1. Decree No. 381, the Legislative Assembly of the Republic of EL SALVADOR: I.-that by Decree legislative Nr. 234, dated December 14, 2012, published in the Official Journal No. 34, volume no. 398, February 19, 2013, was issued the law on scientific and technological development, in order to establish guidelines for the development of science and technology by the definition of the instruments and fundamental institutional and operational mechanisms for the implementation of a national policy of innovation, science and technology, through the implementation of a National Plan for science and technology, which constitutes the frame of reference of the National Research Agenda; repealing at the same time, the Decree legislative Nr. 287, of 15 July 1992, published in Official Journal No. 144. Volume no. 316, of 10 August of that year, which was created the National Council for science and technology, as an autonomous institution decentralized, attached to the branch of economy.
II.-that the law of scientific and technological development before mentioned, establishes in its article 10 that the Ministry of education will create, within its administrative structure, a specialized unit that shall be a State implementing and executing agency of national policies in the field of scientific, technological development and innovation support; so, based on that power, by means of agreement Ministerial No. 15-0432-A, date March 01, 2013, published in the Official Journal No. 61, vol. No. 399, on April 5 of the same year, the branch of education created the National Council for science and technology, as a decentralized unit, under the direct authority of the Deputy Minister of science and technology.
III.-that the article 23 of the Act referred to in the previous recitals, establishes that the staff belonging to the areas of science and technology from the Council, as well as the necessary administrative staff that is determined by the Deputy Minister of science and technology, will become part of the Ministry of education, and assigned to the new CONACYT , stipulating staff that becomes part of this class of insurance, for purposes of accounting and payment of your work time, be deemed time worked in that entity and to staff who are not hired, will be recognised him their employee benefits and labor liabilities will be paid, giving them one month's salary per year or fraction working in the institution.

2 IV-which I am not in the referred law established that entity should be the payment of benefits and labor liabilities to employees concerned; so, it is necessary to empower the Ministry of education, exceptionally so charged to its existing budgetary allocations to cover this commitment.
V-that in the current budget law, was programmed by the special budget of the National Council of science and technology, as an institution in the field of economy, with an allocation of five hundred forty and seven thousand eight hundred ten dollars of United States of AMERICA (US$ 547,810.00), whose amount has the date of allocation of three hundred fifty and two thousand four hundred fifty and four dollars of the United States of AMERICA (US $ 352,454.00) which should be transferred to the field of education to meet the expenses of the Council, which according to the agreement Ministerial No. 15-0432-A, date March 01, 2013, started to operate in MINED from that date. Also, 19 places scheduled by CONACYT budget contracts system, should be transferred to MINED, while maintaining the same wage and payment system.
VI. that in order that the field of education to have the resources necessary for the normal functioning of the National Council of science and technology during the present fiscal year of 2013, it is necessary to incorporate in the existing budget law passed by Decree legislative Nr. 182, dated November 8, 2012; published in Official Journal No. 228, volume no. 397, on December 5 of the same year, the appropriate amendments.
POR_TANTO, in use of his constitutional powers and at the initiative of the President of the Republic, by the Minister of finance, DECREES: article 1.-fiscal 2013, the budget law for the year introduces the following amendments: to) in the section - to GENERAL budget of the State, section III - expenses, in the part corresponding to the field of education literal B. allocation of resources, is added in the numeral 3. Purposes related to assigned resources and 4. Budget allocation by group category, source of funding and economic destination, budget 12 Council national unity of science and technology and line work 01 development of science and technology, as well: 3. relationship purposes with resources allocated 3 unit budget and line work purpose cost 12 Council National Science and technology 01 development of science and technology implement and execute national policies in the field of scientific development and technological support for the promotion of innovation 352,454 352,454 4. Budget allocation by group category, source of funding and budgetary unit economic destiny and encryption budgetary line of work 51 pay 54 acquisitions of goods and services expenditure flows 12 National Council of science and technology 2013-3100-3-12-01-21-1 Fund General development of science and technology 216,897 135,557 352,454 B) resources amounting to $352,454 that is added in the field of education , the budget unit and line of work before mentioned, will be decreased the budget unit 07 support to affiliated institutions, line of work 01 Council National Science and technology, item 56 transfers streams, code: 2013-4100-4-07-01-21-1 General Fund, corresponding to the field of economy.

Article 3.-empower the education industry to charge to its existing budget allocations, pay employee benefits and labor liabilities, from CONACYT personnel, as stipulated in article 23 of the Act of scientific and technological development, and must be given one month's salary per year or fraction working in the institution.
Article 4.-the present Decree shall enter into force as from the day of its publication in the official journal.
