INDEX LEGISLATIVE DECREE No. 62

THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 208, dated November 30, 2000, published in the Official Journal No. 237, Volume No. 349, December 18 the same year, the Law on Road Maintenance Fund, having been created in Art. 4 the Road Maintenance Fund (FOVIAL), which has the responsibility to manage efficiently issued the financial resources that correspond to conserve all paved roads and unpaved roads in good and fair condition, same as reported to the country's municipalities and him with the other countries of Central America, whose jurisdiction is the Central Government - Maintainable Priority National Road network; and also conserve all paved roads of the urban road network in good and fair condition municipalities fail to cover -Red Maintainable Urban Road.
II.- several years, the resources allocated to the Road Maintenance Fund are insufficient to cover maintenance needs require roads, a situation that favors the deterioration of the same and far from it, it has been widening annually maintenance gap, which negatively impacts both users and in the productive sectors and the development of the country.
III.- by Legislative Decree No. 504, dated April 16, 1993, published in the Official Journal No. 73, Volume No. 319 of 22 of the same year, the Law of Fiscal Rights issued by the Circulation vehicles, which aims to regulate the establishment and enforcement of property rights, transfer, and changing driving characteristics of vehicles are authorized to circulate within the country.
IV.- That to strengthen FOVIAL and being financially to the use of vehicles whose circulation is authorized is linked to the national road infrastructure, it is essential to reform the Law related in the previous paragraph, in order that the income they perceive in royalties and penalties established by that law and entering the state General Fund to be fully transferred to the budget of the Road Maintenance Fund.
THEREFORE,
in exercise of its constitutional powers and initiative of the President of the Republic, through the Minister of Public Works Public Works, Transportation and Housing and Urban Development.
DECREES the following:

RIGHTS LAW BY PROSECUTORS OF VEHICLES
Art. Article 35 1. hereby replaced by the following:.
"Art. 35. Payments for fees and fines established by this Act entering the state General Fund should be transferred entirely to the Road Maintenance Fund (FOVIAL) to be used in the maintenance and conservation of Maintainable Priority National Road Network. "
Art. 2. This Decree shall enter into force eight days after its publication in the Official Journal.
