DECREE NO 244
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
CONSIDERING:
I.-That in accordance with Art. 53 of the Constitution of the Republic, the right to education and culture is inherent in the human person; consequently,
is the primary obligation and purpose of the State its conservation, promotion and dissemination. The State will encourage research and scientific work.
II.-That by Legislative Decree No. 234, dated December 14, 2012,
published in Official Journal No. 34, Volume No. 398 of 19 February 2013, was issued on Law on Scientific and Technological Development, which aims to establish guidelines for the development of science and technology, through
the definition of fundamental institutional and operational instruments and mechanisms for the implementation of a National Policy of Innovation, Science and Technology, through the implementation of a National Science Plan and
Technology, which constitutes the reference framework of the National Agenda of Research.
III.-That Article 23, second paragraph of the Law, establishes that the personnel who, by virtue of of the provisions of the first subparagraph, become part of the MINED, for the purposes of accounting and payment of its working time, will be considered the
time worked for the Council.
IV.-That in order to avoid that the mentioned provision is applied differently,
causing legal uncertainty, it is necessary to interpret authentically the article 23, in its second indent, in the sense that the employees who worked in the National Council of Science and
Technology, CONACYT, that were incorporated into the Ministry of Education, MINED, after the entry into force of the Law, the labor liability, equivalent to one month of salary per year worked, must be cancelled, calculated
from the date on which each employee entered to work to the Autonomous Institution CONACYT, until the date on which they entered the MINED. After the entry into force of the Law mentioned above, the aforementioned employees will no longer be entitled to the annual payment of one month's salary per year worked, as their regime
is the same one that applies to the rest of the employees of the Ministry of Education.

DECCRETA:
Art. 1.-Article 23, second indent of the Law on Scientific and Technological Development, contained in Legislative Decree No 234, dated 14 December 2012, published in Official Journal No 34, Volume 19 of 19 December 2012, was authentic. February 2013, in the sense that the staff who
under the provisions of the first paragraph of that same article, became part of the Ministry of Education, will be paid the employment liability, will be paid one month's salary per year or The National Council of Science and Technology, CONACYT, has worked for the National Council of Science and Technology.
from its date of entry to the aforementioned Autonomous Institution, to the date of incorporation into the Ministry of Education-MINED.
Art. 2.-This Authentic Interpretation is understood to be incorporated into the text of Article 23,
second indent of the Law on Scientific and Technological Development.
Art. 3.-This Decree shall enter into force eight days after its publication in the Official Journal
.
