Decision amending Regulation on the establishment of areas for joint recovery of raw materials from the seabed

(Reduction of areas, annual ceilings for recovery, sharp reporting requirements and modification of standard terms etc.)

§ 1

1398 of 1 December 2013 laying out areas for joint recycling of raw materials from the seabed are the following changes:

1. In The opening ‘and § 38(1),’ shall be amended to: ‘§ 34, § 38(1) and 2, and § 44(3).’.

2. In § 2(3), is inserted as 2. item:

‘For areas where there are frequent reporting of the amounts referred to in section 6 a(1), the Natural Authority shall send the period between the update of the website as necessary information on the amount of the amount of the consent holders concerned.’

3. After Section 6, the following shall be inserted:

»Informing the amount of incoming amounts

§ 6 a. The Danish Medicines Agency may decide that the amounts in a specified area must be reported more frequent than the specified in the notice of application for authorisation for investigations and extraction of raw materials from the seabed and reporting of investigations data and raw materials.

Substances. 2. The authorisation holder shall enter the entire amount of which is left by the maximum total or annual recovery amount in an area, in accordance with Annex 3 and the amounts referred to in Section 2(3) shall be published or notified, the authorisation holder shall immediately send notice to the Natural Authority.

3. The decisions of the Danish Nature Agency by paragraph 1 cannot be admitted to other administrative authority.

Criminal rules

§ 6 b. Unless higher punishment is undermined by any other legislation, it is punished by fine it, which fails to conduct reporting as specified in Section 6(2).

Substances. 2. The punishment may rise to prison for until 1 year, if the breach is committed intentionally or gross negligence, and if there is a breach

1) harm to the environment or recalled hazards or

2) achieved or predicted an economic advantage for the individual or others, including savings.

4. Annex 1, paragraph 2.1-2.14, is replaced by Annex 1 to this notice.

5. In Annex 1 paragraph 3.6 as Section 3.6 of Annex 2 to this notice.

6. In Annex 1 shall be inserted after paragraph 3.7 as Section 3.7a Annex 3 to this notice.

7. In Annex 1 shall be inserted after Section 3.9 as Section 3.9 of Annex 4 to this notice.

8. Annex 1, paragraph 3.12, is repealed.

9. In Annex 1 paragraph 3.13 as Section 3.13a and 3.13 b Annex 5 to this notice.

10. In Annex 1 shall be inserted after Section 3.22 as Section 3.22 a-c Annex 6 to this notice.

11. In Annex 1 paragraph 3.29 as Section 3.29 of Annex 7 to this notice.

12. Annex 1, paragraph 3.38, is repealed.

13. Annex 1, paragraph 3.44, is replaced by Annex 8 to this notice.

14. Annex 1, paragraph 3.60, is repealed.

15. Annex 1, paragraph 3.77, is repealed.

16. Annex 2 is replaced by Annex 9 to this notice.

17. Annex 3 is replaced by Annex 10 to this notice.

Section 2

1. The decision shall enter into force on 1 April 2015.

Substances. 2. The terms set out in Annex 2 and 3, as indicated by the Annex 9 and 10 of this notice shall also apply for previously issued permissions.

3. In the areas set out in Annex 2-8, the maximum total amount of recovery shall be considered.

4. In the period from 1 January 2015 to 31 March 2015, in accordance with the applicable rules, the assessment of compliance with restrictions in the yearly permitted amounts set out in this notice.

General terms for the execution of raw material recovery in areas included in joint recovery

1.
Prerequisites for recovery
1.1
Quality assurance
Before initiating the recovery, the authorisation holder for the Danish Nature Agency must provide documentation that a plan for the quality assurance of the current work is established.
The authorisation holder must be able to document that the workers are carried out according to the quality assurance plan, and thus that they in the notice and the authorisation set out.
1.2 1.2
Recycling and position determination
Cancellation of the vessels carrying out raw material extraction pursuant to the authorisation must be sent to the Danish Nature Agency, cf. terms 5.1.1 and 5.1.2. Name, letter letters, IMO number and MMSI number and name, e-mail address and CVR number for the owner of the vessel and/or for the one who runs it.
Recovery craft must be equipped with and apply electronic position determination equipment with an accuracy better than 5 m in 95% of the time of 24 hours.
In recovery craft must also be equipped with and apply AIS (Automatic Identification System).
A recovery vessel can only be used when the Danish Nature Agency has confirmed that the AIS system is contacting the vessel, and that IMO number and MMSI number are entered correctly.
When the first advance in an area is made, the authorisation holder shall send notice to the Danish Nature Agency.

