Publication of the State's adult education support (SVU announcement)

In accordance with section 2 (2), 6, section 3, section. 3 and 4, section 4, section 5, section 4, section 6 (4). One, section 7, section 8, paragraph 8. 1-5, paragraph 9, paragraph 9. 2, section 12 (2). 3, section 13 (3). 2, 6 and 7, section 14 (4). 2, section 14 (a) (1). 5, section 16 (4). 2, section 19 (1). One and two, section 20. 3, section 21, paragraph. 1, 2, and 5, section 22 (4). 2 and section 23 (4). 4, in the case of the state's adult education support (SVU), cf. Law Order no. 554 of 8. June 2009, as amended by law no. 1566 of 21. December 2010 and Law No 1349 of 21. In December 2012, and after negotiating with the Minister for Food, Agriculture and Fisheries and the Minister for Employment, the Minister shall be authorised according to section 19 :

Chapter 1

Administration

§ 1. SVU is managed by the Management of the Higher Educational and Educational Support (Governing Board), cf. however, paragraph 1 3, 4 and 5.

Paragraph 2. The guidance guids the SVU administrators, cf. paragraph 4, and training centres on SVU.

Paragraph 3. SVU Administrators, cf. paragraph 4, counselor training seekers and employers of SVU and receiving, checking and forwarding applications for SVU, cf. § 17, paragraph 1. 2.

Paragraph 4. For the purposes of this notice, the SVU Administrator is understood as follows :

1) Anerwell-known unemployment figures.

2) Adult training centers (VUC).

3) University of Copenhagen.

4) Professor of the profession, LilleguinUniversity College, Professor of Professional College, V.A. University College, the University of Professor Nordjylland University College and the University College College College.

Paragraph 5. The training site shall check the study activity of the training study and decide on the activity event, cf. § 32.

Chapter 2

Certain conditions of support

§ 2. It is a condition to get the SVU that the training is full of 25 years, but at the beginning of the training period, it has not reached population retirement age after paragraph 1 of the Social Security Act, see it. however, paragraph 1 Two and three.

Paragraph 2. Training seekers can have the SVU for preparatory adult learning, the teaching of adults or special training for adults, if they are 20 years old.

Paragraph 3. The Management Board may, in exceptional cases, approve the fact that SVU is given to training seekers who are not 25 years old, for training carried out as part of a job-rotation project. A job rotation is understood to mean an agreement between one or more employees and an employer to participate in training, where the workers are replaced by one or more replacements immediately preceding the recruitment of the employment ; the job center as free. Both the employees and the devots must be employed by the employer throughout the course of the proceedings.

§ 3. Claim for employment in accordance with the provisions of Article 2 (2). 3, must be fulfilled in employment at a workplace in Denmark.

Paragraph 2. For a seasonal worker, non-attached or substitute teacher, he may meet the requirement for employment in accordance with the provisions of Article 2 (2). THREE, TWO. .. The recent period of employment shall be immediately preceding the term of the term.

§ 4. In order to get the SVU in accordance with Chapter 4, it is a condition that the training seeker is employed in a workplace in Denmark.

Paragraph 2. Employment in the country of employment shall be taken into account in accordance with Article 2 (2) of the Act of Employment. 4.

Paragraph 3. When deciding whether employment is subject to the provisions of Article 2 (2) (2) of the law. 4, fulfilled, full-time employment for wage earners employed by the employer who signed a leave of absence in the last 10 weeks prior to the application for SVU for 37 hours per week or in terms of employment in accordance with the agreement or similar conditions ; agreement between employers and employees may be equaged with full time. In all other cases, the person concerned shall be considered to be part time engaged.

Paragraph 4. When deciding whether employment is subject to the provisions of Article 2 (2) (2) of the law. The fourth is met, self-employed workers are considered to be full-time employed if they operate more than temporarily and to a significant extent in the business of self-employed workers. In other cases, the persons concerned shall be considered to be part-time employed.

