Publication of a list of approved varieties of agricultural plant and vegetable species (varieties of variety) 1)

In accordance with paragraph 1 (1), Paragraph 1 and paragraph. 3, no. 2 and 8, cf. Section 1 (1) 1, in the legislation on seeds, potatoes and plants, cf. Law Order no. 195 of 12. In March 2009, and text labelling no. 167 of 24.21.01 of the Finance Bill of the year 2015 shall be adopted according to Article 5 (5). 1, no. 31, in the notice. 512 of 23. April 2015 on the duties and powers of the Natural Business Management Board :

Notification of variety of varieties

§ 1. Notification of a variety of seed of species covered by the notices relating to seed grain, arseed or vegetable seed, and seed potatoes, cf. the proclamations on the breeding of potatoes, for inclusion in the variety list, shall be submitted to the TyphontedFondFondFond; 10, Tystoften, 4230 Skell-crazy, on a form that is available from the Typhoon Foundation or www.tystofte.dk.

Paragraph 2. Notification may be submitted by the person responsible for the maintenance of the sort (maintenance) or by a representative of this.

Paragraph 3. The Theme Fund shall publish the deadlines for notification of a variety of blasts and of the test material submitted in October in the ' Messages of the Office '.

List of blacklist

§ 2. The Danish National Agency shall record a variety on the black list if, on the basis of an official examination at the TyphonteFund or an equivalent accredited institution of another Member State and the European Union, including, in particular, by means of sample cultivation, the following are :

1) Sorten is

a) independently, which means that the variety, irrespective of the artificial or natural origin of the source material, in one or more characteristic characteristics, is clearly distinct from any other variety known in this country or in a country ; Member States of the European Union,

b) sufficiently uniform, meaning that the variety, taking into account the propagation of the species, is made up of plants other than individual exceptions similar to each other or genetically identical in relation to the characteristics used in the investigation ; off whether the variety is uniform ;

c) stability, meaning that the variety of successive formations or, if the variety holder has determined a specific cycle of transformation after the completion of each cycle, still in its essential characteristics is in accordance with the description of the variety ; and

d) have a satisfactory cultivated and useful value, which means that the variety in relation to other varieties accepted on the plant variety right by its properties presents an improvement in the cultivation or exploitation of the crop and of the products that are in use, obtained from this, at least in a particular region. Individual unfavourable properties may be weighed up by other favourable properties.

2) The notifier's proposal for a variety name has been approved following the announcement on plant names.

Paragraph 2. The provision in paragraph 1 shall be 1, no. Paragraph 1 (d) shall not apply to :

1) grasses of grass for other than animal feed,

2) varieties of vegetable species, with the exception of the chicory root, and

3) varieties, including inbred lines and hybrids, which are solely to be used as components for hybrid varieties which meet the criteria for inclusion on a blacklist.

Especially about the variety of varieties of conservation of conservation and hobbies

§ 3. For the purposes of the situ conservation and sustainable use of plant genetic resources, the Wildlife Board may accept land-breeds or varieties of farmland and vegetable species whose region of origin includes Denmark, for inclusion in the variety list As a conservation black. Denmark shall be considered as a single region.

Paragraph 2. The Wildlife Agency may accept varieties of vegetable species with no actual commercial production value developed for the purposes of cultivation under special agricultural technical, climatic or soil conditions, for inclusion on the blacklist, Hobbits black.

§ 4. Notification of a land race or variety of farmland and vegetable species, cf. Section 1 (1). 1 to include in the black list as a container of black or heavour black must, in addition to the test material, for the identification of the identity checks :

1) description of the marked characteristics of the variety, and its designation (variety name),

2) any results of non-official analyses to which notifies are in possession,

3) information on practical experience of growing, multiplication and use of the variety ; and

4) information on the variety of the institutions responsible for plant genetic resources.

Paragraph 2. In addition to the notification of a container, the information referred to in paragraph 1 shall be required. 1 shall be accompanied by information on the region of origin of the variety.

Paragraph 3. In addition to the notification of a heap variety, the information referred to in paragraph 1 shall be provided. 1 shall be attached to the evidence that the variety is without any actual production value and that the variety has been developed for the purposes of cultivation under special agricultural technical, climatic or soil conditions.

§ 5. Sorter shall be approved and included on the blacklist as "conservation black" if the Natural Acquids of Natural Services estimate that the variety is :

1) is of interest in the conservation of plant genetic resources and

2) on the basis of the identity check sufficient to comply with the requirements of section 2 (2). 1, no. 1 (a-c).

Paragraph 2. In the case of varieties of vegetable species, these shall be included in the black list, cf. paragraph 1, by the name of :

1) ' conservation black, the seed of which is certified in accordance with Article 10 of Commission Directive 2009 /145/EC, or controlled in accordance with Article 10 of the Directive ', or

2) ' conservation black, the seed shall be checked in accordance with Article 11 of Commission Directive 2009 /145/EC `.

§ 6. Sorter shall be approved and included in the blacklist as ' heav-black ` if the Office of the Natural Actors considers that the variety has been approved,

1) is without actual production value,

2) have been developed for the purposes of cultivation under special agricultural engineering, climatic or terrestrial conditions ; and

3) on the basis of the identity check sufficient to comply with the requirements of section 2 (2). 1, no. 1 (a-c).

Paragraph 2. Header varieties shall be included in the variety denomination by the designation ' black, developed for the cultivation of special conditions, the seeds of which are checked in accordance with Article 26 of Directive 2009 /145/EC `.

