DECREE NO 783

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That in accordance with Article 63 of the Constitution of the Republic, the artistic, historical and archaeological wealth of the country is part of the Salvadoran cultural treasure, which remains under the safeguard of the State and subject to special laws for their conservation.

II.-Also, Article 144 of the same body It establishes that the international treaties concluded by El Salvador with other States or with International Organizations, constitute Laws of the Republic upon entry into force, in accordance with the provisions of the same Treaty and Constitution. The Law will not be able to modify or repeal what was agreed in an existing treaty for El Salvador. In the event of a conflict between the treaty and the law, the Treaty will prevail.

III.-That by Legislative Decree No 16 of 07 June 2012, and published in the Official Journal No. 127, Volume N ° 396, of July 10 of the same year, was ratified the Convention for the Safeguarding of the Intangible Cultural Heritage, which in its Articles 2 and 3, states that "Intangible Cultural Heritage" means the uses, representations, expressions, knowledge and techniques that the communities, groups and in some cases individuals recognize as an integral part of their cultural heritage. This intangible cultural heritage, which is transmitted from generation to generation, is constantly recreated by the communities and groups according to their environment, their interaction with nature and their history, giving them a feeling of identity and continuity and thus contribute to promoting respect for cultural diversity and human creativity; which can be manifested in oral traditions and expressions, social uses, rituals and public holidays, among others.

IV. the Celebration of the "Day of the Faroliths" in the Municipality of Ahuachapan, of the Department of Ahuachapan, is a popular religious tradition that develops on September 7 of each year, when the population of the community meets with enthusiasm to enjoy this activity, which is considered, an expression of its own our identity as Salvadoran and Salvadoran, being able to declare to this celebration "Intangible Cultural Heritage of El Salvador".

DECRETA:

Art. 1.-Declare the Celebration of the "Day of the Faroliths" in the Municipality of Ahuachapan, of the Department of Ahuachapan, "INTANGIBLE CULTURAL HERITAGE OF EL SALVADOR", for constituting this tradition that takes place on September 7 of each year, a expression of our identity as Salvadoran and Salvadoran.

Art. 2. This Decree shall enter into force eight days after its publication in the Official Journal.
