DECREE No. 372 THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 725 dated September 30, 1999, published in the Official Gazette No. 208, Volume No. 345, November 9 of that year, he was ratified in all parts of the Framework Convention on Enforcement of Financial Aid and Technical and Economic Cooperation in El Salvador , under Regulation "ALA", signed on 17 May 1999 between the Government of the Republic of El Salvador and the European Community, represented by the Commission of the European Communities, which in its Art. 3 states that any project cooperation selected by said Commission, may lead to specific financing agreement between the Commission acting on behalf of the European Community and the Government of the Republic of El Salvador or authorities of public bodies mentioned in Art. 6 Convention, which could be the State, decentralized administrations and local communities, among others.
II. That on October 27, 2011, the Government of the Republic of El Salvador signed with the European Union, the Financing Agreement No. DCI- ALA / 2011 / 022-647 for the implementation of "Solidarity Programme Support Communities El Salvador (PACSES) "in the amount of 47.4 million euros equivalent to US $ 61,823,820, of which 45,000,000 euros equivalent to US $ 58,693,500 will be allocated for Budget Support and 2,400,000 euros equivalent to US $ 3,130,320 for Help, with a duration of 60 months from the entry into force of the Convention.
III.- by Legislative Decree No. 863, dated April 30, 2009, published in the Official Journal No. 94, Volume No. 383, of May 25 of that year, it was ratified in all its parts Basic Cooperation Agreement between the Republic of El Salvador and the Kingdom of Spain, so that on July 6, 2011, was signed with the Spanish Agency for International Cooperation for Development (AECID), the financing agreement to develop an operation of the Common Fund Support Programmatic (FOCAP) for the same "Caring Communities program in El Salvador", for an amount of 16,000,000 euros equivalent to US $ 21,440,000, which will be used to support Programmatic 15,600,000 euros equivalent to US $ 20.904 million and 400,000 euros equivalent to US $ 536,000 for technical assistance to the program.
IV.- That on April 10, 2002, was signed between the Republic of El Salvador and the Grand Duchy of Luxembourg at the General Cooperation Agreement between the two countries, which was ratified by the Legislature, Legislative Decree No. 869, dated June 6, 2002, published in the Official Gazette No. 118, Book No. 355, 27 of the same year; so that on March 23, 2012, the Luxembourg Agency for Development Cooperation,


2 were acting under mandate of the Ministry of Foreign Affairs and Immigration of the Grand Duchy of Luxembourg and the Republic of El Salvador, they signed the financing agreement to develop an operation of the Common Fund Support Programmatic (FOCAP) in support the "Community Solidarity Program in El Salvador" in the amount of 10,000,000 euros equivalent to US $ 12,200,000.
V.- That pursuant to that established in Legislative Decrees Nos. 725, 863 and 869 mentioned above, the provisions of the code of conduct of supportive communities and within the framework of the administrative provisions of the respective Financing Agreements , the Technical Secretariat of the Presidency of the Republic through trades, STP-AAF-170/2012 and STP-AAF-121/2012 dated 26 March and 8 May 2012, assigned to the Technical Secretariat of the US Presidency $ 2,200,290, and the Secretariat of Social Inclusion US $ 2,347,740, which has a total of US $ 4,548,030, of which US $ 2,739,030 correspond to PACSES Funds and US $ 1,809,000 to FOCAP Funds; resources for the implementation of projects Nos 40615 "Support Universal Social Protection System of El Salvador-Solidarias-FOCAP Communities Program" with US $ 2,200,290.; No. 5785 "Strengthening Women Usulutan City headquarters, Santa Ana and San Martin" with US $ 1,304,300, No. 40616 "Support for Associations, Homes and NGOs working for the benefit of the population Elderly in El Salvador-Program Solidarity-PACSES communities "with US $ 43.440; No. 5796 "Improvement, adequacy of infrastructure and equipment of houses of culture at the national level, for the attention of the Elderly" with US $ 605.630 and No. 40623 "Strengthening cultural activities for older adults in Casas de la Culture national level "with US $ 394.370.
That
VI.- of US $ 4,548,030 allocated in the 2012 fiscal year for the aforementioned projects, the amount of US $ 3,541,802 was executed, leaving an outstanding amount of US $ 1,006,228, which correspond to the Technical Secretariat of the Presidency US $ 44.090, Ministry of Social Inclusion with US $ 856.533 and US Secretary of Culture $ 105.605, these resources are US $ 986.228 PACSES Funds and US $ 20.000 Funds are FOCAP.
VII.- that as a result of exchange rate differential generated by the disbursement of the current fiscal year of FOCAP Funds by the Grand Duchy of Luxembourg, through the Luxembourg Agency for Development Cooperation, has generated an amount of US $ 259.800, a figure assigned to the Technical Secretariat of the Presidency of the Republic through trade STP / SPSU / 0012/13, dated March 6, 2013, for Project No. 40615 "System Support Universal Social Protection of the Salvador Solidarias- FOCAP Communities Program. " That VIII.-
Support Program Caring Communities, is an important component of Universal Social Protection System contained in the Five Year Development Plan 2010-2014 and represents one of the strategies promoted by the Government of El Salvador, comprising urban and rural areas and their priority is the reduction of poverty and social exclusion.

IX.- That the execution of that program, will enable the implementation of the registration of participants and the longitudinal survey of social protection, improving the living conditions of women in the cities of Usulutan, Santa Ana and San Martin, through the provision of social services offered by the Centers for Comprehensive City woman and improving the physical conditions of the Houses of Culture to develop the program activities Our Elders Rights.
X. That the Budget Law for Fiscal 2013 financial year, approved by Legislative Decree No. 182, dated November 8, 2012, published in the Official Gazette No. 228, Volume No. 397, 5 December of the same year, does not include the aforementioned resources from donations; so, in order that the Technical Secretariat, the Secretariat for Social Inclusion and the Ministry of Culture, which are dependencies of the Presidency of the Republic, may have the budgetary allocation for the implementation of the above-referenced projects necessary reforming the Act, incorporating part of Income and Expenses, resources for an amount of TWO HUNDRED SIXTY ONE MILLION TWENTY-SIX THOUSAND DOLLARS oF tHE UNITED STATES oF AMERICA (US $ 1,266,028).
THEREFORE,
in exercise of its constitutional powers and initiative of the President of the Republic, through the Minister of Finance, DECREES
:
Art. 1. In the current Budget Law, Section -A STATE BUDGET, the following modifications are made:
In section II-INCOME, Item 22 Capital Transfers, increméntase Account Capital Transfers 224 External Sector and specific sources, with the amounts indicated below:

The resources amounting to US $ 1,266,028 which are incorporated by this Legislative Decree shall be applied to the funding sources as well: Technical Secretariat of the Presidency Source 69 Spanish Agency for International Cooperation, with US $ 20,000, Source 72 European Union, UNE, with US $ 24.090 and Source 35 Government of the Grand Duchy of Luxembourg, with US $ 259.800, Ministry of Social Inclusion EU Source 72, UNE, with US $ 856.533 Ministry of Culture and European Union Source 72, UNE, with US $ 105.605.
Art. 2. This Decree shall enter into force from the day of its publication in the Official Journal.