§ 7. The Wildlife Board may not approve a black as a container of black or heap black, if :

1) the variety has already been included in the Community plant variety right of agricultural plant species or vegetable species as a variety other than a black or a box black,

2) the variety has been deleted by the Community blacklist in the last two years or within two years of the expiry of the time limit for certifying and trade, which may have been granted under section 14, or

3) the variety shall be protected by a national plant variety right or by a Community plant variety right under the Council Regulation (EC) No 2 ; In the case of treatment, 2100/94 or there is an application for such variety rights.

Specific limitations

§ 8. The Office of Natural Acquisitions may only record a genetically modified variety on the black list if it is approved for cultivation in the European Union.

Paragraph 2. Is material of a genetically modified variety intended for use as food, as set out in food, cf. Article 3, or as a feed, cf. Article 15 of the Regulation No 2 of the European Parliament and In 1829 /2003/EC on genetically modified food and feed, the variety shall be included in the variety list only after it has been authorized in accordance with that Regulation.

§ 9. The Office of the Natural Safety Agency may refuse to include a variety on the black market if the cultivation of the variety can lead to the risk of human, animal and plant health or the environment.

Testing of varieties

Testing for test results, etc.

§ 10. The Theme Fund shall inform the notifiers every year of the results of the official value test and shall publish the test results. At the request of a notifier, the Interim Fund may not publish preliminary test results which are not to be rendered in enquiries to a customer base.

Exception or truncation of testing

§ 11. The type of the substance shall be without prejudice or truncation of a declared black in the case of the characteristics referred to in section 2 (2). 1, no. 1 (a) (c) to the extent that results from an official examination in another Member State of the European Union shall be tested. The test fund may also shorten the test in the case of a container in the case of a container.

Paragraph 2. In the case of the test for the cultivation and use of the crop, cf. Section 2 (2). 1, no. However, paragraph 1 (d) may use the results of the official recognised studies in another Member State of the European Union, but not results from animal-based studies.

Maintenance drool

§ 12. Maintenance of the maintenance

1) ensuring in a systematic organised breeding work (maintenance drool) that the propagation material of the variety corresponding to the information in the black-market variety shall be kept in the form of the approved variety ;

2) maintain and maintain records of the propagation of the variety for the maintenance of the maintenance, including the records of the generations prior to the basic material ; and

3) for the test of seed or laying stock, the variety of varieties shall be made available to the Type of Material for the verification of the type of seed or the laying stock.

Paragraph 2. The maintenance of maintenance shall be carried out in another Member State of the European Union and in States whose control is equivalent to that.

Paragraph 3. The provisions of paragraph 1. 1, no. TWO, TWO. indent, and paragraph 1. Two shall not apply to conservation varieties which have a region of origin in Denmark alone.

Repeator of Blacklist Approval

§ 13. The approval of a black is valid for the expiry of the 10. calendar year after approval was given.

Paragraph 2. The approval of a black may be extended for a period of 10 years at a time if the importance of maintaining the cultivation of the variety is justified by the maintenance and maintenance of the maintenance or representative, cf. Section 1 (1). 2, can document the variety

1) continue to comply with the conditions of approval, cf. Chapter 2, and

2) has been maintained in accordance with the provisions of section 12.

Paragraph 3. The application for an extension of approval shall be submitted in writing to the Type of Theme Fund within two years before the approval expires. The application may be submitted only by the maintenance or his representative, cf. Section 1 (1). 2. If the application is not completed before the approval expires, the approval will be extended until the case is closed.

§ 14. The board on an approved black can be certified, respectively controlled as standard seed and sold until the 30. June of the third year after the expiry of the approval. If the maintenance provider does not want to make use of this option, then the subject matter must be communicated to the Theme Foundation within the expiry of the approval.

§ 15. The thieving font of the variety of varieties from the variety list in the following cases shall be the case :

1) It turns out that the variety was not self-employed when it was approved, unless the variety now meets this requirement.

2) It turns out that the variety is no longer uniform and stable.

3) The maintenance request is requested.

4) It is found :

a) the maintenance does not maintain the variety ; or

b) the approval of the variety has been done on the basis of incorrect or fraudulent information.

5) The maintenance of the holder, in spite of the request

a) does not provide necessary propagation material of the variety at the disposal of the Type of Material for inspection or

b) does not pay due fee due in due time.

Paragraph 2. The type of the substance test Foundation may reject a request in accordance with paragraph 1. 1, no. 3, if the variety is essential for land use in this country, and the systematic maintenance of maintenance to be ensured in another way.

§ 16. § 12, § 13, paragraph 1. 2, no. Two, section 15, paragraph. 1, no. Paragraph 4 (a) and paragraph 1. 1, no. Paragraph 5 (a) shall not apply to heap sorter.

§ 17. All available information on the variety and on the basis of the approval, including a description of the variety and the results of the tests, are included in the blackmarket.

Paragraph 2. The type of goods shall keep standard samples of the seed and the laying stock of all approved varieties for use by a possible position on whether a variety of varieties continues to comply with the conditions to be included in the variety list.

Publication

§ 18. The thieving font shall publish the variety of varieties.

Entry into force, etc.

§ 19. The announcement shall enter into force on the 15th. August 2015 and has effect from 1. July, 2015.

Paragraph 2. Publication no. 1492 by 15. In December 2010, a list of approved varieties of agricultural plant and vegetable species (variety list) is hereby repealed.
