1 Decree N ° 787 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that in accordance with article 110 of the Constitution, is the duty of the regular State and monitor public services; seeking to promote access to telecommunications service and the protection of the rights of the users.
II. rights of the users of the public service of telecommunications, among others, are to access the service of telephony without interference or interventions; to not be you disconnect arbitrarily service; to be compensated for damages which cause the operators, as it established laws; in the respective service contract specifying clearly the terms and conditions under which you will receive the service, especially in relation to the quality, coverage, rates and continuity of the same; to be informed in advance of the service cuts to carry out maintenance and the estimated time of duration thereof; to be priced and invoiced to the exact second in all the services of telephony, where time is the unit of measure.
III.-that it is necessary to lay down provisions which allow, in accordance with the existing constitutional and legal framework, ensure the provision of the same under conditions of quality, continuity and regularity.
IV.-that amendments to the Telecommunications Act should be so issued rules that define indicators and technical reference parameters that allow you to measure the quality of telecommunications services which provide commercial network operators; and that result in prejudice to the users, be they compensated for the operators.
Therefore, use of his constitutional powers and at the initiative of Deputies Othon Sigfrido Reyes Morales, José Francisco Merino López, Irma Lourdes Vasquez Palacios, Francisco José Zablah Safie, Rodolfo Antonio Martínez, Damian Alegria, Blanca Noemi Coto Estrada, Rodriguez Bertha Mercedes Avilés, José Álvaro Cornejo Mena, Norma Fidelia Guevara de Ramirios, Manuel Rigoberto Soto loop, Abner Ivan Torres Ventura and martyr Arnoldo Marin.
DECREES the following: reforms to the law of telecommunications 2 article 1.-added paragraphs fourth and fifth to article 1 in the following manner: "the SIGET in the exercise of their functions shall seek from operators of commercial telecommunications networks, the technical information that is necessary to verify compliance with the Act, its regulations and standards that are applicable.
The SIGET must be performed by itself, or through experts or auditors authorized and designated for this purpose, and supervised by staff of the SIGET, inspections deemed necessary in order to check the veracity of the information provided, to the extent that is necessary for the performance of their duties."
Article 2.-added an article 5-A in the following manner: "article 5-A.-the SIGET established technical regulations based on the standards of quality of public telecommunications services." All commercial telecommunications network operator shall be obliged: to) have an auditable measurement system that allows verification of the quality of the public telecommunications services and verification of measurements, according to the technical regulations based on the standards of quality that dictates the SIGET; and, b) report in the periods indicated by the SIGET on the requirements set out in the technical regulations based on the quality standards of services, indicating breaches of quality indicators related to the establishment and duration of telephone calls, services of data, text messaging and multimedia, voice quality, application of rates, customer radio coverage, damages and faults in networks and other services in telecommunication networks.
The SIGET will be responsible for defining the methodology of measurement and control, the content and the form of exchange of information; and can audit processes and information when deemed necessary.
These technical regulations will be issued by the SIGET in coordination with the Salvadoran organization of technical regulation (OSARTEC) "."
Article 3.-added the literal j) and k) article 33 of the following way: "j) breach of the technical regulations based on the standards of quality of public telecommunications services established by the SIGET, in the period of control defined by this institution; (y, k) non-compliance in the payment of compensation result from a process of claims established in this law ".
Article 4.-added the literal or) article 34 in the following manner: 3 "or) failure to comply with repeated technical regulations based on the quality of service standards established by the SlGET, concerning quality indicators related to the establishment and duration of telephone calls, data service, text messaging and multimedia, voice quality ", application rates, attention to the customer, radio coverage, damages and faults in networks and other services in the telecommunications networks".
Article 5.-added the literal l) article 98 in the following manner: "l) by the non-compliance in the provision of telecommunications services established in the technical regulations based on the quality of service standards established by the SIGET".
Article 6.-this Decree shall enter into force eight days after its publication in the official journal.
