DECREE NO 143

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That the Constitution in its article 1 states that El Salvador recognizes the human person as the origin and end of the activity of the State, which is

organized for the attainment of justice, of security of the common good. It also recognizes as a human person every human being from the moment of conception.

II.-That the Code of Work in Chapter II, article 309 regulates the maternity benefits that the pregnant worker has.

III.- That among the benefits that we can mention when granting maternity leave are highlighted, the mother's permanent care towards

the newborn, the strengthening of the affective bond between the mother and the child, and the benefits inherent in facilitating breastfeeding.

IV.-That the World Organisation of The Health and the United Nations Fund for

UNICEF, officially established "World Breastfeeding Week" in the year 1992, thus generating a social movement for the defense of this purpose. Also, by Legislative Decree No. 74, dated 25 of

July 2012, it was declared the third week of August of each year, as "National Breastfeeding Week".

V.-That the most important and visible benefits of breastfeeding are reflected in the health and survival of children, as a result of the immunity conferred on them, reducing infant mortality and having

healthcare benefits that reach adulthood, so it becomes necessary to perform actions aimed at promoting and stimulating them.

DECRETA the following:

LABOR CODE REFORM

Art. 1.-Reform the first paragraph of Article 309, as follows:

" Art. 309.-The employer is obliged to give to the pregnant worker, in the concept of maternity rest, sixteen weeks of leave, ten of which will be compulsorily taken after

of the delivery; and in addition, to pay her in advance benefit equivalent to seventy-five percent of the basic salary during such a license. "

Art. 2.-This Decree will enter into force one hundred and twenty days after its publication in the Official Journal.