Notice of completion of recovery
When the authorisation holder first commences the recovery in an area, the notice must be sent to the Danish Nature Agency.
1.4
Documents to be found on the recovery vessel
A copy of the applicable general terms for the execution of raw material extraction in areas is subject to joint recovery and copy of the applicable recovery authorisation to the area and any decisions notified pursuant to Section 6(1) shall be available on the registration vessel.
2.
The organisation of work
2.1 2.1
Recovery methods
The work must be organised, so recovery and transport are carried out without the middle deposit on the seabed.
The work must be organised so that shipping traffic in the area is disturbed at least possible.
In terms of ship traffic, there must be no depth reductions in the area.
2.2
Base conditions
Drains must not exceed 1:6.
3.
Monitoring
3.1
The position of the recovery vessel and work
During recovery activity, the position of the vessel must be at least every 5 minutes documented via AIS.
In the crash of the navigation system with a duration of over 1 hour, the recovery must cease until the system is again operational.
3.2 3.2
Registration of incoming amounts
The amounts of amounts must be continuously registered, and it must be continuously monitored that the amount specified in the recovery area is not exceeded by the authorisation holder.
3.3
Marin archaeology objects and wrecks
During the work’s execution, it must be monitored whether the marine archaeology objects and wrecks of the archaeology. In this case, the instructions of the Danish Culture Authority’s ‘Instructuring concerning the registration of marine archaeology findings’ shall be followed. The instructions are attached to the permission and can be recovered at the Naturstyrelsen. The funds must be reported, cf. terms 5.1.2, 5.2, 5.3 and 5.4.
4.
End control
4.1
Eventual completion of finishing
If inspection measurements or other studies show that the conditions set are not complied with, the corrective measures must be carried out. Any corrective measures are carried out at the expense of the authorisation holder.
5.
Documentation and reporting
In this section a comprehensive list of the documentation to be submitted to the authorities.
5.1
For the Danish Nature Agency
5.1.1
Before recovery
Plan for quality assurance is submitted, cf. terms 1.1.
Notice shall be sent to vessels to be used in accordance with terms 1.2.
Notice shall be sent on the completion of the recovery, in accordance with terms 1.3.
5.1.2
During recovery
Time of crash and recovery of position equipment and recovery activities during the period must be notified within 24 hours after the start of the incident.
Detentions from the plan for quality assurance during work must be notified within 24 hours by electronic mail to nst@nst.dk with information on which measures have been made to remedy the deviations, cf. terms 1.1.
Any finds of marine archaeology objects and wrecks regardless of age must be reported in accordance with terms 3.3.
Information on insertion of new material during the recovery period shall be notified before inserting new vessel, in accordance with terms 1.2.
Within 2 weeks after the end of each quarter, reports to the Danish Nature Agency for the recovery shall be carried out in accordance with Section 9 of the Order of application for authorisation for investigations and extraction of raw materials from the seabed and reporting of investigations data and raw materials. In the case of a decision made pursuant to Section 6(a) of this notice, the applicant shall be liable.
5.1.3
After completion
Notice of final termination of recovery is sent as soon as possible.
If the authorisation holder has entered the entire amount of the published in the area, this shall be immediately notified, § 6(2).
5.2
For the Danish Culture Agency
Any finds of marine archaeology objects and wrecks regardless of age must be reported.

For Geodatastyrelsen
Any finds of wrecks regardless of age are reported.
5.4 5.4
The Danish Maritime Authority
Any finds of wrecks regardless of age are reported.
6.
Authority supervision
The Danish Medicines Agency shall supervise the advance in accordance with the chapter of the Danish Medicines Act 7. The permit holder must provide a sea host's transport and stay facilities available.
The authorisation holder shall withstand the control measures that public authorities may make to ensure compliance with the provisions of the recovery company. «