§ 5. As employment, cf. Section 2 (2) of the law. 3 and 4, including periods of SVU, allowances for vocational training and training, adult training aid granted under the law of support for adult education and training granted under the law of leave, as well as : periods in which the training seeker has been in flex jobs or jobs with a wage subsidy for early retirement.

§ 6. If training is to be made redundant during training with SVU, it can be completed with SVU. Payable aid shall be paid to the employer, cf. § 28, paragraph 1. 2, this and the training-seeking notification shall be communicated to the Management Board for the purpose of a change of payment.

Paragraph 2. Paragraph 1 shall apply equally if the training applicant receives a new employer during training. However, it is a condition that the training exercise with the new employer will conclude agreements in accordance with the provisions of Article 2 (2). 5.

Paragraph 3. If the training exercise is to be established with effect from a time of education, the SVU may not be granted to the part of the training that is after the termination period, cf. ~ 30 (5)) 2.

§ 7. A training seeker is a study agent when the training exercise is actively participating in training and associated activities, including participation in compulsory training and prescribed tests, the tasks shall be carried out, according to rules, study arrangements or similar that applies to training.

Paragraph 2. The training seeker is considered to be a study agent until further ascertaining.

§ 8. In order to get the SVU, the training exercise must be registered to the population of Denmark or a Danish citizen or be entitled to SVU on an equal footing with Danish nationals under the EU's right or the EEA Agreement.

§ 9. Training seekers cannot get the SVU for a period in which they receive State education aid, reimbursement by participating in business-oriented adult and after-training, granting the right to leave and daily allowance on maternity leave, (maternity leave) or other public services intended to cover the cost of living.

§ 10. For the calculation of the length of school and vocational training, cf. Section 3 (3) of the law. 2, dismiss from

1) training which has not been completed ;

2) single-class education, which does not constitute an education, and

3) standalone courses.

Paragraph 2. For the calculation of the length of business-oriented training, cf. Section 3 (3) of the law. 2, no. Two, enter into internship periods.

Paragraph 3. The deprecated vocational training, cf. Section 3 (3) of the law. 2, no. 2, vocational training shall be regarded as training for training purposes ;

1) have not used in the past 5 years prior to the time of the application, or

2) does not apply and may make it possible that there is no possibility of using again, because it does not correspond to the current training.

Paragraph 4. The control can determine whether a training-seeking is short-trained, cf. in determining whether a training seeker is educated. Section 3 (3) of the law. 2, wholly or partially dismiss from

1) vocational training, if the training seeker can demonstrate that education cannot be used for health reasons, or

2) education or training from abroad, if the training applicant can plainly make it possible for schools or training to be not used in Denmark.

Paragraph 5. In the case of an application for a SVU for preparatory adult learning, the teaching of adults, special training for adult or Danish training for adult foreign nationals, etc., and cf. Section 11 (1). 1, no. 1, 2, 5 and 6, are disregarded from the condition in the section 3 of the law. 1 and 2 that the training-seeking must be a card-trained.

Chapter 3

Education at the level of public school and high school education that gives the right to SVU, including for the payment of the participating States ;

§ 11. SVU shall be provided to participate in the following training under the Ministry of Children and Education :

1) Preparing for adult education (VU) on the basis of the law of preparatory adult learning and dyspool training for adults.

2) Dictionary training for adults, according to the law of preparatory adult learning and the teaching of the provotees for adults.

3) Almen adult education (avu), after law on general adult education.

4) One-class education at the elementary school level after law of elementary school.

5) Special education for grownups, after the law on special training for adults.

6) Danish education for adult foreigners, and others, on education for adult education for adult foreigners and others.

7) Hf-education and hf-single-class law on training for higher preparation of preparation (hf law).

8) Student Exams by Law on Student Student Exams (Stx) (High School Act).

9) Hhx and htx, according to the law of education and training for higher commerce samen (hhx) and higher technical exams (htx).

10) Access to Engineering and the law of universities and the law on universities and others.

11) In particular, the training courses for which cover part of several training courses referred to in paragraph 1 shall be drawn up. 1-10.

