Law on the amendment of the Payments Denmark, the Law of Social Security, Act of Highest, Middle Interest, elevated general and general early retirement, etc. and different laws

(Transfer of duties of the Pension Management tasks to Udbetaling Danmark)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

Department of Social Affairs and the Ministry of Integration

§ 1

Law no. 324 of 11. April 2012 on Udbetaling Danmark is amended as follows :

1. I Section 1 (1). 1, pasted as no. 9-11 :

" 9) The Repatriation Act.

10) Law on active social policy.

11) Law of legal certainty and administration in the social field. `

2. I Section 13 (1). 1, the following shall be inserted after ' citizens ' : ' and undertakings `.

3. I Section 13 (1). 2, the following shall be added after ' citizens ' means : ' and undertakings `.

4. § 25, paragraph. ONE, TWO. pkt., is hereby repealed and the following shall be inserted :

" Contributions must be able to be held within the appropriation for the task of the Finance Bill for the year in which the contributions are to be covered. The Danish Administrative Board shall determine the size of the contributions. ` ;

5. § 25, paragraph. 2, revoked.

Paragraph 3-5 shall then be referred to in paragraph 3. 2-4.

6. § 25, paragraph. 3, there will be paragraph 1. Article is replaced by the following :

" Stop. 2. Payments Denmark shall notify each year to the individual Ministry of Scatalogue which has transferred State duties to Udbetaling Danmark, an estimate of the annual management contribution of the coming year at the latest by 1. August. When the next year's financial law is adopted, the Administrative Board shall determine the final administrative contribution of the Udbetaling Danmark. ` ;

7. I § 25, paragraph. 5, there will be paragraph 1. 4, is changed " cf. paragraph 1-4 "to :" cf. paragraph ONE-THREE.

8. § 25, paragraph. FIVE, TWO. pkt., there will be paragraph 1. FOUR, TWO. rectangle, revoked.

9. I Section 32 (1). 2, is replaced by ' 75 million. kr. " To : " 80 million. kr. "

10. I Section 32 (1). 2, pasted as Three. Point. :

' The loan shall be completed as quickly as possible and no later than the next two successive budgetary years in the case of loans for the taking of municipal tasks and no later than during the subsequent budget year in the admission of loans to the taking of state duties. `

§ 2

In the law of establishing the self-paying institution, Payments Denmark, cf. Law Order no. 334 of 22. March 2013, the following changes are made :

1. I § 8 (3) 1, is inserted after ' to be transferred to Udbetaling Danmark ` : `, in the period from 1. October 2012 to the 1. March 2013 '.

2. After paragraph 10 is inserted before Chapter 6 :

" § 10 a. The occupational pension from the occupational market shall be taken from the time of the transfer of tasks from the Pension Management Board to Udbetaling Danmark, all employees who are employed in the Pension Management Board or with the Pension Authority in accordance with the commune ; Agreement, provisions relating to wages and working conditions laid down or approved by the public authority, or individual contracts, cf. however, paragraph 1 2. The transfer of rights of employees shall apply by means of takeover by the takeover of the staff.

Paragraph 2. Employees who are predominating with tasks that remain state are not subject to paragraph 1. 1.

Paragraph 3. Officials employed in the Pension Management Board or with the Pension Board shall retain from the time of the transfer of the tasks of their official employment in the State in terms of the conditions to which the previous conditions have been made, and are obliged to : to serve in the Labor Market's Supplementary pension.

Chapter 5 a

Handling of assets in transfer of authority tasks from the Social-and Integration Ministry

§ 10 b. The Social and Integration Minister may, in the case of the assignment of tasks from the State to Udbetaling Danmark, state that the state keeps the ownership of assets linked to the management of the tasks transferred from the Pension Board ; to Udbetaling Danmark. If the Minister has decided to keep ownership of the assets, the occupational pension shall rent the assets until they are definitively written. The rent is equivalent to the decoy profile of the assets acquired. When the assets are definitively written, the Minister and the Labor Market ' s Supplementary Pension may agree that they are transferred to the occupational pension for the labour market. `

§ 3

In the Law of Social Security, cf. Law Order no. 390 of 19. April 2013, as amended by law no. 1386 of 28. December 2011 and Section 11 law no. 1380 of 23. December 2012, the following changes are made :

1. I Section 3, paragraph 3. 4, the "Director of the Pension Management Board" shall be replaced by the following : "Payments Denmark".

