1. Decree No. 588 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that by Legislative Decree N ° 272, date January 17, 2013, published in the official journal N ° 15 volume N ° 398, 23 January of the same year, were issued special provisions for the comprehensive Control of the rust of coffee in the coffee-growing areas of El Salvador.
II.-that the coffee, is a product of utmost importance for our agricultural production, as the 217 thousand cultivated apples provide 11.9 percent of the agricultural gross domestic product and 2% of the national production. In addition generates temporary and permanent jobs by the thousands to the rural, coffee plantation and its partner, at the same time forest, supplier of good climate and conditions to produce aquifers.
III.-that the issuance of the referred decree was due, among others, to implement a program of control of the rust of the coffee in the coffee-growing areas of our country, for the damages and economic losses by reducing the quantity and quality of the production of coffee rust product.
IV.-that is necessary and urgent to ensure the effectiveness of the program set already before related Decree, to combat the rust of the coffee plant, so it is necessary to implement reforms that benefit the coffee sector of our country especially to small and medium-sized producers of coffee.
Therefore, use of his constitutional powers and at the initiative of the deputies and members: Orestes Fredesman Ortéz Andrade, Audelia Guadalupe López de Kleutgens, José Santos Melara and José Álvaro Cornejo.
DECREES the following: reforms to the provisions special for EL CONTROL INTEGRAL DE LA ROYA the coffee plant in LAS areas coffee from EL SALVADOR article 1.-insert between article 2 and article 3 an article 2A, as well: "Article 2A.-create a special emergency fund for rust Control program with resources from the Development Bank of El Salvador or the Banco de Fomento Agropecuario , funds that will be used to refinance outstanding Avio of credit of the 2012-2013 crop with State and commercial banks.
2 provide funding through the funds of the trust of support for the production of coffee, known as "Trust", and the Development Bank of El Salvador, to replant the cafetero Park with duly certified rust resistant varieties. Funding may be granted for a period of at least 12 years and maximum of 15 years, with a 5-year grace period."
Article 2.-insert between article 7 and article 8 section 7(a), thus: "provision special and transitional section 7(a)-to give fulfillment to the Arts. 30 and 31 of the law on plant health and Animal, by the State, the Salvadoran Coffee Council (CSC) and the different associations of producers of coffee, duly registered, when they have performed necessary investigations either clear the epidemic of the coffee rust nationwide, which endanger the coffee production, must inform emergency in the shortest possible time to the Ministry of agriculture and livestock so that over a period of three working days after being informed by the Salvadoran Coffee Council, by different organizations or the coffee producers by related research institutions, should the Ministry of agriculture and livestock confirm the presence of pests and diseases endemic in the country or when they acquire incidence levels that are beyond the control of producers as it is the case of the re-emergence of rust; so once confirmed, the Ministry of agriculture and livestock must declare the phytosanitary emergency."
Article 3.-reforming the Art 8, follows: ' article 8.-this Decree shall enter into force as from the day of its publication in the official journal and its effects will last until December 31, 2015. "
Article 4.-this Decree shall enter into force eight days after its publication in the official journal.
