DECREE NO 313

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That the Constitution establishes that El Salvador recognizes the human person as the origin and the end of the activity of the State, which is organized for the

attainment of justice, legal and security common good, as well as the right to life, physical and moral integrity, to freedom, to the security, work, property and possession, and to be protected in the

conservation and defense of the same.

II.-That by Legislative Decree No. 1030, dated April 26, 1997, published

in Official Journal No. 105, Tomo N ° 335, dated June 10 of the same year, the Penal Code was issued.

III.-That sport, in general, plays an important role in the integration of positive values in society; however, it has been punctuated by the actions of the networks of national and international organized crime in the purchase of professional sports meetings

IV.-The cost of undermining institutionality and the

values of ethics, justice and democracy.

IV.-That Sports Fraud is not only against the integrity of the

sports results and the trust of the In addition, it does so against the purity of the results of tests and sports meetings, the heritage of the spectators, sponsors and public bodies that

invest for their promotion and development.

V.-That currently our criminal legislation does not contemplate any typing that

configure the deliberate and fraudulent alteration of professional results, meetings or professional sports events, so it is necessary to incorporate the figure of the Sports Fraud into the Penal Code as a crime.

THEREFORE,

in use of its Constitutional powers and at the initiative of the deputies and deputies Jackeline Noemi Rivera Avalos, Raul Omar Cuellar, Medardo Gonzalez Trejo, Bonner Francisco Jimenez Belloso; Emma Julia Fabian Hernandez and Guillermo Antonio Olivo Mendez (period Legislative 2012-2015) and with

DECCRETA, the following:

Reform of the Criminal Code

Article 1.-Incorporate an article 218-A, as follows:

Sports Fraud

Art. 218-A.- The one who, by itself or by third person, compels or offers, promises, pays or repays with any kind of benefit, in order to alter or ensure a predetermined result of a

professional sports competition or test, national or international, or the abnormal performance of a participant in the same, will be punished with imprisonment of two to four years and special disablement for the same time.

In equal sanction will incur the one that of itself or through a third person, request or receive a payment or any benefit for the purpose of deliberately altering and fraudulently the result

of a professional sports competition or test.

The penalty will be aggravated with imprisonment of three to five years, when the offence has been committed by

official, leader, manager, administrator, coach, referee, referral or judge, promoter or employee of a club or sports entity of any legal nature and special disablement for the same time.

Who in representation of the country as a national selected, individually or collective,

will incur the above mentioned behaviors, will be sanctioned with prison Four to six years and special disable for the same time.

Art. 2. This Decree shall enter into force eight days after its publication in the Official Journal.
