1. Decree No. 174, the Legislative Assembly of the Republic of EL SALVADOR: I.-that the Constitution in its article 1, provides that El Salvador recognizes the human person as the origin and purpose of the activity of the State, which is organized for the attainment of Justice, the legal security and the common good. Also recognized as a human person to every human being from the moment of conception.
II. that by Legislative Decree No. 17 of date 4 of March of thousand nine hundred forty, published in the Official Journal No. 56, vol. 128 number of date March 7, 1940, aired the employees act, holidays and licensing of public employees, which in its article 5, paragraph 2, establishes a childbirth leave and in its article 9 paragraph 1 ° develops the form in which such leave shall be granted.
III. that by Legislative Decree number 143 date October 8 this year, was issued reform of the labour code in its article 309 paragraph 1 °, in order to grant the worker pregnant 4 weeks more in concept of license by maternity.
IV.-that the most important of the breastfeeding benefits for the newborn, are reflected in the health and survival of the same, as a result of both physical and mental development that it confers, being also a right of children which is protected by international conventions and national laws such as the law on protection of children and adolescents (LEPINA).
V becoming necessary to harmonize the law of making, holiday and licensing of public employees, to guarantee the right of equality established in article 3 of the Constitution, for all working women pregnant, whether private or public sector in the sense of giving them 4 weeks more in concept of license for maternity.
Therefore, in use of his constitutional powers and at the initiative of the deputies Santiago Flores Alfaro, David Ernesto Reyes Molina, Mario Alberto Tenorio Guerrero, Silvia Alejandrina Castro Figueroa, Nelson de Jesus Quintanilla Gómez, René Gustavo Escalante Zelaya, Jaime Orlando Sandoval Leiva; and with the support of the Deputy Mártir Arnoldo Marín Villanueva.

(2 DECREES the following: reforms to the Act of making, holiday and licenses of the employees public article 1.-reforming the numeral 2) of article 5, in the following manner: "2) maternity leave."
Article 2.-reform paragraph 1 of article 9, in the following manner: "article 9.-licences for maternity leave shall be granted following in general the same rules laid down for licences by disease; but each birth may not be granted one licence more than sixteen weeks; ten of which will be taken compulsorily after confinement, and must be granted inevitably anyone who is working for the interested time."
Article 3.-this Decree shall enter into force 120 days after its publication in the official journal.
