1 Decree N ° 344 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that on January 31, this year, this House was notified of the sentence of the Constitutional Division of the Supreme Court of Justice, declaring unconstitutional the Decree legislative No. 762 on June 16, the year 2011, which includes the election of the President First and second magistrate of the Court of accounts of the Republic, considering the room that the election procedure does not satisfy the requirements laid down in article 198 of the Constitution, not to justify or substantiate their decision; and therefore is made a new election, so that they complete the period for which it had been elected.
II.-that the Constitution in its article 198 establishes as requirements, that the President and the judges of the Court of Auditors shall be Salvadorans by birth, over thirty years of honesty and noticeable competition; be in the exercise of the rights of citizens and have been in the three years prior to their election.
III.-that this organ of the State proved convincingly that the candidates lawyers Marcos Gregorio Sánchez Trejo, Javier Tránsito Bernal Granados and the lawyer Silvia Aguilar Zepeda, comply with the constitutional requirements for election in accordance with article 198 making reference previous recital, which is based on the resumes submitted by each one of them the corresponding certificates accompanying, interviews and documentation of the entities to which requested report; which is justified and based that such candidates are suitable for the post.
DECREES: Article only.-Eligense in the positions: President of the Court of accounts of the Republic, to the lawyer Marcos Gregorio Sánchez Trejo; First judge of the Court of accounts of the Republic, to the lawyer Javier transit Bernal Granados; and second judge of the Court of accounts of the Republic, to the lawyer Silvia Inmaculada Aguilar Zepeda.
The President and first magistrate have been elected to finish the period which expires on 28 June 2014; and the second judge has been elected for the period that begins on 21 March 2013 and ends July 8, 2014.
Elected officials yielded to this Assembly the protest referred to in Article 235 of the Constitution, before taking possession of their posts.