§ 12. The SVU for the training referred to in section 11 is provided within a limited support system (the level of rock education and secondary education training) for a period of not more than 40 weeks. The cut card is made up of 40 clips that each corresponds to the full-time training week-education, cf. Section 22 (2). 1.

Paragraph 2. For the purposes of training, the SVU shall be granted the SVU at a maximum of 40 weeks or part-time training corresponding to this, cf. however, paragraph 1 4 and 5.

Paragraph 3. For the period of 40 weeks, cf. paragraph The maximum amount of aid shall be granted for preparatory adult learning, cf. 1 and 2. § 11, no. 1, 18 weeks, converted into full-time. SVU cannot be provided to participate several times in the preparatory adult learning stage.

Paragraph 4. In addition to the period of 40 weeks, cf. paragraph 1 and 2, training seagoing, which is 20 years old, but not 25 years, until 18 weeks into full-time, swine vesicular disease will be able to be used for adult training, cf. § 11, no. 1, worsened training for adults, cf. § 11, no. 2 or special training for adults, cf. § 11, no. 5.

Paragraph 5. Educational seekers who may not be able to obtain the SVU within the period referred to in paragraph 1. 1 and 2, due to deduction after paragraph 13 (3). 1, of the aid paid before 1. In July 2000, in up to 18 weeks, the SVU may be converted into full-time for preparatory adult learning, cf. § 11, no. 1, worsened training for adults, cf. § 11, no. 2, or special training for adults, cf. § 11, no. 5.

Paragraph 6. The control can be determined that the periods of 40 and 18 weeks referred to in paragraph 1 shall be determined. 1-5, if a training seeker who has been delayed in training due to illness, maternity or the like, reinvies the training after a period of absence for one of these reasons.

Paragraph 7. In the case of claims for reimbursement of unduly received swine vesicular disease, similar clippings to the clippecal shall be returned.

§ 13. Vocsence training aid assigned to the page 1. In October 1989, the period of 40 weeks referred to in paragraph 12 (2) shall be deduct. One and two.

§ 14. The SVU shall be awarded to training seaers receiving the SVU to participate in training, corresponding to the actual participant payment.

Chapter 4

Higher education that gives the right to SVU

§ 15. SVU shall be provided to participate in the following training under the Ministry of Research, Innovation and Higher Education, which are not offered as a commercial enterprise :

1) Higher education and training for higher-level education (training for adult education), etc., which are subject to a training notification.

2) Additional training activities in order to meet access requirements to training where access requirements have been laid down, and which have been offered in accordance with section 2 (2). 2, in the law of open training (professional adult education), etc.

3) Master training to be offered in accordance with section 5 (5). 1, no. 1, in the case of universities (university law), which is covered by an education notice.

4) The second after-and further training offered in accordance with section 5 (5). 1, no. Two, in the university law, which is covered by a training announcement.

5) Supplementary training activities to meet access requirements for candidate training offered in accordance with section 5 (5). 1, no. Three, in the university law.

6) Individuals in the subtidal training which universities are approved to provide for full time, cf. Section 5 (5). Two, in the university law.

Paragraph 2. SVU may be provided to participate in combinations of the training referred to in paragraph 1. 1, no. 1-6.

Paragraph 3. In addition, the SVU can be provided to participate in the following training, which is not provided as a commercial enterprise :

1) The strengthening of training for adult fishermen and ship sabers training for the guidance of the management of adult operators and ship sasists.

2) Shipsmashes training after notification of training for the shipwrestage of adult skilled shipwrestage.

3) Questginum training in accordance with section 14 (4). 2, in the notice of semen collection and insemination of bovine animals.

Paragraph 4. This is a condition for granting the SVU to the education provided for in paragraph 1. 1-3, that training activities are planned for full-time, cf. section 24 (2). 1.

§ 16. SVU for higher education shall be given in accordance with a limited support system of not more than 40 weeks at a time of full. The decision to grant the SVU to an education may be made at the time of the application.

Paragraph 2. The control can be determined that the period of aid under paragraph 1 shall be that : 1 is extended if a training seeker, which has been delayed in training due to illness, maternity or the like, reinvies the training after a period of absence for one of these reasons.

