1 DECREE No. 143

THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I. The Constitution in Article 1 states that El Salvador recognizes the human person as the origin and purpose of the activity of the State, which is
organized for the attainment of justice, legal security and the common good. It also recognizes as a human person in every human being from the moment of conception.
II.- That the Labour Code in Chapter II, Article 309 regulates maternity benefits is pregnant workers.
III that the benefits that can be granted to mention the provision of maternity leave highlights, permanent care
mother to newborn, strengthening the emotional bond between mother and son, and facilitated the benefits inherent in breastfeeding.
IV.- That the World Health Organization and the United Nations Fund for Children UNICEF

, he declared the third week of August each year as "National Breastfeeding week".
V. DECREES the following:
CODE OF LABOR REFORM
Art. 1. reformed the first paragraph of Article 309, as follows:
"Art. 309. The employer is obliged to give the pregnant worker, in respect of maternity leave, sixteen weeks leave, ten of which will be taken compulsorily
after childbirth; and also to pay in advance the equivalent to seventy-five percent of the basic wage during such leave. "
Art. 2. This Decree shall enter into force one hundred and twenty days after its publication in the Official Journal.
