consumption should be checked.

Art. 4.-Facultate to the Executive Body in the Ramo de Salud Pública y Asistencia Social, to create by Executive Decree, a National Commission for the Yodation of Salt, in order to monitor compliance with the provisions of this Law, its Regulation and Technical Standard A representative of the National Salineros Association of El Salvador must be part of the commission.

Art. 5.-The Ministry of Public Health and Social Care will manage agreements with international organizations to obtain technical and economic assistance in order to achieve the operation of the salt and control of the endemic goiter in El Salvador.

Art. 6. Any natural or legal person engaged in the placing on the market of poorly iodinated or iodine-free salt, intended for human or animal use or consumption, shall be gradually sanctioned in accordance with Art. 7 of this Law.

Art. 7.-Any infringement of the provisions of this Law, its Rules of Procedure and the Technical Standard, shall be sanctioned as follows:

a) Multa which shall graduate from one thousand to twenty-five thousand colones, for each infringement committed;

b) recidivism, in addition to the fine to the offender will be punished with the suspension of the business or business, for a period of not less than one month and not more than six months; and

c) In case of reoffending again, will be sanctioned with the closure of the business or company.

The penalties provided for in this Article shall apply after hearing of the alleged offender, using the procedure set out in the respective regulation.

Art. 8. The cases not provided for in this Law shall be resolved at the discretion of the Directorate General of Health, based on good sense reasons, and the rules of interpretation of the Law.

Art. 9. The President of the Republic shall issue the Regulation to facilitate and ensure the application of this Law, within a period of not more than ninety days.

Art. 10.-Derogase Legislative Decree No. 45, which contains the Law of the Yodation of Salt, issued by the Military Civic Directory of El Salvador, on February 23, 1961, published in the Official Journal No. 40, Volume No. 190, of the 27th of the same month and year.

TRANSIENT

Art. 11. Any natural or legal person who produces, stores or distributes salt shall have a period of sixty days from the date of this law, so that he may perform the adequacy of his plants in order to comply with the provisions of the same.

Art. 12.-This decree will enter into force eight days after its publication in the Official Journal.