Paragraph 3. In the case of claims for reimbursement of undue payment of the SVU, the consumption of periods with SVU has been reduced accordingly.

Chapter 5

Application for SVU, including Participant Payment

§ 17. The steering will assign SVU, including participant payment, after application, cf. § 37, paragraph. 3.

Paragraph 2. The training seeker delivers the application to an SVU administrator, cf. Section 1 (1). 4. If the SVU is sought for training in section 11, the application shall be delivered to one of the SVU administrators referred to in section 1 (1). 4, no. If the SVU is sought for training in section 15, the application shall be handed down to one of the SVU administrators referred to in section 1 (1). 4, no. One, three or four. SVU administrator forwards the application to the Management Board no later than eight (8) days after an adequate completed application has been received. The control can be determined that the request is forwarded in electronic form. The application may not be delivered at the earliest three months before the training begins.

Paragraph 3. Filing applications shall be kept comforting when they are not in use. The applications must be kept for five years.

§ 18. The training seeker shall inform the person number of the application and provide the information necessary for the allocation and payment of the SVU, including for the payment of payments.

§ 19. The employer ' s employer shall, on the application, verify the training of the training seaman's information on employment relations, including the order of the Orlov Agreement. The employer shall also notify the information, including SE or CVR numbers, for the allocation and payment of the SVU and the support for the payment of the payments.

20. The place of education shall, on the application, confirm that the training exercise has been accepted or has been committed to recording and providing the information on training, including the duration and scope of training, etc. that are required for the purposes of such training ; the allocation of swine vesicular disease and support for the payment of payments.

Chapter 6

Scope and calculation of SVU

§ 21. The SVU shall not be provided at the earliest days of the training training exercise and the earliest from the end of the calendar week in which the training-seeking-age-25 or 20-year period is required, cf. Section 2 (2). One and two.

Paragraph 2. If the application has not been received with the SVU administrator, cf. § 17, paragraph 1. 2, no later than the day on which the training exercise begins in training, shall be granted aid from the end of the calendar week in which the request is received.

Paragraph 3. Notwithstanding paragraph 1 2 support shall be granted on the day when the training-seeking begins in training, if the party to receive the aid is paid out, may prove that the delay is not due to their relationship.

§ 22. For full-time training, cf. section 24 (2). 1 and 2, the SVU shall be granted on the basis of an ubitation equivalent to 80% of the highest amount of unemployment benefits, cf. Section 47 in the law of unemployment insurance, etc.

Paragraph 2. SVU shall be eligible for partial training for the training referred to in section 11. Partial training shall be reduced proportionately, cf. paragraph 3.

Paragraph 3. For part-time training where the work performance is established according to ministerial rules, SVU shall be granted in relation to the work effort. In addition, SVU per part-time training shall be provided. curriculate with 1/37 of the insatiation for full-time training.

Paragraph 4. A teaching class is a lesson of at least 45-minute duration.

Paragraph 5. The SVU shall not be provided for training periods that exceed the weekly reduction in working hours.

-23. Participation in training, which, according to law or rules laid down by law, includes sample, shall continue to be the SVU for the test preparation and for the participation of the test. As regards the training referred to in section 11, swine vesicular disease shall be calculated for the test preparation and participation in tests on the same basis as the SVU, which was carried out immediately before the notification has ended. In the case of the training referred to in paragraph 15, it is a prerequisite that the test preparation and the test participation require a working response at full time.

§ 24. For full-time training :

1) Subviewing established as a full-time class according to ministries laid down.

2) Teaching approved as a full-time education for the purposes of granting State aid to education.

3) Other training courses if the training includes at least 20 under-class exhibieses per week.

Paragraph 2. In addition, at higher-level long-term training, education, part of training, or a specific planned course, which is offered by the educational site as a total cycle, shall mean that the standard of the ECTS points corresponds to the training period. A student year work is a full-time student's work for 1 year and corresponds to 60 points in the European Credit Transfer System (ECTS point).

