DECREE No. 876 THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 764, dated July 31, 2014 published in the Official Gazette No. 142, Volume No. 404, of the same date, the Law of tax on Financial Operations was issued for the purpose of establishing a tax that will fall on the amount paid of any type of check and electronic transfers in the country, in legal circulation in the country and will allow the generation of tax revenue systemically, with lower costs to operators, contributing to the balance of state finances by way of government revenue.
II.- Art. 6 of Law in reference states that are responsible for payment, as tax withholding agents, entities of the financial system, running orders or transfers by any means or technological medium, brokerage houses, in the case of securities transactions in third operations, the brokerage, in the case of operations Mediation Products and Services, as well as designated by the Tax Administration; all of which are required to withhold tax under that Act and that according to Art. 8 will have a tax base that is determined by applying a rate of 0.25%, equivalent to 2.5 per thousand, on the amount of transactions or taxable transactions , higher than US $ 1,000.00.
III.- That the application of the Law of Tax on Financial Operations has generated additional revenue to the Treasury during the current fiscal year 2014, which were not considered in the current budget law, so that by Legislative Decree No. 799, dated September 11, 2014, published in the Official Gazette No. 174, Volume No. 404, 22 of the same month and year, were incorporated into the existing budget, resources worth SEVENTEEN MILLION 00 / 100 DOLLARS oF tHE UNITED STATES oF AMERICA (US $ 17,000,000.00), of which TWELVE MILLION 00/100 DOLLARS oF tHE UNITED STATES oF AMERICA (US $ 12,000,000.00) went to cover the organization and conduct of elections of Members of Parliament to Central American Parliament for the period 2016-2021; and of Members of Parliament to the Legislature and the members and members of the Municipal Councils for the period 2015-2018; also 00/100 FIVE MILLION DOLLARS OF THE UNITED STATES OF AMERICA (US $ 5,000,000.00) was allocated to strengthening public security actions aimed at prevention and reintegration, combating crime, the administration of prisons and commissioning in operation of the National Asset Management Council (Conab).


2 IV.- That the application of that law continues to generate additional resources that are not included in the current budget; in addition, to date, there is an inescapable and urgent demand of the University of El Salvador to cover shortfalls in the payment of salaries for the remainder of this fiscal year 2014 in the amount of TWO MILLION NINE HUNDRED TWENTY THOUSAND FOUR HUNDRED SEVENTY-ONE 00 / 100 DOLLARS oF tHE UNITED STATES oF AMERICA (US $ 2,928,471.00), which, due to the difficult situation of public finances, no budget allocation and can be addressed with the resources in question.
V.- That budget to give coverage to additional revenue and demand raised before, it is essential to modify the current Budget Law, passed by Legislative Decree No. 522, dated October 31, 2013, published in the Official Gazette No. 225, Volume No. 401, of December 2 of the same year, in order to incorporate in Section II - Revenue, the amount of TWO HUNDRED TWENTY EIGHT MILLION FOUR HUNDRED SEVENTY oNE THOUSAND DOLLARS 00/100 UNITED STATES OF AMERICA (US $ 2,928,471.00); and in Section III - EXPENDITURES, the share of Education Bouquet increases with the amount of TWO HUNDRED TWENTY EIGHT MILLION FOUR HUNDRED SEVENTY ONE THOUSAND DOLLARS 00/100 UNITED STATES OF AMERICA (US $ 2,928,471.00); also in Section B - SPECIAL BUDGET, NO BUSINESS B.1 decentralized institutions, the Special Budget of the University of El Salvador, with the same value increases.
THEREFORE,
in exercise of its constitutional powers and initiative of the President of the Republic, through the Minister of Finance. DECREES
:
Art. 1. In the current Budget Law, Section -A STATE BUDGET, the following modifications are made:

A) In Section II INCOME TAXES Heading 11, has 116 various taxes, increméntase Specific Source 11604 Tax on Financial Operations, with the amount of US $ 2,928,471.
B) in paragraph III - EXPENSES in the share Bouquet of Education, Literal B. Resource Allocation, paragraph 4 Budget Allocation by Category Grouping, Source of Funding and Economic Destination, the following budget increases Unit :
