CONSTITUTIONAL REFORM AGREEMENT NO 4

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR SALVADOR,

CONSIDERING:

I.-That in accordance with Article 1 of the Constitution, El Salvador recognizes the human person as the origin and the end of the activity of the State and that consequently,

is its obligation to assure the inhabitants, the enjoyment of freedom, health, culture, economic well-being and justice

II.-That in the international arena, it has been recognized that the right to clean water and sanitation is an essential human right for the full enjoyment of life, dignity and all human rights. It has also been highlighted that

the right to adequate food is indispensable for the enjoyment and exercise of all other human rights and fundamental freedoms.

III.-What various treaties and declarations The international community recognizes the right of every human being to an adequate standard of living for himself and his family, including adequate food, clothing and housing, and a continuous improvement of the conditions of existence.

IV. Committee on Economic, Social and Cultural Rights of the United Nations, the right to water includes the all right to

have sufficient, healthy, acceptable, accessible and affordable water for personal and domestic use. The Committee has also maintained that the right to food is exercised when every man, woman and child, has physical access and

economic to adequate food or to means to obtain it.

V.-That the recognition of these fundamental rights in our Magna Carta

will expand the possibilities of its constitutional protection and will lay the foundations to improve the quality of life of the inhabitants of the Nation.

in use of its powers Constitutional and with the initiative of Deputies and Deputies: Othon

Sigfrido Reyes Morales, Guillermo Antonio Gallegos Navarrete, Irma Lourdes Palacios Vasquez, Hortensia Margarita Lopez Quintana, Audelia Guadalupe Lopez de Kleutgens, Mario Alberto Tenorio Guerrero, Carlos Cortez Hernandez, Jackeline Noemi Rivera Avalos, Jaime Gilberto Valdez Hernandez, Karina Ivette Sosa

of Lara, Nery Arely Diaz de Rivera, Norma Fidelia Guevara of Ramírios, Santiago Flores Alfaro and Yohalmo Edmundo Cabrera Chacón.

AGREES: the following reform to the Constitution, issued by Decree Constituent No 38 dated 15 December 1983, published in the Official Journal No 234, Volume N ° 281, dated December 16, the same year, of the Constituent Assembly.

Article 1.-Reform the PUBLIC HEALTH AND SOCIAL ASSISTANCE section, located in the Section Fourth, Chapter II, Social Rights, Title II, Rights and Fundamental Guarantees of the Person,

as follows:

"SECTION FOURTH

PUBLIC HEALTH, FOOD, WATER, AND SOCIAL CARE"

Article 2.- Reform Art. 69, as follows:

" Article 69. The State will provide the necessary and indispensable resources for the control

permanent of the quality of the chemical, pharmaceutical and veterinary products, by means of watchdogs. The State will also monitor the quality of food products and environmental conditions that can affect health and well-being.

Everyone has the right to adequate food. It is the duty of the State to create a food and nutrition security policy for all inhabitants. A law will regulate this matter.

Water is an essential resource for life, therefore, it is the obligation of the State to take advantage of and preserve water resources and to ensure their access to the inhabitants. The state will create public policies and the law will regulate this matter. "
