THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I.- That by Legislative Decree No. 436, dated 15 October 1998, published in Official Gazette No. 206, Volume No. 341, the Special Law on Graces was issued.

II.- That this Assembly received a request for pardon in favor of the intern Miguel Reyes, sentenced to thirty years in prison, imposed for the crime of Homicide Agravated, typified and sanctioned in Art. 129 numeral 3 of the Criminal Code, sentence imposed by the First Court of Judgment of the City of San Miguel, at ten hours with twenty minutes of the day 3 of January of 2008, of which the Supreme Court of Justice was requested, dated 21 September 2010 and on 17 March of this year, the Supreme Court of Justice forwarded the corresponding report, giving favourable opinion to it.

III.- On the basis of the favourable opinion issued by the Supreme Court of Justice, the Commission, taking into account that Mr. Miguel Reyes is a person suffering from a chronic degenerative disease, which causes him difficulties in mobilizing.

IV.- That for the reasons expressed above, he considers the need for the detainee Miguel Reyes to enjoy freedom, because for the diseases he suffers, it is appropriate to grant the pardon requested.

V.- It is the power of the Legislative Assembly to grant pardons, following a favourable report of the Supreme Court of Justice, as regulated by article 131, ordinal 26 of the Constitution of the Republic.

in the use of its constitutional powers.

RIGHT:

Art. 1.- Please grant pardon to the inmates Miguel Reyes, of the penalty imposed for the offence of Agravated Homicide, which is defined and sanctioned in Art. 129 numeral 3 of the Criminal Code, sentence imposed by the First Court of Judgment of the City of San Miguel, at ten hours with twenty minutes of the day 3 of January of 2008, based on the favorable report dated 17 March of this year, issued by the honorable Supreme Court of Justice.

Art. 2.- This Decree shall enter into force from the day of its publication in the Official Gazette.