Paragraph 3. At part-time training, the weekly training period shall be at least 6 hours, cf. however, paragraph 1 4.

Paragraph 4. SVU can be given to part-time training, adulthoseeducation, moderation training for adults or special training for adults when the weekly training period is at least 3 hours.

§ 25. The steering can dismiss from outages in the teaching of shorter ordinary holiday periods and other shorter interruptions during periods in which no education is carried out if the training exercise is not resuming its work under the interruption.

SECTION 26. The reduction of weekly working hours cannot exceed the average weekly working time of the training exercise in the past 10 weeks preceding the application for SVU in current employment, cf. Section 2 (2) of the law. 1, no. Secondly, for a training seeking in employment as a salary recipient, the working time of the employer signed on leave of absence is the subject of the contract of leave. Section 2 (2) of the law. 5 to be included in the calculation of the average weekly working time, cf. 1. Act.

Paragraph 2. In order to be able to provide the SVU for full-time training, weekly working hours must be reduced by at least 37 hours or with an hourly equal to full time for the industry in question. If the reduction of weekly working hours is less, the SVU shall be granted with 1/37 of the ubitation per. the hour the working time is set up. If the employee has not been employed for a fixed weekly working time or document the employee ' s work in several hours rather than corresponding to the employment, the actual hours (earhours) must be at least 37 hours per week.

Paragraph 3. In the case of the SVU, the weekly reduction in working time must be at least 6 hours, in the course of preparatory adult learning, the dyspool training for adults or special training for adults, however, for adults, however, at least three hours.

Chapter 7

Payment and disbursement of payment

§ 27. The steering shall be paid out of the SVU, including to the participant payment, with effect from the time that is specified in section 21 when the necessary information for the payment has been received in the Management Board.

§ 28. Payments shall be made in arrears by 4 or 5 weeks to the training of the training seaman after deduction of A-tax deduction. Each payment period ends next Sunday for one month.

Paragraph 2. Training seekers who receive pay in training from the workplace from which granted leave may be reached by an agreement with the employer that the SVU is paid back for 4 or 5 weeks from the employer ' s Nemkonto. It is a condition that the pay, the training seagoing recipient, shall be at least equivalent to SVU. The amount of the payment shall be granted to the employer when paid to the training seeker for the same period. Until then, the amount shall be kept separate from the other assets of the employer.

Paragraph 3. Paragraph 2 shall apply mutatis muctis to the payment of SVU to participant payment, where the employer shall have the participant in charge.

§ 29. The steering will stop the payment of SVU, including participant payment, in accordance with section 30-32 after notification from the SVU Administrator.

Chapter 8

Distraction of SVU, including participant payment

-$30. This is a condition for getting the SVU, including the participant payment, that the training seeker is a study agent, cf. Article 7, unless the training seeker has had a legal decline.

Paragraph 2. If the training seeker ceases to attend training, no longer meets the conditions in § 2 and section 3 of the Act or covered by Section 14 of the Act, the aid shall be suspended for the remainder of the training with the end of the calendar week ; where the training exercise terminates, or the conditions are not fulfilled.

§ 31. SVU, including for participating payments, shall be granted up to two weeks after the end of the calendar week in which a period of absence due to sickness, childbirth or similar begins. The training seeker shall give notice of sickness, maternity or similar to the training site.

Paragraph 2. Remaining granted aid falls unless the training exercise resusces the suspended education within a period of 1 year from the date of suspension of the training period, cf. stk.1. Recording assumes that the training seeker is still eligible, except for the conditions of section 2, age and Article 2 (2). 3 and 4, on the subject of prior employment.

§ 32. The place of education shall immediately inform the SVU that the training seeker has submitted an application for SVU where the training seeker ceasing to participate in training or is no longer a student of the studies and therefore the aid must therefore be used ; are stopped in accordance with section 30 (3). 2. The SVU administrator shall send the information to the Administrative Board without delay. The same applies if the training is absent due to illness, maternity or similar, cf. Section 31 (1). 1.

