II. that by Legislative Decree No. 756 of date July 28, 2005, published in the Official Journal No. 198, volume no. 369, 25 October 2005, issued regulations within this Legislative Assembly, which develops with regard to antejuicios, in its chapter XV, understood article 118 to 142, establishing that you to initiate such a procedure It will be by complaint to the Assembly, before the Office of the Attorney-General or the competent court; and that takes place when the Legislative Assembly, it must refer it to the concerned public prosecutor, to intervene;
III.-that the intervention of the Fiscal General in the submission, bicker with what sets it Constitution, since this determines that in this process which must intervene is a fiscal of the "breast of the Assembly", by what it willing, currently, in the regulation inside of it Assembly, can constitute an obstacle, since the submission not is part of a procedure criminal , but this is will take to out before the court competent, after it Assembly has declared that there is place to training of cause for the official denounced, and is, in this procedure criminal, in which itself should intervene the Fiscal General of the Republic, for promote the action criminal, to is refers the ordinal 4 ° of the Art. 193 of the Constitution;
IV.-that is also necessary to determine the reasonable period of time so that the Attorney General referred to this House allegations that stand in this institution, against the officials referred to in article 236, of the Constitution.
