1 Decree No 410 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that the legislative plenary, with 26 of the current date, accepted the resignation presented by lawyer Javier transit Bernal Granados, as first judge of the Court of accounts of the Republic, who presented it in order to resolve impasse aroused by your choice expressing, at the same time, that it is willing to accept a new election for the post, if so had it to good legislative plenary, creating with this resignation, a vacancy in the position of first judge of the Court of accounts of the Republic;
II.-in accordance with provisions of the Art.131, paragraph 19, of the Constitution, exclusive attribution of this House, is to choose the President and judges of the Court of accounts of the Republic;
III.-that the Constitution, in its article 198, sets as unique requirements for the performance of them charges of President and judges of the Court of accounts that must be Salvadoran by birth, greater of thirty years of age, of honesty and competition notorious; be in the exercise of the rights of citizens and have been in the three years prior to his election;
IV.-this organ of the Government through formalities, as described, in detail, in the opinion of the political Commission, which issued to that effect, has proved convincingly that the candidate, Attorney Javier transit Granados Bernal, underwent the procedure laid down in regulation in this House, and which meets the constitutional requirements mentioned above, which is based on the application and submitted resume , the corresponding certificates accompanying such as: birth certificate, reports of various public institutions that les was required, the achievements of the institution during his tenure as first judge of the Court of Auditors, played from 16 June 2011, as well as interviews with the candidates, which were publicly , and with the presence of journalists who cover this information source, certificates comparison between the universe of candidates, all of which is justified and based that this candidate is suitable for the position, and that there are no situations or facts that disqualify him or inhibit for such performance.
Therefore, use of his constitutional powers, DECREES: 2 article only-choose as first judge of the Court of accounts of the Republic, to the lawyer Javier transit Bernal Granados, to end the period that expires on June 28, the year 2014.
The elected official paid before this Assembly, protest referred to in Article 235 of the Constitution, before taking up his post.
