DECREE N ° 996

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No. 353, dated October 19, 1989, published in Official Journal No. 200, Volume No. 305, of the 30th of the same month and year,

the Law of the Salvadoran Coffee Council was issued, in which it is created the Salvadoran Coffee Council, as an autonomous state institution, with representation of the private sector, constituting in the higher authority in

national coffee policy material and other activities related to the coffee industry.

II.-That in order to update the performance of the The Salvadoran Council of Coffee, in its capacity as the governing institution of the national coffee culture, to the reality that the coffee sector is going through, it is necessary to reform some of the provisions of the

Law of the Salvadoran Coffee Council.

TANTO,

in use of its Constitutional powers and on the initiative of the President of the Republic through the Minister of Economy,

DECRETA the following:

REFORMS TO THE LAW OF THE SALVADORAN COUNCIL OF COFFEE

Art. 1.-Reform Art. 3, as follows:

Art. 3.-The Council will have its headquarters and main offices in the city of Santa Tecla,

Department of Freedom. In order to fulfill its purpose, it may open offices anywhere in the Republic or abroad, when the Directory deems it necessary. "

Art. 2.-Addition to Art. 4 (e) and a final point, as follows:

" e) To promote the development of research and experiments in the field of agronomy,

agrology and coffee technology, in order to increase its productivity and improve its quality; likewise, apply these research and experiments to promote the industrialization of coffee, trying to reduce the costs of production and obtain better use of the by-products. "

" For compliance with the above literals, the Council is empowered to celebrate with governmental and non-governmental, national or international entities, the

documents that are necessary for the fulfillment of institutional purposes. "

Art. 3.-Replace in Art. 7 the Roman I) and the final paragraph, as follows:

" I) Public Sector:

a) Minister of Agriculture and Livestock;

b) President of the Central Reserve Bank of El Salvador;

c) Minister of Environment and Natural Resources; and,

d) Minister of Tourism.

The Directory will be chaired by the Minister of Agriculture and Livestock, and in his absence, by the holder

that follows in the order of the above mentioned literals. "

Art. 4.-Reform in Art. 11, the last paragraph as follows:

"The resolutions of the Board shall be settled in a Book of Acts, which shall be authorized by the Minister of Agriculture and Livestock."

Art. 5.-Reform the number 4) of the third indent of Art. 20, as follows:

" 4) Apply daily the Differential agreed by the Directory, in accordance with the Articles

26 and 27 of this Law in order to determine the price FOB and to settle it in a book that will be specially carried for that effect, which must be authorized by the Ministry of Agriculture and Livestock; "

Art. 6.-Reform of Art. 52, as follows:

Relations with the Executive Body

Art. 52. In its relations with the Executive Body, the Council shall do so through the Ministry of Agriculture and Livestock, through its holder. "

Art. 7.-Reform the second paragraph of Art. 57, as follows:

"This Memory shall be presented to the Minister of Agriculture and Livestock and shall be printed and widely circulated."

Art. 8.-This Decree shall enter into force eight days after its publication in the Official Journal.