Paragraph 2. In other cases, the SVU administrator may receive information that the conditions of sections 2 and section 3 of the law have not been met, cf. ~ 30 (5)) 2, the SVU shall communicate the information to the Administrative Board without delay.

Chapter 9

Repayment

§ 33. The training seeker shall pay the SVU, including for the payment of payments, if the conditions of aid are not met and the training seeker knew or should know this.

Paragraph 2. In the case of a much paid SVU, including the payment fees, shall be paid back no later than 1. the month following 2 months after the claim is made.

§ 34. The control may dictation that the training seeking written or electronic recognition should be given to the obligation to repay the SVU, including the payment of the payment which is paid too much.

$35. The control may determine that too much out of the SVU, including the payment fees paid, shall be repaid with equal amount over a maximum period of three years. However, where exceptional circumstances are available, a longer period may be fixed. However, the individual rate may not be less than 500 kr. for the individual requirements.

Paragraph 2. The control can determine how the amounts paid are allocated on interest, principal and any costs.

Paragraph 3. The debt may be terminated for indemnable payment, if the debtor does not comply with the terms of the refund.

§ 36. The management may, in accordance with the application of the debtor, grant relief to the conditions of repayment, including postponement of repayment, whose debtor owing to unemployment, sickness, birth, protective duty or other special circumstances cannot : to the repayment.

Chapter 10

Deadlines, access to catching information, complain, etc.

§ 37. The Management Board shall determine in the individual case

1) Deadlines for payments and notifications,

2) to the extent to which applications meet, in addition to the applications referred to in Section 17, to be submitted in a special form, and

3) the extent to which information is to be given in writing.

Paragraph 2. The steering can require the information necessary for :

1) aid allocation ;

2) repayment and

3) administration, by the way.

Paragraph 3. The management shall draw up the schema material, etc. to apply for application, etc.

§ 38. The management shall supervise the tasks of the tasks referred to in section 1 (1). 3 and 5 shall be added to SVU administrator and training sites.

Paragraph 2. The Management Board may require all information necessary for the supervision of the supervision.

Paragraph 3. The steering can change the training of education tests for study activity, cf. Section 1 (1). 5, after complaint or on its own request.

Paragraph 4. The steering can authorize the individual SVU administrator to the styler's computer system.

Paragraph 5. The management of the SVU administrator and training sites shall pass on the information relating to the training seeker which is necessary for the purposes of the taking of tasks in accordance with section 1 (1). 3 and 5.

§ 39. The customs and tax authorities shall make available information to the Management Board on the tax credits of the training seaman to the extent necessary for the payment of the SVU. The information must be provided in a form suitable for electronic data processing.

Paragraph 2. The Central Person Register provides information to the Management Board for training, including person and address information. The information must be provided in a form suitable for electronic data processing.

Paragraph 3. Other public authorities and private institutions shall make available information to the Management Board on training, where the information is necessary for the calculation of SVU and for reimbursement. The information must be provided in a form suitable for electronic data processing.

§ 40. Decisions on the calculation, allocation, payment and repayment of the SVU may, within four weeks of the notification of the decision, be submitted to the Board of Appeal for the education and support of the decision to which the decision relates.

Paragraph 2. The appeal shall be made to the Board of Appeal for Educational Support and shall be sent to the Management Board. If the board maintains its decision, the Board shall send the complaint to the Board of Appeal with a statement.

Paragraph 3. Decisions taken by the training field of study activity, cf. Section 1 (1). 5, within 4 weeks of the notification of the decision, may be submitted to the board for the management of the decision to which the decision relates.

Paragraph 4. The Board of Appeal for Educational Support, cf. paragraph 1, or the management board, cf. paragraph 3, may, up to six months after the notification of the decision, disregard the overrun of the time limit referred to in paragraph 1. 1 and 3 when the overrun of particular grounds is excruciatable.

Chapter 11

Entry into force.

§ 41. The announcement shall enter into force on 1. March 2013 and shall have effect on applications for the state's adult education aid for training received from 1. March 2013, or later.

Paragraph 2. Publication no. 767 of 25. June 2010 on the State's adult education support (SVU notice) is hereby repealed.