2. I § 46 b, 2. pkt., the words ' Pension Management ` shall be replaced by ' Payments Denmark `.

3. § 56 a ITREAS :

" § 56 a. Payments Denmark shall be responsible for the tasks relating to the population ' s pension, heating supplement, petroleum allowance, pension pension, supplementary pension provision and other addendum in accordance with Chapter 11. Payments Denmark shall also carry out tasks relating to the right to include a public pension or early retirement pension at permanent residence abroad and tasks relating to the right to receive an old-age pension at permanent residence abroad. In addition, Payments Denmark shall perform all tasks relating to the calculation and payment of early retirement.

Paragraph 2. Payments Denmark shall decide on the amount of the personal additional percentage and the cash flow of cash.

Paragraph 3. The Municipal Council shall perform the tasks relating to personal addendum and health allowance for the people of the People's Party. In addition, the municipal management board shall carry out the duties on early retirement which have not been mentioned in paragraph 1. One and two.

Paragraph 4. The local authority of the municipality of the residence authority must, without the citizen making an application to this effect, consider whether or not the citizen is entitled to second aid from the municipality when Udbetaling Danmark is refused retirement because of rules on earnings or on a person to be registered ; Rows pension. The local authority of the municipality of residence shall offer to provide guidance in accordance with section 5 of the law of legal security and administration in the social field when a pre-retirement pension is transferred to a pension. Payments Denmark shall notify the municipality of persons covered by the situations listed in 1. and 2. Pct. "

4. § 62 (2) 1, ITREAS :

' Payments Denmark shall exercise the powers conferred by the municipalities in accordance with this Act concerning pensions to be granted to persons resident abroad in accordance with this law, in accordance with Regulation (EC) No 2. '883/04 on the coordination of social security systems and by rules in agreements with other states'.

5. I § 62 (2) 3, the words ', including rules concerning the transfer of municipalities ' competence to the Pension Authority `.

6. § 62 a revoked.

§ 4

In the law of the highest, middle, average and general early retirement, etc., cf. Law Order no. 391 of 19. April 2013, the following changes are made :

1. I Section 3, paragraph 3. 3, the "Director of the Pension Management Board" shall be replaced by the following : "Payments Denmark".

2. I § 45 B, 2. pkt., the words ' Pension Management ` shall be replaced by ' Payments Denmark `.

3. § 52 b ITREAS :

" § 52 b. Payments Denmark shall perform the tasks relating to the calculation of early retirement payment, assistance allowance, care allowance, invalidity allowance and admittance of Chapter 11 and all tasks relating to the heating supplement and petroleum allowance. Payments Denmark shall also carry out tasks relating to the right to include a pre-retirement pension at permanent residence abroad.

Paragraph 2. Payments Denmark shall decide on the amount of the personal additional percentage and the cash flow of cash.

Paragraph 3. The local authorities shall be responsible for the tasks of the law, which are not assigned to Udbetaling Danmark, cf. paragraph One and two.

Paragraph 4. The local authority of the municipality of residence shall offer to provide guidance in accordance with section 5 of the law of legal security and administration in the social field when a pre-retirement or recipient of invalidity allowance is transferred to a population pension. Payments Denmark shall notify the municipality of persons covered by the situation referred to in 1. Pct. "

4. § 56, paragraph. 1, ITREAS :

' Payments Denmark shall exercise the powers conferred by the municipalities in accordance with this Act concerning pensions to be granted to persons resident abroad in accordance with this law, in accordance with Regulation (EC) No 2. '883/04 on the coordination of social security systems and by rules in agreements with other states'.

5. I § 56, paragraph. 3, the words ', including rules concerning the transfer of municipalities ' competence to the Pension Authority `.

6. § 56 a revoked.

