THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I. According to article 172 of the Constitution, the Judiciary has the power to prosecute and enforce the court in civil and commercial matters, in the Magistrates ' Courts and Second Instance Chambers; it also states that its organization and functioning shall be determined by law.

II. That Legislative Decree No. 372, dated twenty-seven May of two thousand ten, published in Official Gazette No. 100, Volume No. 387, dated thirty-one May of two thousand ten, in its article 17, regulates that the proceedings in force upon the entry into force of the Code of Civil and Commercial Procedure, should be substantiated and fenced no later than the end of the two-year period, counted on the extension of the statute,

III. That Legislative Decree No. 42, dated twenty-nine June of two thousand twelve, published in the Official Gazette No. 395, Volume No. 120, dated twenty-nine of the same month and year, in its article one, extended for eighteen more months the effects of article 17 of the legislative decree related to the previous consideration.

IV. That there are currently more than 18,000 unresolved processes on the part of the Jurisdictional Body, which generates a lot of concern on the part of this State Body, and the judges of the Supreme Court of Justice are urged to carry out the relevant measures to realize their mission of ensuring prompt and full justice.

V. That in view of the fact that the deadline referred to in consideration III, and which expires on the thirty-one December of this year, has not been sufficient, it becomes necessary to extend that period for a further twelve months.

in the use of its constitutional powers and at the initiative of the Supreme Court of Justice,

RIGHT:

Art. 1.- Prorrógase por 12 meses más, los efectos del artículo 17 del Decreto Legislativo N 372, de fecha 27siete de mayo de dos mil Diez, publicado en el Diario Oficial N° 100, Tomo N° 387, de fecha thirty y uno de mayo de dos mil Diez.

Art. 2.- Judges who continue to be aware of the proceedings initiated under the Civil Procedures Code and other special laws, shall submit a quarterly report to the Supreme Court of Justice on progress in the purification and completion of pending proceedings.

The report referred to in this article should be prepared by payroll containing the following information: reference or record number, procedural parts, type of process or diligence, base document of the action, if any, procedural stage and description of the number of parts and folios that make up it. It shall also contain the signatures of the judge and the secretary of proceedings, and the seal of the respective court.

Art. 3.- The present decree will enter into force on January 1, two thousand fourteen, following its publication in the Official Journal.
