THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I.- That Legislative Decree No. 1030, dated 26 April 1997, published in Official Gazette No. 105, Volume No. 335, of 10 June 1997, issued the PENAL CODIGO.

II.- That article 338 of the Criminal Code does not unequivocally establish the punishable conduct of the use of telecommunication facilities in prisons, it should be taken into account that information and communication technologies are likely to be used as a tool for the commission of offences, in particular by those in prison.

III.- That in the light of the above, it is necessary to reform the Criminal Code, interspersing an article 338-C between article 338-B and 339, in order to expressly include the offence of “Indebted Use of Appparates, Components and Electronic and Telecommunications Accessories, in Prisons, Detention or Reeducational Centers”.

IV.- That the Penal Code should also be amended by providing that a prison officer or employee alters or modifies security standards that correspond to the detention regime affect its functionality.

DECRETA:

REFORMS TO CRIMINAL CODIGO

Art. 1.- Addendum to Art. 338-B as the last subparagraph, the following paragraph:

“The staff member or penitentiary employee who, through action or omission, alters or alters the security standards of the Internal Referral Regime, affecting its functionality, shall be punished with imprisonment for four to eight years and special disqualification of the position or employment for the same time. ”

Art. 2.- Intercálase entre el Art. 338-B and Art. 339, Art. 338-C, like this:

“USO OF APARTMENTS, COMPONENTS AND ELECTRONIC ACCESSORIES AND TELECOMMUNICATIONS, IN PENITIAL CENTRES, DETENTION CENTRES OR REEDUCATIVES.

Art. 338-C.- Any person who is temporarily detained or is serving a term of imprisonment, in the interior of a penitentiary centre or place of detention, safeguard or re-education, shall use any type of electronic equipment for the storage or processing of information, or telecommunication devices, components or accessories for them, such as SIM cards or chips, telephone cards or pre-paid or similar balances, or any other device or configuration that may be used to transmit, or receive any other signals,

No criminal penalty shall be applied when the use of the objects referred to in the preceding paragraph is carried out in accordance with the penal law. ”

Art. 3.- This Decree shall enter into force eight days after its publication in the Official Gazette.