§ 5

In the repatriation law, cf. Law Order no. 871 of 29. In August 2012, the following changes are made :

1. I ~ 10 (1)) 5, and § 10 (a) (a) 3 and 4, the words ' Pension Management ` shall be replaced by ' Payments Denmark `.

2. I § 12, paragraph 1. 3, the words ' Pension Management ` shall be replaced by : 'Payments Denmark'.

§ 6

In the area of law on legal security and administration in the social field, cf. Law Order no. 930 of 17. September 2012, as amended by Section 7 of Law No 326 of 11. April 2012 and Clause 13 in Act No. 1380 of 23. December 2012, the following changes are made :

1. I Section 2 (2). 1, the words ', Pension Authority `.

2. I § 11 a, paragraph 1 6, the words ' and the handling of cases in the Management Board '.

3. I § 11 a, paragraph 1 6, pasted as Act 2. :

' Similarly, in the case of Udbetaling Danmark's processing of cases according to the law of social pension and law of highest, middle, general and general early retirement, etc. for persons residing abroad. `

4. The heading for Chapter 8 ITREAS :

" Chapter 8

Payments Denmark '.

5. § 48 ITREAS :

" § 48. The Social and Integration Minister may lay down rules that Udbetaling Danmark is competent institution in relation to which country's legislation on social security to be used in accordance with EU rules and social security agreements.

Paragraph 2. The Social-and the Minister for Integration can lay down rules on how Udbetaling Danmark should provide technical assistance to the trademark of tasks related to international social security. `

6. I § 49 the words ' Pension Management ` shall be replaced by ' Payments Denmark `.

7. I § 62 the ' Pension Management ` shall be replaced by ' Payments Denmark ' and ' Pension Management Board ` shall be replaced by ' Payments Denmark `.

8. § 64 revoked.

9. I § 64 a pasted as paragraph 2 :

" Stop. 2. The same applies to :

1) decisions on aid to Danes abroad in accordance with section 6 of the Act of Active Social Policy,

2) decisions on compliance with persons who, following a Community regulation on the coordination of social security schemes, are covered by Danish legislation on social security, cf. § 85 a, paragraph. 8, in the Act of Active Social Policy, and

3) decisions on the country ' s legislation on social security to be used which has been made by Payments Denmark pursuant to rules issued in accordance with Article 48 (3). 1. "

§ 7

Law no. 218 of 5. March 2013 on the amendment of the highest, middle, average and general early retirement, etc., the Social Security Act and the Act of Individual Housing Support (Voluntary Transition for Pre-Social Security Act) are hereby amended as follows : change :

1. Section 5 (5). 13, revoked.

Ministry of Employment

§ 8

In the Act of Active Social Policy, cf. Law Order no. 190 of 24. February 2012, as last amended by Law No 1399 of 23. December 2012, the following change is made :

1. I Section 6 (2). 1, the words ' Pension Management ` shall be replaced by ' Payments Denmark `.

Tax Exempties

§ 9

In the equation of the equation, cf. Law Order no. 405 of 22. April 2013, as amended by Section 2 of Law No 2. 1386 of 23. December 2012, the following changes are made :

1. I § 7, nr. 22, 1. pkt., the words ' Employment Minister ' shall be replaced by the following : ' customs and tax administration `.

2. I § 7, nr. 22, pasted as 3. and Act 4. :

' Customs and tax administration shall publish each year a list of the foundations, foundations, associations, etc., which have been approved. The customs and tax administration may fix a time limit for when an application and so on approval shall be received by the Fund, the Foundation, the association and so on may be included in the list for the year in question. ` ;

Ministry of Economic and Interior

§ 10

In the Act of the Central Person Registry, cf. Law Order no. 5 of 9. January 2013, the following change is made :

1. I Section 33 (4). 3, ' Social-and Integration Ministry ` shall be replaced by : 'Payments Denmark'.

Entry into force and transitional provisions

§ 11

Paragraph 1. The law shall enter into force on 1. June 2013.

Paragraph 2. Payments Denmark complements cases in case areas, as a result of the section 3-6 of the Act, be transferred to Payments Denmark and which, not before the entry into force of the law, is finally concluded by the Pension Board. Customs and tax administration will complete cases which, as a result of the Clause Act, are transferred to customs and tax administration if they have not been decided by the Pension Board at the time of entry into force of the law.

Paragraph 3. Payments Denmark may, without renewed consent, treat cases pursuant to paragraph 1. 2, if the citizen has given consent to the Pension Board after paragraph 11 a, paragraph, 1, in the law of legal security and administration in the social field.

Paragraph 4. Payments Denmark will inherit the Pension Board's claim against the citizen and the citizen's claim against the Pension Board, which may be at the entry into force of the law, in cases, as a result of the section 3-5 of the law, be transferred to Udbetaling Danmark.
