DECRETO N° 589

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I.- That by Legislative Decree No. 41 of twenty-eight June 2012, published in Official Gazette No. 137, Volume No. 396 of 24 July 2012, the Law on Identification of Vehicle Serials was issued, which aims to mark the identification series of automotive vehicles, in order to normalize their legal status in the Public Registry of Automotive Vehicles of the Vice-Ministerio de Transporte.

II.- Let Art. 10 of the Law on Identification of Serials of Vehicles in its second paragraph determines the realization of the material act of the same, empowering exclusively the General Directorate of Transit for the execution of the same, as the third paragraph establishes the responsibility of the official for the realization of the material act.

III.- That due to the executive decree of austerity in force from the first of January to the thirty-one of December of the current fiscal year, there is no financial availability for the acquisition of equipment and recruitment of highly specialized personnel to perform the physical remarking of the identification series of a motor vehicle.

IV.- That in order to comply effectively with the object of the law, which is the remarking of the automotive vehicle identification series for the loss, deterioration or alteration of one of its identifiers, making it possible to register the Public Registry of Automotive Vehicles, it becomes necessary to reform the Identification Law of Vehicle Serials.

DECRETE: The following:

REFORMS TO THE LAW OF IDENTIFICATION OF VEHICLES

Art. 1.- Amend chapter IV, paragraph 2, on the Procedure as follows:

“The material act of marking the identification series will be carried out by the General Directorate of Transit or, by whom it authorizes.”

Art. 2.- Amend article 10, paragraph 3, of Chapter IV on the Procedure as follows:

“Any expense incurred by the owner of a vehicle for the mismanagement of a series will be the responsibility of the holder of the General Directorate of Transit and of the official or employee who executes such a marking or who has been authorized to execute it. ”

Art. 3.- Amend Article 17 (1) of Chapter VI on General Provisions as follows:

“Art. 17.- The physical demarcation of the identifiable series that according to this law is applicable will have a cost which will be defined by the General Directorate of Transit”.

Art. 4.- Amend section VI, paragraph 3, on General Provisions as follows:

“The alienation made in contravention of the provisions of this article shall be presumed null and void.”

Art. 5.- Defrost article 20 as a whole.

Art. 6.- This Decree shall enter into force eight days after its publication in the Official Gazette.
