1. Decree No. 714 in the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that by Decree N ° 534, dated November 7, 2013, published in the official journal N ° 223, Tome N ° 401, November 28 of the same year, was issued the "special law of extinction of domain and the administration of the goods of origin or destination illicit".
II. that articles 17 and 18 of the aforementioned Act establishes the obligation to create the courts specialized in domain extinction, corresponding to first and second instance.
III. for the application of the law before referred to, is necessary the creation of courts indicating the same legal body and erect the corresponding jurisdiction, as they have it the 131 articles ordinal 31 ° and 3 ° 133 ordinal of the Constitution. And must, therefore, enter the corresponding to the organic law of the Judicial reforms, so feel the courts specialized in extinction of domain, of first and second instance, respectively.
IV.-that will be the Supreme Court of Justice which must have the form of organization and administrative form of courts, taking into account the modernization of the judiciary.
Therefore, use of his constitutional powers and at the initiative of the Supreme Court of Justice.
DECREES: Creation of specialised courts Article 1.-believe the courts specialized in extinction of domain and erect the jurisdiction that corresponds, in first and second instance, Court and Chamber respectively, which will develop its judicial function, as set out in the Constitution, conventions and relevant treaties, special legislation and related laws, which will be exclusively for the extinction of domain action.
First instance: Judged expert in extinction of domain, with residence in San Salvador, and competition in the entire territory of the Republic.
2. second instance: Camera specializing in domain extinction, with residence in San Salvador and competition throughout the territory of the Republic. Learn about degree of appeal of final and other interlocutory judgments which designate the law of the matter, by the specialized court in extinction of domain.
Powers of the Court of Justice article 2.-the Supreme Supreme Court, are available for the service of the specialized court and Chamber of extinction of respective domain, the use of electronic, optical, magnetic, electronic, computer systems and other technologies, for the proper functioning of the judicial offices.
Provision transitional Art. 3-expanded, temporarily, the jurisdiction and competence of the first Chamber of the penitentiary of the first section of the Center, to know of the appeals against final or interlocutory decisions pronounced by the Court specialized in domain extinction, while it is not created a specialized camera, which will be subject to consideration of the Supreme Court of Justice attending to the increase in the workload.
Periodic reports article 4.-the courts before referred to, must report quarterly to the Supreme Court of Justice, about the advances in treatment and termination of processes.
The reports referred to in this provision, are to be compiled using payroll containing the following information: reference, number of record, procedural parts, stage of the proceedings, description of parts number and number of pages that comprise it.
The signatures of the titular judge, Secretary of performances and the stamp of the respective court should also include.
Article 5.-the provisions of this Decree shall be taken by incorporated into the Judicial Organization Act.
Article 6.-this Decree shall enter into force eight days after its publication in the official journal.
