DECREE No. 811 THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 307 dated February 14, 2013, published in the Official Gazette No. 40, Volume No. 398 of the same year, the Law on Political Parties was issued.
II.- That Article 37 of the Act, mandates that the lists of deputies to the Legislative Assembly, the Central American Parliament and members of the municipal councils should be formed by at least thirty percent of women.
III.- That some electoral actors have expressed doubts about the application of that percentage, so to dispel any concerns about this, it is necessary to amend this provision.
THEREFORE,
in exercise of its constitutional powers and initiative of the Members of Ramirios Norma Guevara Fidelia, Mariella Peña Pinto, Jackeline Noemi Rivera Avalos, Alberto Armando Romero Rodriguez and Nelson of Jesus Quintanilla Gomez.
DECREES the following:
LAW REFORM TO POLITICAL PARTIES
Art. 1. Agréguense three indents at the end of Article 37 as follows:
"It shall be applied to each national, departmental and municipal payroll, according to the inscription of candidates that each political party or coalition present in the constituencies national, departmental and municipal. Each return will be considered holistically, ie, including candidates and alternates.
For the lists with candidates for municipal councils, thirty percent minimum participation of women, will be required both in the forms presented by political parties or coalitions should be winners, and lists that designate the order of precedence in case of no simple majority, according to Article 165 second paragraph of the Electoral Code.
The Supreme Electoral Tribunal must verify that the political parties or coalitions comply with the provisions of this article, so that the municipal councils elected in conformation to achieve the effective participation of at least thirty percent of women. "

Art. 2. This Decree shall enter into force eight days after its publication in the Official Journal.
