DECRETO N° 588

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I.- That by Legislative Decree No. 272, dated 17 January 2013, published in the Official Gazette No. 15, Volume No. 398, of 23 January 2013, issued the Special Provisions for the Comprehensive Control of the Caffeate Roya in the coffee areas of El Salvador.

II.- That coffee is a very important product for our agricultural production, as the 217 thousand cultivated apples provide 11.9% of the Gross Domestic Product and 2% of the national production. It also generates temporary and permanent jobs for thousands to the rural population, being the coffee plantation and its associated forest, in turn, providing good weather and conditions to produce aquifers.

III.- That the issuance of the said decree was due, among others, to implement a control program of the Cafeto Roya in the coffee areas of our country, for the damage produced and economic losses by reducing the quantity and quality of the production of the Roya coffee.

IV.- That it is necessary and urgent to ensure the effectiveness of the program established in the decree already previously related, for the fight of the Roya del Cafeto, so it is necessary to implement reforms that benefit the coffee sector of our country especially the medium and small coffee producers.

TANTO,

in the use of their constitutional powers and at the initiative of the Deputies and Deputies: Orestes Fredesman Ortéz Andrade, Audelia Guadalupe López de Kleutgens, José Santos Melara and José Álvaro Cornejo.

DECRETE the following:

REFORMS TO SPECIAL PROVISIONS FOR THE INTEGRAL CONTROL OF THE CAFECT ROY IN THE CAFETALARY ZONES OF THE SALVADOR

Art. 1.- Intercálase entre el Art. 2 and Art. 3 an Art. 2A, like this:

“Art. 2A.- Create a Special Emergency Fund for the Roya Control Programme with resources from the Banco de Desarrollo de El Salvador or the Banco de Fomento Agropecuario, funds that will be used to refinance insolute balances of the Avío de la Harvest Credit 2012-2013 with the commercial and state banks.

To grant funding through the Funds of the Coffee Production Support Trust, called “Fideicomiso”, and the Development Bank of El Salvador, to resembrate the cafeteria park with properly certified Roya resistant varieties. The financing may be granted for a minimum period of 12 years and up to 15 years, with a period of 5 years of grace. ”

Art. 2.-Interchange between Art. 7 and Art. 8 Art. 7A, like this:

“Special and Transitory Provision

Art. 7A.- In order to comply with the Arts. 30 and 31 of the Law on Vegetal and Animal Health, by the State, the Salvadoran Council of Coffee (CSC) and the different associations of coffee producers, duly registered, when they have carried out the necessary investigations or it is evident the epidemic of the Roya del Café at the national level, that endangers the production of coffee, they must report urgency in the least time possible to the Ministry of Agriculture and ”

Art. 3.- Refer to Art 8, as follows:

“Art. 8.- This Decree will enter into force on the day of its publication in the Official Gazette and its effects will last until 31 December 2015. ”

Art. 4.- This Decree shall enter into force eight days after its publication in the Official Gazette.
