DECREE No. 699 THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
I. That on April 10, 2002, was signed between the Republic of The Salvador and the Grand Duchy of Luxembourg, the General Cooperation Agreement between the two countries, which was ratified by the Legislative Assembly by Legislative Decree No. 869, dated June 6, 2002, published in the Official Gazette No. 118, Volume No. 355 , 27 of the same year; so that on March 23, 2012, the Luxembourg Agency for Development Cooperation, were acting under mandate of the Ministry of Foreign Affairs and Immigration of the Grand Duchy of Luxembourg and the Republic of El Salvador, signed the financing agreement to develop a operation of the Common Fund support Programmatic (FOCAP) in support of the "Community Solidarity Program in El Salvador", amounting to € 10,000,000.00 euros equivalent to US $ 12,200,000.00.
II.- by Legislative Decree No. 863, dated April 30, 2009, published in the Official Journal No. 94, Volume No. 383, of May 25 of that year, the Basic Agreement ratified in all its parts Cooperation between the Republic of El Salvador and the Kingdom of Spain; so that on July 6, 2011, was signed with the Spanish Agency for International Cooperation for Development (AECID), the financing agreement to develop an operation of the Common Fund Support Programmatic (FOCAP) aimed at the same " Solidarity Communities program in El Salvador ", for an amount of € 16,000,000.00 euros equivalent to US $ 21,440,00; which will go for Programmatic Support € 15,600,000.00 euros equivalent to US $ 20,904,000.00 and € 400,000.00 euros equivalent to US $ 536,000.00 for Technical Assistance Program.
III.- by Legislative Decree No. 725, dated September 30, 1999, published in the Official Gazette No. 208, Volume No. 345, November 9 of the same year, ratified in all parts of the Framework Convention on the implementation of the Financial Aid and Technical and Economic Cooperation in El Salvador, under Regulation "ALA", signed on 17 May 1999 between the Government of the Republic of El Salvador and the European Community, represented by the Commission of the European Communities, which in its Art. 3 provides that all cooperation projects selected by said Commission, may lead to a specific financing agreement between the Commission acting on behalf of the European Community and the Government of the Republic of El Salvador or the authorities of the public bodies mentioned in Article 6 of the Convention, which may be:. State, devolved administrations and local communities, among others.
2 IV.- That on October 27, 2011, the Government of the Republic of El Salvador signed with the European Union, the Financing Agreement No DCI-ALA / 2011 / 022-647 for execution the "Support Program for Caring Communities in El Salvador (PACSES)" in the amount of € 47,400,000.00 euros equivalent to US $ 61,823,820.00 of which EUR € 45,000,000.00 equivalent to US $ 58,693,500.00 will be allocated for Budget Support and € equivalent to US 2,400,000.00 euros $ 3,130,320.00 for Help, with a duration of 60 months from the entry into force of the Convention; however, dated January 20, 2014, it was approved Addendum No. 1 amending the original distribution of these resources, being as follows: € 42,750,000.00 euros equivalent to US $ 55,758,825.00 for Budget Support; € 2,400,000.00 euros equivalent to US $ 3,130,320.00 to € 2,250,000.00 Extra Help and euros to US $ 2,934,675.00 equivalent to support Ciudad Mujer Program, through the Ministry of Social Inclusion.
V. That the Caring Communities program is an important component of Universal Social Protection System contained in the Five Year Development Plan 2010-2014 and represents one of the strategies promoted by the Government of El Salvador, which comprises the urban and rural areas and their priority is to reduce poverty and social exclusion; within which, the Technical Secretariat is implementing the Technical Assistance Project Code 40615 "Support Universal Social Protection System of El Salvador-Solidarias-FOCAP Communities Program."
VI.- of approved for fiscal 2012 by the Spanish Agency for International Cooperation for Development and the Grand Duchy of Luxembourg resources, there is an unused balance of US $ 1,027,195.00, of which by Note No. STP / SPSU / 0150/13 dated November 28, 2013, was assigned to the Technical Secretariat of the Presidency the amount of US $ 427,195.00 (US $ 379,163.00 of AECID and US $ 48,032.00 Duchy of Luxembourg), whose incorporation into the Budget Law in force 2014 is necessary to strengthen the Register of Participants Universal Social Protection System. That
VII.- of resources allocated to the Technical Secretariat of the Presidency during the year 2013 for the implementation of Technical Assistance Project Code 40615 referred to above, according to Note No. STP / SPSU / 0019/13 dated February 4 2014, there is an availability of US $ 65,611.00 (US $ 23,894.00 AECID; US $ 41,619.00 Duchy of Luxembourg and US $ 98.00 in the European Union), which is required to incorporate the current Law on Budget 2014, in order to strengthen management the Universal Social Protection System.
VIII.- that the disbursement of funds from AECID during exercise
Fiscal 2013 financial, generated an increase of US $ 538,150.00 product of the exchange rate differential, whose amount by Note No. STP / SPSU / 0138/13 dated November 8, 2013, was assigned to the Technical Secretariat the Presidency the amount of US $ 258,150.00 which is convenient to add them to the current 2014 budget, so they can be aimed at strengthening and positioning Universal Social Protection System and the implementation of the Secretariat for Vulnerability Affairs.
IX.- That in order that the Technical Secretariat of the Presidency, may use the credit budget that allows it to continue funding the Technical Assistance Project Code 40615 cited above, it is necessary to reform the current Budget Act voted by Decree legislative No. 522, dated October 31, 2013, published in the Official Gazette No. 225, Volume No. 401 of December 2 of the same year, incorporated in Section II- Revenue and Expenditure in Section III, part corresponding to the Presidency of the Republic, Grant resources available up to an amount of SEVEN HUNDRED FIFTY FIFTY SIX HUNDRED THOUSAND DOLLARS 00/100 UNITED STATES oF AMERICA (US $ 750,956.00), of which the amount of FIFTY THOUSAND EIGHT HUNDRED FIFTY EIGHT aND 00/100 DOLLARS oF tHE UNITED STATES oF AMERICA (US $ 750,858.00) comes from FOCAP (US $ 661,207.00 of the Spanish Agency for International Cooperation for Development and US $ 89,651.00 of the Grand Duchy of Luxembourg) and NINETY EIGHT 00/100 DOLLARS THE UNITED STATES oF AMERICA (US $ 98.00) correspond to PACSES (European Union).
