1 Decree N ° 166 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that the first paragraph of article 1 of the Constitution of the Republic establishes that: "El Salvador recognizes the human person as the origin and purpose of the activity of the State, which is organized for the attainment of Justice, the legal security and the common good;" and article 54 of the same provides that: "The State will organize the education system which will create the institutions and services that are necessary".
II.-that the General Education Act, approved by Legislative Decree N ° 917, dated 12 December 1996, published in the official journal N ° 242, taking N ° 333, dated December 21, 1996, establishes in its article 1 °: "education is a process of permanent, personal, cultural and social training that is based on a comprehensive conception of the human person their dignity, their rights and duties".
III. being a mandate to the State the integral protection of children and adolescents, is necessary to update the legislation, regulating the operation of shops and cafes school, from a perspective of protection of the right to health, in particular through the exercise of the right to a healthy diet, so that they can have a healthy food supply nutritious, safe and adequate schools public and private in the country inside, in order to enable their evolutionary development and facilitate their learning process.

DECREES, the following: reforms to the law GENERAL of education article 1.-added a second paragraph to article 113, and reform the current second paragraph that happens to be third in the following way: "the Ministry of Education issued regulations that is intended to regulate and control the marketing of foods high in fat, salt and sugar, and all those who do not contribute to healthy eating within school cafes and shops.
"Violations of the first paragraph of this article shall be sanctioned under the law of the teaching career and the disciplinary regime of the present law."
Article 2.-merge an article 113-A, in the following manner: "article 113-A-managerial school boards of officers of education centres and private education centres directors, shall ensure compliance with the regulations issued by the Ministry of education for the transparent operation, monitoring and control of the shops and cafes school, establishing coordination mechanisms necessary for preparation and hygienic handling distribution and sale of food in schools. As well as the promotion of healthy eating in the educational community."
Article 3.-merge an article 113-B, in the following manner: "article 113-B.-shops and cafes, school administrators should ensure the availability of healthy, safe, affordable and culturally acceptable foods that have nutritional value suitable for the development of girls, boys and adolescents who are studying in schools."
Also the shops and cafes school positioned the menu in a visible place with the list of food prices, for students of schools."
Article 4.-merge an article 113-C, in the following manner: 3 "article 113-C.-the Ministry of education shall coordinate with the Ministry of health, their collaboration for the elaboration of the rules established in paragraph two of article 113 of this law, in order to determine technical for issuance criteria and mechanisms of supervision of the marketing and distribution of healthy shops and cafes school."
Also the Ministry of education should develop joint activities with the Ministry of health which have as their purpose the promotion of a culture of healthy eating in the educational community."
Article 5.-this Decree shall enter into force eight days after its publication in the official journal.
